Section C - Descriptions and Specifications
LIGHT SCATTERING REQUIREMENTS
Light scattering instrument requirements
Nanoparticles can best be measured by dynamic light scattering (DLS) technique. When used in combination with an electrophoretic light scattering detector, the electrophoretic mobility, particle size (0.2-5,000 nanometer in diameter) and their size distribution can be measured simultaneously. More specifically, polymers, quantum dots and colloid particles are subjects of interest. Some of which fluoresces strongly in the emission spectra that interferes with the DLS measurement.
The requirements for the light scattering instrument are consisted of two parts: (A) demonstrated technical/application support (requirements #1-4), and (B) design specifications for nanoparticle characterization (requirements #5-15). Wyatt Technology’s Mobius instrument is chosen since it is the only company that meets both requirements as a complete solution to the Navy’s need. Details on these requirements are listed below.
1. In addition to on-site installation and familiarization, a separate multi-day training at Manufacturers facility that covers theory, hardware, software, and applications consulting. Supplier must demonstrate this level of support on installation and on-site training at the supplier facility. Pre-recorded webinars are not acceptable substitute for on-site training.
2. Two years software/firmware-update support on the control unit of the instrument. The instrument must able to update its software/firmware on the control unit for government security purposes which may include 21CFR Part 11 compliant package. The supplier must demonstrate this from three testimonies from previous customers within the past 12 months.
3. Two years instrument software support. This includes update to new Wyatt software that are: (1) capable to conduct parametric analysis, e.g. plotting and fitting changes in mobility and size over temperature, or changes in charge as a function of sample concentration or pH, and (2) capable to calculating solvent viscosity based on measured diffusion properties of a known size standard.
4. At the end of the 12 months warranty period, additional 12 month service contract covers: (a) priority technical support through means of phone and email, (b) online access to Wyatt Support Center (c) one annual preventative maintenance inspection, (d) necessary repairs, cost of parts and labor included, (e) Critical Care Program that covers 50% of parts’ cost for disasters, (f) free software and firmware updates, (g) applications support from Wyatt’s PhD Application Scientist team, (h) elevated priority turn-around timing for instrument service, and (i) loan instrument when available. In addition, the supplier must show three testimonies from previous customers within the past 12 months.
5. Manufacturing. The Mobius is manufactured by Wyatt Technology in the USA; no aspects of the R&D or manufacturing of the instrument are “outsourced”.
6. Sensitivity. Proprietary optical designs, laser systems, and alignment processes provide the highest sensitivity for measurements under most dilute conditions at a wavelength of 532 nm. The Mobius can characterize the mobility of Lysozyme, a 14 kDa protein, at a concentration of 1 mg/mL with 15 seconds of data collection.
7. Simultaneous mobility and size measurements. The unique optical design of the Mobius allows simultaneous measurements of the mobility and size of the sample. Simultaneous mobility and size measurements are extremely important for closely monitoring the sample condition during the measurement. Other ‘zeta potential’ instruments can only carry out these measurements sequentially, losing this valuable information.
8. Massively-parallel phase analysis light scattering (MP-PALS). The Mobius incorporates an array of 31 PALS photodetectors, with each of the detectors making an independent measurement of sample mobility. This new measurement technique is called MP-PALS and enables the Mobius to capture data more than thirty times faster than conventional ‘zeta potential’ instruments.
9. Unique flow-through cell design. The Mobius flow-through cell (with a cell volume of 170μL) is uniquely designed to eliminate air-fluid interface, creating a closed system for mobility measurements. Elimination of free liquid surface minimizes fluid convection driven by surface-tension, avoiding artifacts in the measurement of mobility. The closed measurement cell also ensures the ratio of solvent mixtures is perfectly maintained. Furthermore the Mobius flow-through cell can withstand at least 50 bars of pressure, further extending its utility when used in combination with an autosampler and/or Wyatt Atlas pressurization system.
10. Option for open cuvette for batch mobility measurements that uses low-volume dip cell. The Mobius has an easy-to-use, low-volume dip cell accessory which uniquely enables batch measurements of mobility in native solution, without dilution or insertion of the sample into a reservoir of matched buffer. The minimum required sample volume is 65μL, recoverable.
11. Fluorescence filter kit at 532 nm, will be required for measuring our samples.
12. The Mobius may be used in conjunction with an auto-sampler. Since the Mobius flow-through cell is designed to have an enclosed and well-sealed sample chamber, the Mobius may be used with an auto-sampler for automated and unattended measurements (for example, with an Agilent auto-sampler using a 900-μL sample loop).
13. Wyatt Atlas: Unique pressurization system for high-salt samples. Light scattering based mobility measurements in conducting solutions are often disrupted by gas bubbles generated via electrolysis, especially when measurements are required under medium- to high-salt conditions (> 7 mS/cm). The gas bubbles interfere with the scattered light and distort the electric field, producing erroneous mobility data. The Wyatt Atlas pressurization system pressurizes the sample contained in the Mobius flow-through cell up to 35 bars (the Mobius flow-through cell withstands at least 50 bars (~700psi) of pressure), preventing the evolution of gas bubbles due to electrolysis.
14. High-field measurement mode for organic samples. For organic or non-conductive aqueous samples, the Mobius can apply up to 667 volt/cm of electric field, more than twice the maximum achievable electric field of conventional ‘zeta potential’ instruments.
15. Automated temperature control from 4 to 70 degrees Celsius. The Mobius provides customers software programmable temperature control from 4 to 70 degrees Celsius. Temperatures can be incremented or decremented, allowing thermal ramps at customer specified ramp rates while simultaneously collecting data. The thermal data can be analyzed within the Mobius DYNAMICS software utilizing one of several proprietary fitting algorithms to determine T-melting and T-onset of aggregation.

