Description: NOTICE OF INTENT TO AWARD A SOLE SOURCE

The Department of Veterans Affairs (VA), Network Contracting Office (NCO) 9, intends to issue a Firm

Fixed Priced contract under the authority of Federal Acquisition Regulation (FAR) 13.106-1(b)(1)(i), Soliciting from a single source. Award is anticipated to occur on or about January 11th, 2022 to First

Nation Group, LLC. The period of performance will be for sixty calendar days after issuance of the notice to proceed.

This requirement includes the purchase of Alice NightOne Wireless Home Sleep Testing System for veteran patients that receive sleep testing at the Lexington Veterans Administration Medical Center. The intended purpose of the The Alice NightOne is a physiological data recorder intended to collect and record data from multiple physiological channels. It is intended for use by or on the order of a physician.

The Alice NightOne is intended for use in a supervised (hospital) or unsupervised (home) environment.

Alice NightOne is intended as a diagnostic device for adults. No physiological alarms are present. Alice

NightOne is not a monitor. The patient’s treatment plan will include input sleep medicine professional regarding a patient’s progress should they require supplementary treatment if there is a material change in their overall health. This Alice NightOne Wireless Home Sleep Testing System will provide much needed sleep testing devices within the Lexington Veterans Administration Medical Center.

Contractor will be responsible for the delivery of the Alice NightOne Wireless Home Sleep Testing

System to the Lexington Veterans Administration Medical Center in a timely manner.

NCO 9 intends to non-competitively award this requirement to First Nation Group, LLC since the brand of Alice NightOne Wireless Home Sleep Testing System is most compatible with the current network of

Alice NightOne Wireless Home Sleep Testing System utilized at local VA facilities. The Alice NightOne

Wireless Home Sleep Testing System previously obtained from First Nation Group, LLC has provided the facility with the capacity to evaluate and treat veteran patients in routine and emergency circumstances.

As a result, any contractor other than First Nation Group, LLC that would provide Alice NightOne

Wireless Home Sleep Testing System to the facility would unintentionally cause a delay in sleep testing.

Unnecessary delays cannot be endured.

The North American Industry Classification System (NAICS) code for this requirement is 339112 with the size standard of 1,000. The applicable Product Service Code is 6515. This notice of intent is not a request for proposals or quotes. However, all responsible sources may submit an offer and technical capabilities/narrative that proves by clear and convincing evidence that similar home sleep testing systems are available that will provide comparable sleep testing intervention capabilities for the facility.

If said OFFER and technical capabilities/narrative is received within three calendar days of publication of this notice, the narrative will be considered by NCO 9. All responses must be submitted to the

Government point of contact at the email address shown below. A determination by the Government not to open the requirement to competition based upon the responses to this notice is solely within the discretion of the Government. Information received will generally be considered solely for the purpose of determining whether to conduct a competitive procurement.
