MSQ for NIST-owned U3000 HPLC System Statement of Work

I. BACKGROUND

The Material Measurement Laboratory (MML) is one of two metrology laboratories within the National Institute of Standards and Technology (NIST). The laboratory supports the NIST mission by serving as the national reference laboratory for measurements in the chemical, biological and material sciences. Our activities range from fundamental and applied research on the composition, structure and properties of industrial, biological and environmental materials and processes, to the development and dissemination of tools including reference measurement procedures, certified reference materials, critically evaluated data, and best practice guides that help assure measurement quality.

The Applied Chemical and Materials Division (ACMD) has an Ultimate 3000 (U3000) HPLC system (composed of RS variable wavelength detector, pump, autosampler, and a column compartment) in its Fluids Characterization Group. This Group performs experimental research on the relationship of chemical composition to chemical and thermophysical properties of fluids. Measurements are performed over wide ranges of temperature, pressure, and composition, including the study of reacting fluids under extreme conditions. The Group develops and certifies standard reference materials and measurement protocols for fluids; and provides comprehensive thermophysical property measurements for technically important pure fluids and fluid mixtures, including common inorganics, industrial chemicals, refrigerants, hydrocarbons, aqueous coal conversion products, heavy oils, and other fuels (including precursors, additives, and production/waste streams).

The ThermoFisher Scientific U3000 HPLC system that ACMD currently owns (including an RS variable wavelength detector, pump, autosampler, and a column compartment) requires a 100 % compatible mass spectrometer detector (MSQ), including a computer and compatible software, an update to the Chromeloeon 7 software license, installation, and a one-year service contract for the entire unit (including currently owned and newly acquires components). Acquisition of a MSD will greatly enhance the capabilities of the U3000 HPLC system, affording MML’s group the opportunity to expand into new areas of research related to, for example, biogenic amines and drugs of abuse.

II. SCOPE OF WORK

A. The Contractor shall provide, install, and show fully functioning the MSD requested as well as the computer, software, and nitrogen generator necessary for operation of the MSD. The Contractor will ensure that these parts and software are fully compatible with U3000 HPLC. The Contractor shall provide a service agreement for the service and maintenance for the entire system, including the currently owned RS variable wavelength detector, pump, autosampler, and a column compartment. The Contractor shall provide training for up to four staff members of the Group. The Contractor shall guarantee the full system performance of the entire system.

Service and maintenance shall include emergency visits during regular business hours in addition to scheduled preventive maintenance visits for one year, unless stipulated otherwise. Covered expenses shall include all parts, labor, travel, and per diem. The Contractor shall repair/replace all parts (i.e., hardware, software, accessory components/systems) required for the operation of the systems listed in Table 1. Currently, all equipment listed in Table 1 is functioning in accordance with manufacturer’s specifications. ALL EQUIPMENT SHALL BE BRAND NAME OR EQUAL.

III. SPECIFIC TASKS

A. Service Conditions and Repairs

1. All services provided under this agreement must be provided by personnel who are trained and fully competent in the operation of the U3000 HPLC system.

2. All parts shall be approved for use with the U3000 HPLC system. The Contractor shall only employ tools, instruments, test apparatus, methodologies, techniques, and practices approved for use with the U3000 HPLC system by the manufacturer. The service protocols and the U3000 HPLC-MSD specifications shall be adhered to at all times.

3. The standard manufacturer’s warranty for parts and labor shall apply to all work performed.

4. The Contractor shall respond to service call requests in the event of a U3000 HPLC system failure which requires immediate repair.

5. The Contractor shall respond to service calls Monday through Friday, during regular business hours only. The Contractor shall provide a service technician/engineer on-site at NIST, Boulder, CO within 48 hours after the service call is placed by the Government. No weekend service visits shall be required.

6. In the event that the Contractor is unable to resolve the problem during the service call, the Contractor shall provide telephone support and on-site support as needed to expedite a solution for NIST.

7. The Contractor is responsible to obtain all parts required for all repairs and maintenance. The Contractor shall make a commercially reasonable effort to secure parts within 72 hours after identifying the need for a replacement part for the covered equipment.

8. Replacement parts provided under this agreement may be either new or remanufactured and the Contractor may exchange and/or repair existing components.

9. All repairs must result in the U3000 HPLC system meeting manufacturer’s specifications as specified in the most recent version of the operation and maintenance manual for the U3000 HPLC system.

10. Any parts or components removed for replacement shall become the property of the Contractor unless otherwise agreed to by the parties. The Contractor shall remove the parts from the NIST campus at the time of the service call. This statement of work assumes that the Contractor will take the component(s) with them at the time of the service call, and that no shipping charges will be incurred under this contract. The Contractor shall assume liability for all parts removed from the NIST campus.

Clarification: Should a part need to be replaced and that part is determined to be contaminated, NIST will dispose of the item and will order a replacement. The Government understands that rebates cannot be provided for items deemed to be contaminated.

