(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records—Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.
(e)(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

SALIENT FEATURES FOR THE PROCUREMENT OF AN
ENERGY DISPESRIVE X-RAY FLUORESCENCE SPECTROMETER
1.0 DOCUMENTATION
1.1 The supplier shall provide published information/specification or generated test data showing how the proposed system compares to the requirement of this specification.
1.2 The supplier may use photographs, drawings, sketches, and/or test data to demonstrate compliance to each requirement of this specification.
1.3 A complete set of paper or electronic documentation of the operator's manual, schematic diagrams, parts list, and any technical information required for the proper operation of the system shall be supplied with the equipment.
2.0 WARRANTY
2.1 The supplier shall specify a warranty for the equipment to be provided for at least one year after date of installation at no cost to the government for parts, labor or travel.
3.0 DELIVERY
3.1 The supplier shall specify the length of time required for delivery after an order has been placed.
3.2 The supplier shall specify the shipping weight and the cost required to ship the equipment to

4.0 DESCRIPTION
4.1 An Energy Dispersive X-Ray Fluorescence Analyzer equipped with a forced air cooled X-
Ray tube containing two anode targets. The analyzer must be capable of providing simultaneous polarized and direct excitation. The analyzer should include a silicon drift detector (SDD) with an active area of 30 mm² or larger.
5.0 SYSTEM PERFORMANCE PARAMETERS
5.1 Minimum quantification limits (MQL) for iron in oil is 1.0 ppm, and the MQL for chlorine and sulfur in oil, 1.5 ppm.
5.2 The ability to analyze and quantify S, Si, Al, Mg, Ti, Cr, V, Mn, Fe, Co, Ni, Cu, Zn, Sn, Mo, Nb, Sn and Pb in various aluminum alloys, stainless steels, nickel or cobalt based alloys and brass/bronze alloys.
5.3 System must be configured with safety devices / interlocks to prevent radiation exposure. The system should allow changing the sample without having to turn off the X-Ray detector.

5.4 The optics should be fixed and inverted (samples sits above the X-ray tube and detector).

Bandpass filter/s are required for improved sensitivity for the elements from potassium to manganese.
5.7 PC controlled workstation with flat screen monitor and printer. System should include
Windows and an intuitive menu based software to de-convolute or correct for overlapping elemental peaks, material matching, and to perform qualitative and quantitative analysis. The software must be able to control/set the operating and measurement parameters. Acquiring information technology using Internet Protocol shall be IPv6 compatible as followed:
Must support Dynamic Host Configuration Protocol version 6 (DHCPv6);
Must support Dual Stack (Operates IPv4 and IPv6 simultaneously);
Must support IPv6 only mode.
5.8 Software and spectrometer should be able to screen unknown samples for elements from sodium to uranium, also the system shall display overlaid spectra, line markers, regions of interest with statistics, automatic line identification, linear, logarithmic and square root scaling. The system must provide a searchable database with sample data, measurement parameters and with the ability to display/print/export analysis reports.
5.9 Spectrometer must be capable of performing measurements in air, vacuum or with a helium purge. Helium purge of the sample chamber is required for excitation and detection of elements that produce low energy (soft) x-rays (sodium, magnesium, aluminum, etc.).
5.10 Onsite installation and training /calibration of test methods (4 days minimum).
5.11 Input power 110VAC @ 60 Hz.

Paragraph (m) Instructions Regarding Submission of Offers. The following information is to be provided with offeror’s proposal and must be submitted no later than the date and time specified on page 1 in Block 8 of the SF 1449. The information requested must be provided for the prime contractor, and, if applicable, significant subcontractors. Failure to provide any item requested below may render an offeror’s proposal non-responsive and thereby ineligible for award.
(1) List of Required Documents – The following is a list of required documents provided for the Offeror’s convenience. There may be other documents, either required or necessary for effective evaluation, which do not appear on this list. It is the offeror’s responsibility to ensure that the proposal submitted is complete in every respect and not rely solely on this list to prepare its proposal.

(2) Evaluation Criteria Submission Requirements –
a. Technical Acceptability: Offerors quote shall include the salient characteristics of the proposed product and demonstrate the degree to which it can satisfy the government’s requirement. The quote shall be clear and concise, and shall include sufficient detail for effective evaluation and substantiation of stated claims. The quote shall not simply affirm, rephrase, or restate the Government's requirements, but rather, provide convincing rationale to address how the offeror’s product meets the requirements. Offerors shall assume that the Government has no prior knowledge of their products, facilities, or experience, and will base its evaluation only on the information presented in the offeror's quote. Elaborate brochures or documentation, detailed artwork, or other superfluous embellishments are unnecessary and are not desired. Offerors are advised that existing product literature may be submitted in lieu of unique technical proposals so long as it conforms to the requirements of the solicitation and contains adequate detail for purposes of evaluation. The information provided shall comprehensively explain how the offeror proposes to comply with the applicable requirements. Technical proposals should include, at a minimum, details adequate to demonstrate that the proposed x-ray fluorescence spectrometer meets the requirements identified in the Salient Features including the offeror’s IPv6 compliance.
b. Price: Offeror is to provide a general breakdown of pricing sufficient to determine price reasonableness. Offeror shall identify and document all (if any) assumptions, conditions, and/or exceptions upon which the price is based. Any assumptions, conditions, and/or exceptions considered by the Government to be unacceptable may result in elimination for an award.
(3) Evaluation – This acquisition for a commercial item will be conducted pursuant to the simplified acquisition procedures in FAR Part 13. As such, the best value selection shall comply with the procedures in FAR Part 13.106.
a. The Government intends to award one contract from this solicitation to the offeror who is determined responsible in accordance with the Federal Acquisition Regulation, as supplemented, whose offer conforms to the solicitation requirements and is determined, based on the evaluation factors, to represent the best value to the Government. The following factors shall be used to evaluate offers: Technical Acceptability and Price.
b. Options. Not applicable to this requirement.
c. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(4) Financial Information – In order for the Government to make an affirmative responsibility determination, offerors shall provide correspondence from its financial institution indicating offeror’s financial capabilities.
(5) Proposal Costs – The Government will not pay any offeror for preparation of its quote.
(6) IPv6 Compliance – In order for the Government to determine IPv6 compliance, offerors shall provide correspondence that addresses the following: supports Dynamic Host Configuration Protocol version 6 (DHCPv6); supports Dual Stack (Operates IPv4 and IPv6 simultaneously); and supports IPv6 only mode.
(7) Questions – Questions regarding the solicitation are encouraged to ensure adequate understanding of the government’s requirement. All questions regarding subject solicitation must be submitted no later than 3:00 p.m. Central Time on October 17, 2016. Questions submitted after this date/time may not be answered. (a) Definitions. As used in this provision—
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. “Forced or indentured child labor” means all work or service—