(i) Offers from HUBZone small business concerns that have not waived the evaluation preference; and
(ii) Otherwise successful offers from small business concerns.
(2) The factor of 10 percent shall be applied on a line item basis or to any group of items on which award may be made. Other evaluation factors described in the solicitation shall be applied before application of the factor.
(3) When the two highest rated offerors are a HUBZone small business concern and a large business, and the evaluated offer of the HUBZone small business concern is equal to the evaluated offer of the large business after considering the price evaluation preference, award will be made to the HUBZone small business concern.
(c) Waiver of evaluation preference. A HUBZone small business concern may elect to waive the evaluation preference, in which case the factor will be added to its offer for evaluation purposes. The agreements in paragraph (d) of this clause do not apply if the offeror has waived the evaluation preference.
[ ] Offer elects to waive the evaluation preference.
(d) Agreement. A HUBZone small business concern agrees that in the performance of the contract, in the case of a contract for
(1) Services (except construction), at least 50 percent of the cost of personnel for contract performance will be spent for employees of the concern or employees of other HUBZone small business concerns;
(2) Supplies (other than procurement from a nonmanufacturer of such supplies), at least 50 percent of the cost of manufacturing, excluding the cost of materials, will be performed by the concern or other HUBZone small business concerns;

POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (JUL 2013)
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (c) of this clause. Such a concern is “not dominant in its field of operation” when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(b) If the Contractor represented that it was a small business concern prior to award of this contract, the Contractor shall rerepresent its size status according to paragraph (e) of this clause or, if applicable, paragraph (g) of this clause, upon the occurrence of any of the following:

(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code assigned to this contract. The small business size standard corresponding to this NAICS code can be found at http://www.sba.gov/content/table-small-business-size-standards/ .
(d) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(e) Except as provided in paragraph (g) of this clause, the Contractor shall make the rerepresentation required by paragraph (b) of this clause by validating or updating all its representations and Certification section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause that the data have been validated or updated, and provide the date of the validation or update.
(f) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (e) or (g) of this clause.
(g) If the Contractor does not have representations and certifications in SAM, or does not have a representation in SAM for the NAICS code applicable to this contract, the Contractor is required to complete the following rerepresentation and submit it to the contracting office, along with the contract number and the date on which the rerepresentation was completed:

(1) Any such clause is unenforceable against the Government.
(2) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOX, or similar legal instrument or agreement is invoked through an "I agree" click box or other comparable mechanism (e.g., "click-wrap" or "browse-wrap" agreements), execution does not bind the Government or any Government authorized end user to such clause.

"Data Universal Numbering System +4 (DUNS+4) number" means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR 32.11) for the same parent concern.
"Registered in the System for Award Management (SAM) database" means that --
(1) The contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, and Contractor and Government Entity (CAGE) code into the SAM database; and

ALTERNATIVE LINE ITEM STRUCTURE (SEP 2011)
(a) Line items are the basic structural elements in a solicitation or contract that provide for the organization of contract requirements to facilitate pricing, delivery, inspection, acceptance and payment. Line items are organized into contract line items, subline items, and exhibit line items. Separate line items should be established to account for separate pricing, identification (see section 211.274) of the Defense Federal Acquisition Regulation Supplement), deliveries, or funding. The Government recognizes that the line item structure in this solicitation may not conform to every offeror's practices. Failure to correct these issues can result in difficulties in accounting for deliveries and processing payments. Therefore, offerors are invited to propose an alternative line item structure for items on which bids, proposals, or quotes are requested in this solicitation to ensure that the resulting contract structure is economically and administratively advantageous to the Government and the Contractor.
(b) If an alternative line item structure is proposed, the structure must be consistent with subpart 204.71 of the Defense Federal Acquisition Regulation Supplement and PGI 211.274. A sample line item structure and a proposed alternative structure are as follows:
