(i)This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in FAR Subpart 12.6, FAR Subpart (13 or 15) and as supplemented with additional information included in this notice. This announcement constitutes the only solicitation; offers are being requested and a written solicitation will not be issued.
(ii)This solicitation is issued as an Request for Proposal (RFP).
(iii)The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2021-05.

CUSTODIAL OPERATIONS OF RECREATION AREAS

Description: The Contractor is to perform complete custodial operations and trash pickup as specified to insure the facilities below are maintained in a safe, attractive, clean, and sanitary manner at all times. All restroom facilities must be cleaned to CDC Standards (Attachment B). This contract includes custodial care of picnic shelters and toilet/restroom building(s) to include cleaning and disinfecting of restroom facilities (flush toilets/shower buildings and vault toilets) to CDC COVID-19 Standards and resupplying paper goods, emptying trash bins and resupplying trash bags, cleaning drinking fountains, trash pickup and disposal as specified for the entire site(s). Contractor will also be responsible for updating the maintenance log which indicates when the restroom was last cleaned.Custodial operations of Recreation Areas on the Davy Crockett National Forest including trash pickup as specified to ensure the facilities listed below are maintained in a safe, attractive, clean, and sanitary manner at all times.

All locations are located on the Davy Crockett National Forest, Houston County, Texas:

(1) Piney Creek Horse Camp: NFSR 566; (2) White Rock Horst Camp: NFSR 514D; (3) Neches Bluff Overlook: NFSR 511A; (4) Ratcliff Lake Recreation Area (Day Use): State Highway 7, Ratcliff, TX; (5) Ratcliff Lake Recreation Area (Sawmill): State Highway 7, Ratcliff, TX; (6) Ratcliff Lake Recreation Area (Camping): State Highway 7, Ratcliff, Texas.

FACILITIES AT EACH RECREATION SITE (Option Clean Once Opened- Group Shelters/Amphitheaters)

TERMS AND DEFINITIONS:

1. Safe: A condition free of hazards and not having a potential for personal injury or harm.

2. Clean: Free of impurities or foreign matter not normally a part of the original component and, if necessary, eliminating objectionable odors.

3. Sanitary: Promoting healthful conditions by the elimination of dirt, agents of disease or infection through ventilation, cleansing with disinfectants, or disposal of wastes. Restroom facilities must be cleaned to CDC COVID-19 standards.

4. Scrub: The use of brushes, stiff bristle (GI) type, with soap and clean water or other approved cleaning materials to produce a clean surface.

5. Contracting Officer (CO): The Contracting Officer administering the project, acting directly or through a duly authorized representative.

6. Contracting Officer Representative (COR): The person authorized in writing as the Authorized Representative of the Contracting Officer, acting within the limits of his/her authority.

7. Contractor: Means the company structure, including all partners, officers, and employees with interest in this contract.

8. Quality Control: Refers to action taken by the Contractor and/or their personnel to document, inspect, and control performance of services to insure they meet the specifications and requirements of this contract.

9. Quality Assurance: Refers to action taken by the Government to insure the Contractor’s quality control system is functioning and effective and that the Contractor is providing services which are in accordance with this contract.

GENERAL REQUIREMENTS

A. Materials and Equipment: Contractor shall provide all personnel, equipment, materials, supplies, personal protective equipment, supervision, and quality control necessary to perform all services described herein.

B. Vehicles: All vehicles utilized under this contract will be presentable, serviceable, and shall comply with safety standards as required by the State of Texas.

C. Minimum Manpower Requirements: The Contractor shall provide an adequate number of fully qualified personnel to perform the specified services properly and efficiently within the time limits specified.

D. Janitorial Supplies: Cleaning materials used shall be a product specifically manufactured for the surface to be cleaned and approved by the Contracting Officer Representative prior to use. Contractor shall submit a listing of products to be used for cleaning purposes prior to start. Use EPA List N (Attachment C) to document janitorial supplies proposal.

E. Repairs: Contractor shall be responsible for damage (caused by the negligence of the Contractor or Contractor’s employees) to buildings, fixtures, equipment and materials in connection with performance of this contract.

