About this file

This is a Records Management Obligations clause that outlines requirements for contractors who handle federal records. The clause defines federal records and establishes requirements for their management under federal contracts.

The clause mandates that contractors must comply with federal records management laws, NARA regulations, and Privacy Act requirements. Key requirements include: maintaining all records created for government use with proper technical documentation, preventing unauthorized destruction of records, immediately reporting any unauthorized disclosures, obtaining contracting officer approval for subcontractor relationships involving records, using government IT equipment only for authorized purposes, completing agency-provided records management training, and not retaining/selling/disseminating deliverables containing Privacy Act information. The agency maintains ownership of all data and records produced under the contract. These requirements flow down to all subcontractors, and violations by subcontractors are attributed to the prime contractor.
