JUSTIFICATION AND APPROVAL

OTHER THAN FULL AND OPEN COMPETITION

1. Identification of the agency and the contracting activity.

This justification is executed by the Naval Medical Logistics Command (NMLC), Fort Detrick, MD, on behalf of the Navy to meet Navy Medicine Information System Support Activity (NAVMISSA) requirements. The following sites are included: Lovell Federal Health Care Center (Great Lakes) which is a shared VA/ U.S. Navy facility, NH Jacksonville, BHC Mayport, BHC Jacksonville, NH Pensacola, BHC Belle Chasse, NMC Meridian, BHC Gulfport, NH Lemoore, BMC Philadelphia, NH Naples, NH Sigonella, NH Guam, NH Yokosuka, and MCAS BMC Iwakuni.

2. Nature and/or description of the action.

The proposed action is for HIPAA compliant audiometric software solution. The Government intends on awarding a Firm Fixed Price contract. The proposed source is AudSoft, Inc., 1327 Ashton Road, Suite 203, Hanover, MD 21706.

3. Description of Supplies or Services:

The proposed acquisition is to purchase HIPAA compliant audiometric software solution. It is intended to acquire a one-time purchase of AudBase Base software package which includes licensing for server database plus two (2) concurrent user licenses. The software shall include:

manual (point and click) data input or electronically transferred data from RS-232 equipment GSI-61 and Tympstar, GSI AudioStar, Madsen OTOsuite connected products, and Interacoustics Suite connected products. Forms shall be viewed and/or printed in graphical or tabular format.

AudBase Install and Training Package includes on-site install, training, and support for entire end user group and IT Department for each MTF plus cabling and port converters, if necessary.

Also the software package shall include license to print AudBase report to a file for attachment into electronic medical records (AHLTA). Install includes server software installation/configuration, client software installation/configuration, and audiometric equipment hookup.

4. Identification of the statutory exceptions permitting other than full and open competition.

This requirement may be excluded from competition requirements under the authority of 10 USC 2304(c)(1) and FAR 13.501(a) sole source (including brand name) acquisitions.

5. Demonstration that the proposed contractor’s unique qualifications or the nature of the acquisition requires use of the authority cited.

AudSoft Inc. is the manufacturer and sole vendor of AudBase. There are no other authorized vendors, distributors or providers of this software solution. AudBase audiology software meets and has been approved by the DoD Information Assurance Certification and Accreditation Process (DIACAP). While there are other products on the market that collect audiograms, those applications coincide with those vendor's medical devices, and changing would force the DoD to replace over half of the medical devices that are made from other vendors. This equipment includes RS-232 equipment GSI-61 and Tympstar, GSI AudioStar, Madsen OTOsuite connected products, and Interacoustics Suite connected products. This equipment was purchased around 2010 at an estimated value of $360,000. Upgrades were made between 2013 and 2014 at 15 Navy MTFs. The life expectancy of this equipment is 10 years. AudBase is device agnostic and provides compatibility with all the major audiology equipment manufacturers, allowing the clinics to keep their existing audiometers and tympanometers.

6. Description of efforts made to ensure that offers are solicited from as many potential sources as practicable.

Market research was performed, the results of which are in paragraph 8. This requirement will be posted to NECO and/or FedBizOpps in accordance with FAR 5.202.

7. Determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.

The Contracting Officer shall determine the anticipated cost to the Government of the supplies/services covered by this Justification and Approval will be fair and reasonable by conducting a price analysis before an award is made. In addition, the Government anticipates that the negotiated contract price will reflect a discount from the vendor’s commercial price list and will be determined fair and reasonable.

8. Description of the market survey conducted and the results, or a statement of the reasons a market survey was not conducted.

Market research was conducted by the NAVMISSA and Hearing Center of Excellence (HCE) program office in August 2013 and September 2014 by searching the web and contact with other DoD medical offices. While there are other audiology software programs are available, those other vendor applications coincide with that vendor's medical devices, which would force the DoD to replace over half of the medical devices that are made from other vendors.

9. Other facts supporting the use of other than full and open competition.

DoD Hearing Center of Excellence (HCE) had previously awarded a sole source contact to AudSoft Inc. for the AudBase Base Package software. Reference contract number W81XWH- 13-C-0221 dated 25 September 2013. An earlier version of AudBase Software is currently installed and used by other DoD medical facilities, more than half of our total AudBase Software installation requirement. Upgrade of these units with the latest version of AudBase Software and

It would take a significant amount of time for the other software manufacturers to obtain the required DoD DIACAP certification and even longer to adapt their software to meet our requirement for digital capture of manipulative audiograms.

10. Listing of Sources, if any, which expressed, in writing, an interest in the acquisition.

To date, no other sources have written to express an interest. Any sources expressing interest in response to the synopsis will receive consideration.

11. Statement of actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.

Future requirements will be synopsized in accordance with FAR 5.203.

For the reasons set forth in Paragraph 5, NMLC has no plans at this time to compete future contacts for the types of supplies/services covered by this document. If another potential source emerges, NMLC will assess whether competition for future requirements is feasible.

The Government expects to obtain a technical data package that will support competition for future acquisitions of the same or similar items.