F. Maintenance Log, Work Signs - Out-of-Order, Cleaning/Servicing, etc.: The contractor will be responsible for updating the maintenance log indicating when the restroom was last cleaned. The Contractor shall place specified signs when cleaning/servicing any facility during operations. Every reasonable effort is to be made to keep the restrooms open at all times. The work/caution signs and barricades are a part of the contractor provided supplies.

G. Restocking and Resupply: Replace and Replenish Toilet Tissue as needed. Place fresh, full-sized rolls of toilet paper on all dispensers. Toilet Tissue will be provided by the Contractor.

H. Closing Area: The Contractor will not be allowed to close the area without instructions from the Contracting Officer.

I. Safety and Accident Protection: The Contractor shall comply with all applicable Federal, State, and local laws, ordinances, and regulations governing safety, health, and sanitation, and shall provide all safeguards, safety devices, and protective equipment, and shall take any other needed actions, on his own responsibility, that are reasonably necessary to protect the life and health of employees on the job and the safety of the public, and to protect property in connection with the performance of the work covered by the contract.

USE OF RECREATION AREAS

A. Contractors are advised that recreation areas are for the convenience and safety of the users and that customer service is of primary importance.

B. The Contractor’s personnel are not to accept payment or gratuties from the public for any services rendered. The Contractor is cautioned concerning the following items:

1. Do not distribute commercial items.

2. Do not attempt to be a law enforcement officer. Employees will not be permitted to wear simulated law enforcement clothing, badge/shield, etc., nor will they be permitted to have firearms on the recreation sites or administrative sites. Contractor's personnel shall cooperate with duly constituted law enforcement officers in the performance of their duties.

3. All misplaced/lost items found at the site shall be turned over to a Forest Service District employee. Each item shall be tagged showing date and place found, description of item and signature of finder

C. The Contractor or his employees will be limited to personal items on the premises as follows:

Items such as lunch boxes and ice chest/cooler, and personal protective gear. Other items may be permitted with the approval of the Contracting Officer. Weapons will not be permitted on site under any circumstances.

D. The Contractor will not be permitted to change or re-key locks or install any type of device without prior approval of the Contracting Officer.

E. The Contractor will not be permitted to set up temporary utility building(s), trailer(s), vehicles, etc. for storage, office, etc.

PERSONNEL REQUIREMENTS

A. General: The Contractor is to make his own review of the contract requirements for work included herein and in conjunction with actual job site conditions. The Contractor is responsible for all work included herein.

Additionally, the Contractor's personnel are to be polite and assist the public with information and aid in such a manner as to reflect favorably on the Forest Service and Contractor providing the service. The Forest Service reserves the right to require the Contractor to replace any employee deemed unqualified, displaying unfavorable personal conduct or appearance and/or making a unfavorable reflection of the Forest Service to the public.

Staffing: The Contractor shall provide qualified personnel to satisfy the contract objective at all times.

B. Supervision: The Contractor shall give his personal superintendence to this contract. Contractor shall appoint in writing, subject to the approval of the COR, a minimum of one foreman/superintendent. The superintendent will have full authority and power to act for the Contractor on items pertaining to overall work performance, management, coordination, and supervision. This individual may also serve as the Quality Control Inspector, provided that his/her job performance in each category is maintained at a level acceptable to the COR. In addition to supervision the superintendent shall be required to follow-up on public complaints and problems with personnel.

All cleaning and disinfecting of bathrooms must follow CDC COVID-19 standards for cleaning. The Contractor's responsibilities shall include, but not be limited to the following:

Flush toilets/shower stalls, vault toilets, picnic shelters (once opened) and the cleaning of drinking fountains, must be thoroughly cleaned inside and outside (defined as a 15’ perimeter around the building) so that they present a clean, sanitary appearance and are virtually odorless. Contractor shall provide all necessary labor, supplies, equipment and materials for the maintenance of these areas.

