About this file
The document is the Ohio Attorney General's Office (AGO) Quick Quote Submission Standards for Suppliers, which outlines the procedural and legal requirements for potential suppliers submitting bids to the AGO. The standards cover comprehensive guidelines for bid submissions, including compliance expectations, reservation of rights, and specific conditions for offering goods or services under state contracts.
The document emphasizes key legal and procedural provisions, such as governing Ohio laws, fund certification requirements, and specific conditions for software licensing and vendor interactions. Notable requirements include the AGO's right to reject submissions not in its best interest, the need to include state contract numbers when applicable, and mandatory compliance with the Ohio Bureau of Criminal Investigation's (BCI) visitor policy. The standards also explicitly state that unilateral supplier terms, such as "click-through" or "shrink-wrap" agreements, are not binding, and the AGO retains sole discretion in procurement decisions.

Ohio Attorney General’s Office (AGO) Quick Quote Submission Standards for Suppliers
(1) Compliance with Instructions. Suppliers must follow all Quick Quote Standards and Instructions.
Submissions that do not comply may be rejected. By submitting a bid, suppliers agree to these Standards.
(2) AGO Reservation of Rights. The AGO reserves the right to reject any submission not in its best interest, or the AGO may decline to do business with any responding supplier. The AGO may cancel or reissue this Quick Quote at its sole discretion.
(3) State of Ohio Contract Identification. If a supplier is offering goods or services under a State Contract (e.g. STS, MMA, etc.) the submission must include the State contract number and expiration date. The AGO may give preference to suppliers on a State contract, even if their pricing is higher than non-contract responses.
(4) Applicable Laws.
• Governing Law. This procurement and any resulting purchase shall be governed by the laws of the State of Ohio.
• Invalid Terms. Any term deemed void or unenforceable under Ohio law (including the Ohio Constitution and ORC 9.27) will be removed, with the remaining provisions remaining in effect.
• Certification of Funds. In accordance with ORC 126.07, performance by the AGO is contingent upon appropriated funds. If funding is not continued by the Ohio General Assembly, the purchase will terminate without further AGO obligation.
(5) Submission of Terms and Conditions. If a supplier requires the AGO to review specific terms and conditions, those must be submitted with the bid. Unless explicitly agreed to in writing by the AGO, no supplier terms or conditions will be valid or enforceable “Click-through,” “shrink-wrap,” “browse-wrap,” or unilateral terms are not binding. AGO employees are not authorized to modify these Standards.
IF APPLICABLE:
(6) Software License. If a supplier is reselling software (including licenses), supplier warrants that: (1) supplier has the right to grant the license, (2) supplier has all necessary permissions to sell and the AGO may use the software for business purposes, (3) in the event the supplier is not the provider of the product, the License Provider’s terms apply but in case of any conflict, these Standards shall control.
(7) BCI Visitor Policy. All supplier employees, subcontractors, and subcontractor employees are subject to the Ohio Bureau of Criminal Investigation’s (BCI) Visitor and Non-FOP AGO Employee DNA Sample Collection protocol attached to this Quick Quote.
