INTRODUCTION

THIS IS A PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT)

SYNOPSIS TO AWARD A CONTRACT OR PURCHASE ORDER WITHOUT

PROVIDING FOR FULL OR OPEN COMPETITION.

The National Institutes of Health, National Institute of Child Health and Development (NICHD), in support of the work of the National Institute of Diabetes, Digestive, and Kidney Disease (NIDDK), intends to award a purchase order without providing for full and open competition (Including brand-name) to Bauer Compressors, Inc., 1328 Azalea Garden Road, Norfolk, VA 23502-1904 for the purchase of a Bauer model G60-V high pressure gas compressor system for helium recovery.

NORTH AMERICAN INDUSTRY CLASSIFICATION SYSTEM (NAICS) CODE

The intended procurement is classified under NAICS code 424690 with a Size Standard 1000.

REGULATORY AUTHORITY

The resultant contract will include all applicable provisions and clauses in effect through the Federal Acquisition Regulation (FAR) Circular (FAC) 2022-04 effective 01-30-2022.

This acquisition is conducted under the procedures as prescribed in FAR subpart 13- Simplified Acquisition Procedures at an amount not exceeding the simplified acquisition threshold ($250,000) and FAR Subpart 12- Acquisition of Commercial Items.

STATUTORY AUTHORITY

This acquisition is conducted under the authority of the Federal Acquisition Regulation (FAR) Part 13—Simplified Acquisition Procedures, Subpart 13.106-1 (b) (1), Soliciting from a single source and is not expected to exceed the simplified acquisition threshold.

Contracts awarded using FAR Part 13—Simplified Acquisition Procedures are exempt from the requirements of FAR Part 6—Competition Requirements.

Place of Performance National Institutes of Health 9000 Rockville Pike Bethesda MD 20892 United States

DESCRIPTION OF REQUIREMENT

Currently, there is a worldwide shortage of helium, and future disruptions to the helium market are likely. Thus, it has become essential for NIDDK to recycle the helium that is used by NMR magnets in buildings 5 and 6. Without recycling helium, there is a real danger that valuable government property (i.e., expensive NMR magnets) will be

PRE-SOLICITATION NON-COMPETITIVE (NOTICE OF INTENT) SYNOPSIS

damaged irreversibly if liquid helium cannot be obtained in a timely manner. Therefore, we have an urgent need to acquire helium compressor units that will be used to recover helium that otherwise would escape from the magnets as described above. These units will compress the escaping helium gas into pressurized gas cylinders, which can then be taken to a helium liquification facility that already exists in NIH building 50. The liquified helium can then be reused in NMR magnets. These helium recovery systems should collect the helium gas that boils off from the NMR magnets and compress the helium gas for storage.

REQUIRED FEATURES

Task Area 1 delivery timelines lead time 12- 16 weeks upon awarded PO.

Task Area 2 two units are to be shipped to two different buildings at the NIH main campus.

Task Area 3 Installation requirements - Not required

Area 4 software, warranty, maintenance requirements - Standard Warranty applies 24 months after date of shipment per Quote Task Area 5 training requirements - Not required

CONTRACTING WITHOUT PROVIDING FOR FULL OR OPEN COMPETITION

(INCLUDING BRAND- NAME) DETERMINATION

The determination by the Government to award a contract without providing for full and open competition is based upon the market research conducted as prescribed in FAR Part 10—Market Research. Only one source is available: Per FAR 13.106-1(b)(1) the Contracting Officer has determined that Bauer Compressors, Inc. is the only vendor that can provide the Helium Recovery Systems for Buildings 5 & 6. The following specifications are the only ones that can be met by Bauer Compressors:

The helium recovery system that can: (1) fit in the laboratory space as currently configured; (2) be quiet enough in both sound and vibration to not disturb nearby researchers and experiments. The G60-V helium recovery system has a small internal gas bag to contain helium gas that escapes from our NMR magnets. The G60-V system is much more compact (56” x 32” x 61”), and quiet (65 dB noise level), than other helium compression systems, which require a much larger external gas bag, and a larger, higher horsepower compressor.
