NATIONAL LABOR RELATION BOARD

EXCHANGE PROGRAM

REQUEST FOR PROPOSAL (RFP) NLR63310016Q0108

1. The solicitation, RFP NLR63310016Q0108, is being issued utilizing the streamlined solicitation procedures for commercial items in accordance with the Federal Acquisition Regulation (FAR) 12.603 as a Request for Proposal (RFP).

2. The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisitions Circular 2005-85, Effective 01/04/2016.

3. The applicable NAICS is 721110 – Hotel (except Casino Hotels) and Motels, Size Standard $32.5M.

4. This is a firm fixed price contract.

5. Place of Performance: Washington, DC, in a safe area, preferably within a ten to fifteen minute walk of NLRB’s Headquarters located at 1015 Half Street, SE as well as within walking distance of a variety of restaurants.

6. The Statement of Work titled National Labor Relations Board, Statement of Work, Exchange Program is attached.

7. The provision at FAR 52.212-1, Instructions to Offerors – Commercial Items (OCT 2015), applies to this acquisition.

8. The provision at FAR 52.212-2, Evaluation – Commercial Items (OCT 2014), applies to this acquisition.

9. The offeror must include a completed copy of the provision at FAR 52.212-3, Offeror Representations and Certifications – Commercial Items. Representations and Certification must be uploaded to the System for Award Management at www.sam.gov.

10. FAR 52.212-4, Contract Terms and Conditions – Commercial Items (MAY 2015), applies to this acquisition.

14. To the extent prospective Offerors have questions or comments regarding this Solicitation, they are to be submitted in writing via email to the Contract Office at Delfina.St.Clair@nlrb.gov by 12:00 noon EST on March 4, 2016. At the NLRB’s discretion, the NLRB may provide written responses to the questions or comments as appropriate. Any such responses will be posted as an Amendment to the Solicitation.

Addendum to 52.212-1 Instructions to Offerors – Commercial Items

1. Offeror shall furnish two separate volumes, Technical (Volume I) and Price (Volume II).

2. Technical (Volume I) shall contain the following:

(i) Factor 1 – Technical

(ii) Factor 2 – Past Performance

All offerors must confirm in their proposal that the facility is compliant with the Hotel and Motel Fire and Safety Act of 1990 (Public Law 101-391) (15 U.S.C. 2201 et seq.) and the American with Disabilities Act (ADA) (Public Law 101-336)(42 U.S.C. 12101 et seq.).

3. Price (Volume II) shall contain the following:

(i) The solicitation number;

(ii) The name of the company, DUNS number, CAGE Code, address, telephone and facsimile numbers of the offeror, and electronic address if available;

(iii) Names, titles, and telephone and facsimile numbers (and electronic address if available) of persons authorized to negotiate on the offeror’s behalf with the Government in connection with this solicitation if applicable;

(iv) Acceptance of terms and conditions; The offeror shall state, “The terms and conditions in the solicitation are acceptable to be included in the award document without modification, deletion or addition”.

The offeror shall state “The terms and conditions in the solicitation are acceptable to be included in the award document with the exception, deletion or addition of the following: Offeror shall list exception(s) and rationale for the exception(s);

(v) Written confirmation that Representations and Certification are current in https://www.sam.gov/portal.public/SAM/; and

(vi) Any other business or administrative information that the offeror wishes to include in their proposal.

The NLRB is a tax exempt Federal agency; please do not include any sales taxes in proposals for which the Federal Government is exempt.

FAR 52.212-2 – Evaluation – Commercial Items (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Factor I – Technical

a. Location – Proposals will be evaluated on the ability of the hotel to provide a facility that is located in Washington, DC, in a safe area, preferably within a ten to fifteen minute walk of NLRB’s Headquarters located at 1015 Half Street, SE as well as within walking distance of a variety of restaurants.

b. Rooms – Sleeping rooms should be clean, furnished appropriately and include the usual amenities for overnight accommodations. Sleeping rooms should also have complimentary high speed internet access (Wi-Fi preferred) and a refrigerator or easy access to a refrigerator.

c. Other Considerations – Transportation to major airports, availability and cost of on-site guest parking. In addition, the hotel must include complimentary on-premises exercise facility with state of the art equipment such as elliptical trainers, treadmills, bikes and other strength training equipment that are properly maintained and in good working condition.

Factor II – Past Performance The hotel should provide references for at least three (3) references for similar work performed within the past three (3) years. The hotel will be evaluated based on customer satisfaction. The contact information for each reference shall include:

The NLRB may also assess Past Performance in any other manner prescribed by the Federal Acquisition Regulations.

Factor III – Price The NLRB intends to award a firm-fixed price contract. Lodging price must be at the Government per diem rate of $ 226 per night or lower for Sessions 1 and 2 and $174 or lower for Session 3.

Proposal must be valid 90 days after submission.

All non-price evaluation factors when combined are significantly more important than price;

however, as proposals become more equal in their technical merit, the proposed price may become the determining factor for award.

The Government intends to evaluate Proposals and make award without discussions; however, this does not preclude the Government from having discussions if it is in the best interest of the Government.

(b) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(d) Comptroller General Examination of Record The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records -- Negotiation.

(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor’s directly pertinent records involving transactions related to this contract.

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c) and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial items. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause—

Contract Administration Data

(a) All contract administration must be effected by the Contracting Officer except as delegated to the Contracting Officer’s Representative (COR). In no event will any modification, change order or other matter in deviation from the terms of scope of this contract be effective or binding unless formalized by proper contractual documents by the Contracting Officer.

(b) In the event the Contractor makes any changes to the terms or scope of this contract at the direction of any person other than Contracting Officer, the change will be considered to have been made without proper authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof.

Contracting Officer’s Representative (COR)

(a) Contracting Officer’s Representative (COR), for the contract resulting from this solicitation will be designated at time of award.

(b) The COR is responsible, as applicable, for receiving all deliverables, inspecting and accepting the services provided hereunder in accordance with the terms and conditions of this contract; providing direction to the Contractor which clarifies the contract effort; fills in details or otherwise serves to accomplish the contractual Statement of Work; evaluating performance;

and certifying all invoices/vouchers are acceptance of the services furnished for payment.

(c) The COR does not have the authority to alter the Contractor’s obligations under the contract, and/or modify any of the expressed terms, conditions, specifications, or cost of the agreement. If as a result of technical discussion, it is desirable to alter/change contractual obligations or the Statement of Work, the Contracting Officer shall issue such changes.

National Labor Relations Board Invoicing Requirement

(a) To constitute a proper invoice, the invoice must be prepared in accordance with FAR 52.212- 4(g). In addition, the following must appear on the invoice:

1. Contract Number;

2. Date of Invoice;

3. Date service was performed;

4. Itemized description of services, applicable unit prices, and quantity delivered;

5. Extended totals; and

(b) All invoices must be prepared and submitted on a monthly basis, concurrently to the following:

1. Department of the Interior (DOI), National Business Center via email at NLRBPayments_ibcdenver@ibc.doi.gov and

2. Designated COR.