A. Cleaning Routine for Toilets/Restrooms (All cleaning procedures and materials must meet the CDC COVID-19 Standards, using EPA Registered Disinfectants- link attached):

1.Sweep floor - dust walls and ceiling for cobwebs
2.Empty trash receptacles
3.Clean and disinfect toilet partitions, waste receptacles and doors
5.Sanitize/clean toilet bowls
6.Sanitize/clean toilet seats and risers
7.Sanitize/clean urinals
8.Clean and disinfect lavatories including faucets and handle
9.Clean and disinfect hardware. (Push/pull plates, bars kick plates, etc.)
10.Clean and disinfect showers, stalls, doors, handles and floors
11.Clean mirrors
12.Mop and disinfect using EPA approved disinfectant floor cleaner (scrub with brushes when needed)
13.Scrub walls and floors (especially around and under urinals, toilets, and lavatories) with brush and approved cleaning agent; dry tile, metal, etc.
13.Clean all exposed pipe, hinges, latches, escutcheons and fittings

14. Scrub concrete floors with concrete cleaner

15. Inspecting and reporting any need for major repairs such as leaks in roof, damage to doors, windows, gutters and downspouts, etc.

16. Cleaning exterior of building to keep clean of dirt, mildew, bugs, etc.

17. Pick-up litter within a 15’ perimeter of facility (including all buildings and trash bins)

18. Replace toilet paper and paper towels. Place fresh, full-sized rolls of toilet paper on all dispensers. Completely refill all paper towel dispensers with paper towels

19. Report any damage or vandalism immediately

B. Cleaning Routine for Picnic Shelters, Amphitheater and Sidewalks (option clean once opened):

1. Sweep or blow off floor and sidewalks

2. Dust walls and ceiling for cobwebs

3. Empty trash receptacles

4. Cleaning exterior of building to keep clean of dirt, mildew, bugs, etc.

5. Pick-up litter within a 15’ perimeter of facility

C. Cleaning Routine for Drinking Fountains:

1. Wash bowl

2. Remove trash weekly

3. Keep drain open

4. Report poor water flow, leaks, defective parts to Contracting Office

TRASH PICKUP

General: The term "Trash Pickup" includes both the removal of trash from trash receptacles and the area immediately outside (defined as a 15’ perimeter) the trash receptacles. Contractor shall provide all necessary labor, supplies, equipment, personal protective equipment, and materials for the maintenance of these areas.

A. ACCESSORIES

Trash Receptacles: Utilize Forest Service provided trash receptacles. Always use plastic liner in all trash receptacles. Empty all receptacles at each cleaning cycle, despite amount of prior use. Trash bags and loose litter left directly outside the trash receptacles shall be removed, up to 15’ away. Wash/scrub the inside and outside of each trash receptacle monthly to maintain odor free containers. Use disinfectant.

B. TRASH DISPOSAL:

Trash will be disposed of after each collection in an approved land field.

Description of Requirement

DAMAGE RESPONSIBILITY

The Contractor shall be responsible for restoring any Government facilities or structures damaged as a result of his/her operation. He/She shall also be responsible for any damage to private property and injury to any person as a result of his/her oprerations. The contractor will notify the Contracting Officer immediately of damage to Government and private property and injury to any person resulting from his operations.

NOTE: IT IS THE PROSPECTIVE CONTRACTOR’S RESPONSIBILITY TO VISIT THE PROJECT, INSPECT ACTUAL ON-GROUND CONDITIONS, AND CLARIFY AND POTENTIAL QUESTIONS WITH PROJECT PERSONNEL PRIOR TO BIDDING.

INSPECTION AND ACCEPTANCE

A. Inspection of work performance under this contract shall be made by the Contracting Officer’s Representative or the designated inspector as the work progresses at such intervals as are necessary to insure compliance with the contract specifications and provisions.

Upon completion of work on an all sites specified by the Contracting Officer’s Representative, the Contractor shall notify the Contracting Officer’s Representative that work is completed, and the Contracting Officer’s Representative shall make an overall inspection of the work completed. If the work is not accepted by the Contracting Officer’s Representative, the Contractor shall complete any remedial work required prior to payment.

