FEDBIZOPPS.GOV ANNOUNCEMENT: SPECIAL NOTICE
CLASSIFICATION CODE: 70- General purpose information technology equipment
SUBJECT: NOTICE OF INTENT TO SOLE SOURCE: Colorimeter Goniometer Hardware and Software Upgrade

The National Institute of Standards and Technology (NIST) intends to negotiate, on a sole-source basis, with Dynamic Strutures & Materials, LLC (DSM)., under the authority of FAR Part 13.106-1(b), for the procurement of Colorimeter Goniometer Software and Hardware Upgrade to be used by NIST Physical Measurement Laboratory (PML), in Gaithersburg, MD.
***** Sole source determination is based on the need to acquire Colorimeter Goniometer software and hardware upgrade. Colorimeter Goniometer is currently being used by scientific and technical staff at PML for high accuracy retroreflection measurements.
PML has an existing Dynamic Strutures & Materials (DSM), LLC 8-axis colorimeter goniometer with an old controller that requires replacement due to only 7 channels of the 8 working properly. Due to this issue, the existing system loses all settings and configurations upon power loss and must be manually reprogrammed. In addition to these issues, the colorimeter goniometer’s existing software is written in LabWindows, and the system is not Windows 10 and Labview 18 compliant and thus cannot be used on NIST computers. In order to meet mission, the upgrade shall include controller installation, wiring, configuration, troubleshooting, debugging, code verification and demonstration for at least 2 axes of motion- one of which includes an encoder, limit switches, a home switch, and update the software to run on Windows 10 in LabVIEW 18. DSM is the only company capable of performing these upgrades as they are the original manufacturer of the colorimeter and thus are the only company authorized to perform the required hardware and software upgrade. In addition, the colorimeter goniometer schematics contains proprietary information and thus information required for other companies to complete the upgrade cannot be released.
Based on the above justification Dynamic Strutures & Materials (DSM), LLC is the sole manufacturer and distributor of the required colorimeter goniometer software and hardware upgrade.

***** A determination by the Government not to compete the proposed acquisition based upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement.
*****No solicitation package will be issued. This notice of intent is not a request for quotations.
Interested parties that believe they can satisfy the requirements listed above must identify their capability in writing before the response date of this notice.
