NATIONAL AERONAUTICS AND SPACE ADMINISTRATION

JOHN F. KENNEDY SPACE CENTER

Justification for Other than Full and Open Competition

1. The Engineering and Technology Directorate (NE) at Kennedy Space Center, FL requires a sole source acquisition for Harris Corporation OS/Comet software maintenance renewal. This software maintenance is required to provide continued support for the Launch Control System and the Ground Systems Development and Operations (GSDO) Advanced Hardware Launch Control System (LCS) Emulator (GAHLE) to be deployed at Marshall Space Flight Center SLS Integration Lab.

2. This requirement has been procured in the past as a sole source requirement from the software manufacturer, Harris Corporation. This current action is for renewal of the existing Harris Corporation OS/Comet software maintenance agreement.

3. The requirement is to provide maintenance services only for the OS/Comet software.

This service requires Harris provide the Government with receiving patch versions, minor point release versions and telephone technical support at a total estimated cost of $391,667.00. This software is used in the development, testing, and production of the next generation launch support and ground support systems.

Continued maintenance is required to provide the core command and telemetry processing capabilities in the Spaceport Command and Control System.

4. Harris Corporation confirmed that this software is customarily used by the non-governmental entities for other than governmental purposes and has been sold or licensed to the general public. Harris Corporation also provides the same or similar maintenance services contemporaneously to the general public under terms and conditions similar to those offered to the Federal Government. This requirement is meets the definition of a commercial item in accordance with (IAW) FAR 2.101.

5. IAW FAR 12.203 and FAR 13.500, simplified acquisition procedures may be used for acquisitions of commercial services in amounts greater than the simplified acquisition threshold but not exceeding $7 million. Furthermore, any simplified acquisition procedure in FAR Part 13 may be used to maximize efficiency and economy and minimize the burden and administrative costs for both the Government and industry.

6. Pursuant to FAR 13.105(b) and FAR 12.603, a combined synopsis solicitation will be issued to help streamline the acquisition process. This procedure combines the synopsis required by FAR 5.203 and the issuance of the solicitation into a single document.

7. Harris Corporation is uniquely qualified to provide these services to the Government because the requirement is for maintenance of existing Harris Corporation OS/Comet software licenses only and they are the sole distributor of the requested maintenance renewal. No other contractor or contract vehicle exists as an alternate

Pursuant to FAR 6.302-1, there is only one responsible source and no other supplies or services will satisfy Agency requirements. The statutory authority permitting other than full and open competition is 41 U.S.C. 1901 as implemented in FAR Subpart 13.5

8. Offers were initially solicited to all NASA SEWP GWAC contract holders. The solicitation was open for full and open competition for a period of thirteen days but no offers were received.

9. Prior acquisition history is available to assist the Contracting Officer with determining that the anticipated cost to the Government will be fair and reasonable.

10.Market research was conducted to identify as many potential sources as is practicable. Multiple vendors were found on the NASA SEWP V GWAC that can supply products and services by this brand name. As previously stated above, a solicitation was issued on the NASA SEWP V GWAC but no offers were received.

The Government later learned that the manufacturer does not currently authorize any other distribut contract vehicles (such as a GSA Schedule) to fulfill this requirement. No other sources have expressed in writing an ability to meet the requirement.

11.The requirement is for maintenance of existing software licenses only. No other the agency to remove or overcome barriers to competition

12.Based on the information above, Harris Corporation is the only software manufacturer that can meet mission requirements.

The Government s Technical Representative, Mr. Guy Bedette certifies that the supporting data presented in this justification is complete and accurate.

The Contracting Officer (CO) has reviewed and hereby approves of the justifications provided by the technical/requirements team. Market research supports that there is only one source reasonably available for this acquisition. This requirement will be pursued as a sole source requirement to Harris Corporation.
