National Labor Relations Board 2016 Trial Training Conference
Washington, DC
PERFORMANCE WORK STATEMENT
OVERVIEW: The National Labor Relations Board is an independent federal agency created by Congress in 1935 to administer the National Labor Relations Act, the primary law governing relations between unions and employers in the private sector. The statute guarantees the right of employees to organize and to bargain collectively with their employers, and to engage in other protected concerted activity with or without a union, or to refrain from all such activity.
The purpose of this Agency Trial Training Conference is to provide legal advocacy skills training for newer field attorneys or those who have not previously received such training.
Conference accommodations for 120-130 individuals which includes providing 120-130 sleeping rooms at or below the government per diem rate for a six-day period, beginning on Sunday, September 18, 2016. One (1) General Session Room that is spacious, rectangular-shape room large enough to accommodate 150 people set in crescent-round style seating, (6 people per round table), elevated platform with reserved faculty table in front of room with seating for six (6). Lighting level for participants should be sufficient for reading and note taking. Room should lack obstructions (e.g., pillars) so that all audience members at tables can see the elevated platform.
The room must be large enough to accommodate LCD Projector package (to include LCD projector, screen, AV cart, multiplug extension cord, at least one "lavaliere” microphone and two stationary microphones, and audio sound system). The room must be available on Monday, September 19th, from 7:00am – 1:30pm.
The Agency does not anticipate utilizing any "realtime" broadcast of the conference events. In the event the Agency determines that a recording of the events is desirable for future use on its website, or in any other venue, the Agency reserves the right to provide and operate its own equipment.
Conference Dates: September 18, 2016 through September 23, 2016.
Property Details: The hotel must provide conference accommodations to include a meeting room and related services and lodging for 120-130 individuals. Sleeping rooms should be clean, well furnished and include standard amenities for overnight accommodations. All rooms must include free high-speed internet access (Wi-Fi preferred). The hotel must also provide complimentary refrigerators to guests with medical requirements.
Location Details: The NLRB will only consider hotels within a ten to fifteen minute walk to NLRB Headquarters at 1015 Half St, SE, Washington, DC 20570. Additionally, the hotel must be within walking distance of a variety of restaurants; convenient to the airport and public transportation; and located in a safe area.
Participants: Approximately 120-130 total participants: Managers, supervisors and attorneys from most of the Agency’s Regional and Sub-Regional Offices, and General Counsel's Headquarters divisions.
Performance Requirements:
1. The contractor shall provide lodging for 120-130 participants, September 18 – 23, 2016.
Participants will be checking in on Sunday and checking out on Friday. Hotel rooms will be paid via conference attendee’s individual Government Travel Card.

2. The hotel must be located in Washington, DC within a ten to fifteen minute walk of NLRB’s Headquarters located at 1015 Half Street, SE, Washington, DC 20570.
3. 4. Provide the following AV Equipment: LCD Projector package (to include LCD projector, screen, AV cart, multiplug extension cord, at least one "lavaliere” microphone and two stationary microphones, and audio sound system).
PERFORMANCE STANDARDS:
The Performance Requirements includes performance standards. The Government shall use these standards to determine contractor performance. Regardless of the surveillance method, the Contracting Officer Representative (COR) shall always contact the contractor’s task manager or on-site representative when a defect is identified and inform the manager of the specifics of the problem. The COR shall be responsible for monitoring the contractor’s performance in meeting specific performance standards.
Methods of Quality Assurance Surveillance.
• Direct Observation. (Can be performed periodically or through 100% surveillance)
• Periodic Inspection. (Inspections may be scheduled daily or unscheduled as required)
• Validate User/Consumer Complaints. (Relies on the user of the service to identify deficiencies, Complaints are then investigated and validated)
Ratings. Metrics and Methods are designed to determine if performance exceeds, meets or does not meet a given standard and acceptable quality level. A rating scale shall be used to determine a positive, neutral or negative outcome. The following ratings shall be used:
GREEN
Performance meets or exceeds contract requirements to the Government's benefits.
YELLOW Substandard Performance will be corrected on the spot.
RED Substandard Performance that may not be corrected on the spot or at all.
GOVERNMENT ROLES AND RESPONSIBILITIES:
The following personnel shall oversee and coordinate surveillance activities.
Contracting Officer (CO): The CO shall ensure performance of all necessary actions for effective contracting, ensure compliance with the contract terms and shall safeguard the interests of the United States in the contractual relationship. The CO shall also assure that the contractor receives impartial, fair and equitable treatment under this contract. The CO is ultimately responsible for the final determination of the adequacy of the contractor’s performance.

QASP
The Contractor Service Delivery Schedule identifies the major tasks or deliverables the contractor will be providing or accomplishing during the contract period. The schedule identifies the task standards, the acceptable level of quality and the primary method the Government will use to assess the contractor’s performance.

QUALITY CONTROL AND QUALITY ASSURANCE SURVEILLANCE PLANS
(QASP)
Government will monitor the Contractor’s performance using the Quality Assurance Surveillance Plan (QASP). Government personnel will record all surveillance observations. When an observation indicates substandard performance (i.e. yellow or red ratings), the Government POC must annotate their findings on the QASP form and must immediately acquire the Contractor’s initials, or their representative at the site, on the completed QASP. The initialing does not necessarily constitute concurrence with the observation, only acknowledgement that the Contractor or their representative has been made aware of the substandard performance. Any action taken by the Contracting Officer as a result of surveillance will be in accordance with the terms of the contract.
