nature of the acquisition requires use of the authority cited:
Lacire, the incumbent, is the only responsible contractor with the capability of fully performing these services at this time because it is already familiar with the Government’s processes and staff. The Government cannot have any gaps or breaks in services or a reduction in capacity. The work cannot be distributed to other contractors at this time nor tasks or services distributed to other possible contractors. As the current provider of services, Lacire possesses the required skills and in-depth knowledge of the GCS requirements and operational environment to successfully support GCS’ contracting mission. Lacire has personnel in place with extensive knowledge and experience of on-going support efforts which would allow them to fully perform in a condensed time frame. This presumption of familiarity cannot be substituted, interrupted, or replicated by any other contractor within such a short period of time without excessive costs and risks to GCS.
Award to Lacire will require minimal additional training or hours. It will provide complete continuity of services until either civil servants are onboarded or a competitive follow-on effort is awarded. Under these circumstances Lacire is uniquely positioned as the sole source to continue performance. Any other source would result in unacceptable delays and risks to the government. The time and cost involved in finding and training personnel with the required skills and experience needed to operate in GCS’ unique and evolving environment for the relatively short period of the time increases the likelihood that GCS mission would be adversely impacted.
If the Agency pursued any other course of action, it would take 90-120 days to go through the pre-solicitation and pre-award process. Another 45-90 days to process and onboard these personnel. And another approximate 45-90 days to familiarize these new contractor personnel with GCS, its processes, et cet. This equates to six to 10 months and GCS does not have six to 10 months to be able to wait for the needed support.
FAR Clause 52.217-8 was included in the base contract, however, an evaluation of the option was not conducted prior to award.
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by subpart 5.2 and, if not, which exception under 5.202 applies.
No efforts made, but this J&A will be posted on the Governmentwide Point of Entry (GPE).
7. A Determination by the Contracting Officer that the Anticipated Cost to the
Government will be Fair and Reasonable:
The Government is receiving the same exact pricing currently in place in the subject contract in accordance with FAR 52.217-8. The Government anticipates adopting the current pricing and that pricing was already determined fair and reasonable by the Agency. However, an additional analysis is being completed since the option was not evaluated with the award. In order to determine the price for the modification is fair and reasonable, a survey of random GSA schedules was looked at to compare hourly rates for the same or similar services. Lacire’s price proposal contained three labor categories and hourly rates associated with those labor
13. Contracting Officer Certification that the Justification is Accurate and Complete to the Best of the Contracting Officer’s Knowledge and Belief:
I certify that this Justification is accurate and complete to the best of my knowledge and belief, and I determine on the basis of the findings above that an other than full and open competition approach is in accordance with the requirements and is in the best interest of the Government.