When the Contracting Officer’s Representative observes the Contractor has failed to adequately perform any of the services for which the Contractor is responsible, the Contracting Officer or a designee will take the following action:

B. Non Compliance:

When services (custodial operations, trash pickup of recreation areas, etc.) are not provided in accordance with the contract, through the fault or negligence of the Contractor, the Contractor's Supervisor will be notified and directed to perform the services within twenty four hours at the contractor’s expense.

C. Follow-up on Non Compliance:

An inspection of non-compliance items will be made after twenty four hours by the Contracting Officer Representative. The Contractor’s Supervisor will be asked to accompany the Contracting Officer’s Representative during the inspection. If the inspection shows the item or items have been corrected, proven satisfactory or continuous progress is being made, the previous notice will be rescinded; however, if non-compliance still remains, the Contractor's Supervisor will be given notification in writing with copy of non-compliance mailed to the Contractor's company address.

D. Services Restored by the Contracting Officer:

If the Contractor fails to prosecute the work as directed or fails to perform the work in a satisfactory manner, the Contracting Officer may proceed to have the work performed with other forces. The cost of the work so performed including materials, labor, and equipment will be deducted from payment due the Contractor on his contract.

COMPENSATION

The Forest Service agrees to pay the Contractor the lump sum per site per month for services described herein upon receipt and approval of an invoice for the monthly period invoiced.

Monthly Submittal Data required for processing payment is as follows:

Monthly invoice for services rendered.

Reduction on non-performance of services will be handled as previously specified.

FOREST SERVICE RESPONSIBILITIES

Administration:

The Forest Service will provide personnel for administering the terms and conditions of this Agreement.

Inspections:

The Contracting Officer’s Representative (COR) will conduct frequent, unscheduled inspections and maintain a log noting conditions and compliance with contract provisions and quality of workmanship.

Contractor Personnel:

The Forest Service will not be responsible in any way to the Contractor's personnel for damages, destruction or loss, from any cause, to the Contractor's equipment, supplies, materials or tools or the personal property of the Contractor's personnel. The Contractor will be responsible for all repairs, regardless of cost, resulting from the negligence of the Contractor or Contractor's employees. The Forest Service will not participate in the cost of such repairs.

(viii) 52.212-1 Instructions to Offerors – Commercial Items (JUN 2020) (Provision) Addenda to provision 52.212-1:

Addenda to paragraph 52.212-1(b) Submission of Offers:

1) Offerors must have an active entity registration in the System for Award Management in order to submit an offer. https://www.sam.gov/SAM/

2) Offers submitted in response to this solicitation shall include a technical proposal, a price proposal, and past performance.

a) Technical Proposal – The technical proposal shall address the evaluation factors in 52.212-2. At a minimum technical proposal shall include:
i) Past Performance – provide a list of similar projects completed by your firm over the past three years. Include a brief description of the project, dollar amount, year completed, and project owner contact information (name, phone, and email).
ii) Technical Capability – Provide a list of equipment and key personnel (with qualifications) that will be used to complete this project.
b) Price Proposal – Include the following: 1) the completed price schedule contained in section v of this solicitation, 2) Acknowledge any amendments issued on beta.sam.gov for this solicitation by completing and signing the posted SF-30,

3) Submit offer by email to carol.pyle@usda.gov so that it is delivered into this inbox by the due date and time. Emails should contain 3 separate attachments (Technical Proposal, Price Proposal, and Representations and Certifications) in Microsoft Word or Adobe PDF format. Be aware that large attachments may increase the time required to deliver an email. It is the offerors responsibility to confirm receipt of the offer from carol.pyle@usda.gov.

(ix) 52.212-2 Evaluation – Commercial Items (OCT 2014) (Provision)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Technical Past Performance Cost or Price Technical and past performance, when combined, are “Approximately equal to cost or price.”

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. (d) Comptroller General Examination of Record. (b)If the Government exercises this option, the extended contract shall be considered to include this option clause.
