The contract documents will govern the work. The various components of the contract documents are intended to be complementary and cooperative and to describe and provide for a complete project. Anything shown or mentioned in one component but not the others shall be as though shown or mentioned in all.

DA/6/PWK/953-07-08-24F130 (Rev. 02-29-24) III-GP-2

In case of a conflict between components of the contract documents, permits from other agencies shall have precedence over the Special Provisions and Technical Specifications, the Special Provisions and Technical Specifications over the plans, plans over the Standard Provisions and Standard Details, Standard Provisions and Standard Details over the Standard Specifications and Standard Plans, and all other code references.

If the conflicts cannot be resolved by the precedence prescribed above, the most stringent requirements shall prevail.

3. PRECONSTRUCTION CONFERENCE

After full execution of the construction contract by the Contractor, and prior to the issuance of a Notice to Proceed, the Engineer will schedule a preconstruction meeting to review the project with the Contractor. The Contractor’s representatives at this meeting shall include all upper-level superintendents for the work and may include major subcontractors.

During the meeting, the Contractor shall submit to the Engineer:

Other contracts may be or may have been awarded to other contractors to work at a close proximity to or at the same site as this project. The award of the contract for this project to the Contractor shall not be interpreted as granting the Contractor the exclusive right to occupy the site of the work. The Contractor shall not cause any unnecessary hindrance or delay to any other contractors working on any projects which encompasses this work and shall expedite the Contractor’s own work to complete the project within the time specified.

If the performance of this contract is likely to be interfered with by the simultaneous execution of the other contracts, the City will decide which contractor shall continue or whether the work can be coordinated so that all the contractors may perform the work simultaneously. If the Contractor is ordered to cease work to accommodate the work of the others, the Contractor will be compensated with the same number of days the site was unavailable to the Contractor. The City, however, will not be responsible for any damage suffered or extra costs incurred by the Contractor resulting directly or indirectly both from the award of any contracts or the decision of the City respecting the order of precedence in the performance of the contracts.

6. CONTRACTOR’S BOND FOR LABOR AND MATERIALS

The Contractor shall notify the Contractor’s suppliers, the Contractor’s subcontractors, and their suppliers that a Contractor’s Bond for Labor and Materials has been filed with the City for this job. The suppliers and the subcontractors and the subcontractors’ suppliers shall not file any Preliminary Notices of Lien against any private party on which work may be done as part of this contract. If Preliminary Notices are to be filed, they should be filed with the City of Mountain View with reference that the work done or the materials supplied are in connection with this contract.

In the event that a Preliminary Notice of Lien or lien is filed against any private party, the

Contractor shall immediately take whatever steps necessary to rescind the Preliminary Notice of Lien or lien, as the case may be. No progress payments will be made to the Contractor as long as any Preliminary Notice of Lien or lien is in effect against any private party in connection with this contract.

Vehicle Code § 591 does not relieve you or any other person from duty of exercising due care.

Provisions and these specifications.

The Engineer shall at all times have access to the work during its construction and shall be furnished with every reasonable facility for ascertaining that the stock and material used and workmanship are in accordance with the requirements and intentions of these specifications. All work done and all material used shall be subject to inspection and approval by the Engineer. Inspection of the work shall not relieve the Contractor of any of the Contractor’s obligations to fulfill this contract as prescribed. Defective work or unsuitable materials shall be removed and made good, notwithstanding that such defective work and materials had been previously overlooked by the Engineer when accepted or estimated for payment. The Contractor shall provide a minimum of two (2) working-day notice for overtime inspection.

The Contractor’s attention is directed to Section 8-04, “Character of Workers,” of the

Standard Provisions, and these specifications.

The Contractor and the Contractor’s employees shall conduct themselves in a socially acceptable manner. They shall not create unnecessary noise, use obscene language, exhibit socially unacceptable behavior, litter the neighbors’ yards, or hang around at the job site and socialize after work hours. Consumption of alcohol on or near the job site is prohibited.

13. SITE APPEARANCE

The Contractor’s attention is directed to Section 4-05, “Final Cleaning Up,” and

The Contractor shall maintain a neat appearance to the work site throughout the construction period. When practical, broken concrete, dirt, and debris generated by the construction shall be disposed of concurrently with its removal. If stockpiling is necessary, the material shall be removed or disposed of daily or at the direction of the Engineer.

The Contractor’s equipment used on the project, including construction vehicles, machinery, and traffic control devices, including, but not limited to, barricades and signs, shall not be unsightly, in disrepair, or marked with graffiti. Acceptability of such equipment shall be at the discretion of the Engineer. Rejected equipment shall be immediately removed from the project site.

14. TERMINATION OF CONTRACT

The City reserves the right to terminate the contract for the City’s convenience at any time upon a determination by the City Council or designated representative that termination of the contract is in the best interest of the City.

The Contractor shall retain and maintain such records and make them available to City at any time during that three (3) year period. The provisions of this Section 8-1.14 shall be included in all subcontracts.

15. PAYMENT PRIOR TO PROPOSED FINAL ESTIMATE

All payments, including payment upon the Final Estimate, shall be subject to deduction for prior payments and amounts, if any, to be kept or retained under the provisions of the contract.

The Contractor is advised that five percent (5%) will be retained by the City from payments made to the Contractor. This retention percentage supersedes that stated in Section 9-06 of the Standard Provisions.