B. Preventive Maintenance

1. Provide two (2) preventive maintenance visits during each one-year term of the service agreement as specified in the manufacturer’s operations and maintenance manual for the U3000 HPLC-MSD. The Contractor shall utilize the most recent operation and maintenance manual available for the U3000 HPLC system.

2. Scheduling of the visits shall be consistent with the maintenance requirements of the U3000 HPLC system as detailed in the most recent operation and maintenance manual for each piece of equipment.

3. Preventive maintenance visits shall occur during NIST’s regular business hours as specified in this SOW. The NIST Technical Point of Contact (TPOC) shall contact the Contractor to schedule a mutually acceptable date and time for the preventive maintenance visits. The scheduled maintenance visits may be made at the same time as an unscheduled visit for corrective or other action if such a visit occurs within one month before a scheduled preventive maintenance visit. All visits must be scheduled, in advance with the NIST TPOC.

4. Any parts or components removed for replacement shall become the property of the Contractor unless otherwise agreed to by the parties. The Contractor shall remove the parts from the NIST campus at the time of the service call. This statement of work assumes that the Contractor will take the component(s) with them at the time of the service call, and that no shipping charges will be incurred under this contract. C. System Enhancements

a. Install all commercial software updates for the purposes of instrument optimization not later than 60 days after any such update is released. The software updates for the U3000 HPLC system in this requirement shall be free for the life of the contract, unless a hardware upgrade is required.

b. Prior to completion of the installation, the Contractor shall test the equipment, review the equipment’s performance, and take whatever steps are necessary to ensure the equipment is functioning in accordance with the manufacturers’ specifications as impacted or changed by the update.

D. Telephone Support

Provide telephone support for the covered equipment during regular business hours. Telephone support must include responses to questions about operating practices, application use, and service issues that can be diagnosed and resolved over the telephone.

E. Compliance with NIST Rules and Regulations

While on the NIST campus, the Contractor’s representative(s) shall abide by all NIST rules and regulations pertaining to visitors.

The Contractor shall provide all information necessary for the COR or TPOC to authorize entrance to the NIST campus in accordance with NIST Security Policy and Procedures. In the case of preventive maintenance visits, the Contractor shall provide at least thirty (30) days’ notice to the COR or the TPOC.

IV. ACCEPTANCE/INSPECTION BY THE GOVERNMENT

The Government reserves the right to conduct quality assurance testing to confirm that the U3000 HPLC system meets the manufacturer’s performance specifications. All Government testing will be completed within five (5) working days of the completion date of a maintenance or repair visit.

V. OPTIONS

The Contractor shall perform the work described in Sections II and III of this SOW for the base period and if exercised, each one-year option period.

VI. DELIVERABLES AND DELIVERABLE DUE DATES

The Contractor shall submit a service ticket prior to departure from NIST on any given service call for maintenance or repairs. The service ticket shall include the following for repairs and maintenance:

a. Model number.

b. Date and time of arrival to NIST.

c. Description of service performed.

d. Name and quantity of any parts that were repaired.

e. Name and quantity of any parts that were replaced.

f. Date and time of departure from NIST.

g. Diagnostic test results or narrative summary demonstrating that the U3000 HPLC system is meeting the performance standards.

h. Any additional comments or recommendations.

i. Printed name and signature of Agilent Technologies service person

j. Signature block for NIST personnel accepting the services rendered.

VII. PERIOD OF PERFORMANCE AND PLACE OF PERFORMANCE

The period of performance shall be for a base period of one year from the date of award with four one-year option periods.

Place of Performance will be at NIST, 325 Broadway, Boulder, CO.

VIII. RISK ASSESSMENT:

The HSPD-12 Security Risk Level assigned to this contract is no risk.

IX. CONTRACTOR’S MINIMUM QUALIFICATIONS

The Contractor shall provide engineers or technicians that are fluent in the operation of the equipment in question throughout the period of performance of this requirement. Contractor personnel shall have at least two (2) years of experience on the U3000 HPLC system.

Due to timelines associated with clearance of non-US citizens, personnel performing repairs must be US citizens.

X. GENERAL INFORMATION

This work does not involve confidential or proprietary data. The certification and accreditation requirements of Clause 1352.239-73 do not apply and a security accreditation package is not required.

Security

NIST is a restricted campus. An identification badge is required for access for entry into buildings and also is shown to the armed Security Police when entering the campus. Contractor personnel must wear the identification badge issued by NIST Security while working at any NIST campus.

Regular Business Hours

Regular business hours are Monday through Friday, 8:00 am to 5:00 pm local time, excluding weekends and Federal Holidays.

Vehicle Registration

All Contractor employees must register their vehicles with the NIST Security Office to gain access to the campus. A valid driver’s license, Government-furnished civilian ID, proof of insurance and current registration must be presented to the NIST Security Office, at which time a NIST vehicle pass will be issued. The pass shall be displayed on the vehicle in accordance with NIST Security Office instructions.
