2. Nature and/or Description of the Action Being Processed:

A new, sole source (TECH ELECTRONICS, INC.) procurement for an urgent and compelling requirement for a Physical Access Control System for the Jesse Brown VAMC, located in

Chicago, Illinois.

3. Description of Supplies/Services Required to Meet the Agency’s Needs:

LENEL brand name only Physical Access Control System for the Police Service at the Jesse

Brown VAMC. Installation is required.

Estimated Value: $360,209.00.

Estimated Delivery / Completion: 30-days ARO.

4. Statutory Authority Permitting Other than Full and Open Competition:

( ) (1) Only One Responsible Source and No Other Supplies or Services Will Satisfy

Agency Requirements per FAR 6.302-1;

(x) (2) Unusual and Compelling Urgency per FAR 6.302-2;

( ) (3) Industrial Mobilization, Engineering, Developmental or Research Capability or Expert Services per FAR 6.302-3;

5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition

Requires the Use of the Authority Cited Above (applicability of authority):

This procurement is for equipment, installation and programming to upgrade the Physical Access

Control System at the Jesse Brown VAMC in Chicago, Illinois. The current system is Lenel

Facility Commander WinX, and the new LENEL upgrade is to OnGuard. The OnGuard upgrade is the only upgrade software platform that will work on the existing infrastructure at Jesse Brown

VAMC. The OnGuard system would allow for the existing data on the current system to be migrated and used on the new.

The Jesse Brown Deputy Director signed a memorandum for the emergency procurement of this requirement. The current system is malfunctioning as the access and control would allow a person in an area one day and then not another day, also profiles are not saving or an error message is received. The current system has been flagged by OI&T as the software is currently unsupportable and they are also requiring the current system to be replaced. The current system controls all card readers and if it goes off line would put the hospital and patients at risk. The current system, until recently, could get support and parts as needed. The latest issue it was discovered that there are no more parts available to replace existing infrastructure.

6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:

This procurement is of an urgent and compelling nature, therefore i/a/w: FAR 5.202(a)(2), the proposed contract action is made under the conditions described in FAR 6.302-2 (or, for purchases conducted using simplified acquisition procedures, if unusual and compelling urgency precludes competition to the maximum extent practicable) and the Government would be seriously injured if the agency complies with the time periods specified in FAR 5.203.

7. Determination by the CO that the Anticipated Cost to the Government will be Fair and

Reasonable:

The IGCE provided by the facility is for $360,209.00 (IGCE calculated with the incorrect quantity of panic alarms required). Pricing information was provided by the two (2) LENEL small business authorized dealers:

1) E.NORMAN SECURITY SYSTEMS, INC. (16-604-1033) – $386,817.79.

2) TECH ELECTRONICS, INC. (03-110-3153) – $374,550.00.

The TECH ELECTRONICS pricing information is $12,267.79 less than the E.NORMAN

SECURITY SYSTEMS, INC. pricing information provided.

8. Description of the Market Research Conducted and the Results, or a Statement of the Reasons

Market Research Was Not Conducted:

VIP search was conducted using the search criteria of NAICS Code: 334290, the search resulted in 163 matches. A second search was conducted using the search criteria of NAICS Code:

334290 and the Keyword: Lenel, the search resulted in one (1) match, an SDVOSB vendor:

HURTVET SUBCONTRACTING, LLC (83-127-7319) – SDVOSB.

Ability One website search was conducted; Ability One does not provide the requirement.

FSS search conducted, resulting in no FSS contract holders that can provide the full requirement.

The manufacturer, LENEL, has authorized two (2) dealers to provide its equipment to the Jesse

Brown VAMC:

1) E.NORMAN SECURITY SYSTEMS, INC. (16-604-1033) – Small Business – pricing information for requirement provided to facility, $386,817.79.

2) TECH ELECTRONICS, INC. (03-110-3153) – Small Business – pricing information for requirement provided to facility, $374,550.00.

Based on the information provided above, it is determined this procurement will be fulfilled by awarding a sole source purchase order to TECH ELECTRONICS, INC., i/a/w: FAR 6.302-2.

9. Any Other Facts Supporting the Use of Other than Full and Open Competition:

Non-Manufacturer Rule (NMR): Definition - for small business set-asides, other than for construction or services, any concern proposing to furnish a product that it did not itself manufacture, must furnish the product of a small business manufacturer unless the SBA has granted a waiver. If the IGCE is less than $250,000.00 the NMR does not apply and a set aside shall be sought. If the IGCE is equal to or greater than $250,000.00 the NMR applies.

The NMR does apply to this procurement, as SBA has not granted a waiver and the IGCE is greater than $250,000.00.
