NAVSUP FLEET LOGISTICS CENTER

CONTRACTING DEPARTMENT

110 YORKTOWN AVENUE

NAS JACKSONVILLE, FL 32212

J&A No. 18-017

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Identification of Requiring Activity and Contracting Activity.

The requiring activity is Trident Refit Facility, (TRF), Kings Bay, GA; the contracting activity is Fleet

Logistics Center Jacksonville (FLCJ).

2. Description of the Action Being Approved.

This justification and approval is to provide a Layher Scaffolding System in support of Trident Refit

Facility (TRF) Naval Submarine Base, Kings Bay, GA, without full and open competition for the subject requirement, in that the need for these supplies is of such unusual and compelling urgency that the

Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits. An urgent and compelling need exists for scaffolding that supports the repair and restoration of the sonar dome/sphere while the submarine is in dry dock to meet submarine schedules. It is vital that the sonar equipment is up and running prior to the submarine’s mission and competing this requirement would cause unacceptable delays. Restoration and repair of the sonar system maintains peak tactical advantage over our adversaries and is important for the safety of our Government. It is critical that the sonar sphere be fully functional because it is vital for safe submarine operation and tactical capabilities, especially considering the submarine operates in areas with large contact densities. Having the capability to restore the sonar dome to full capability is required to support the strategic mission of the submarine. The submarine cannot safely move in the water without the sonar which uses sound propagation to navigate, communicate with or detect objects on or under the surface of the water, such as other vessels. A firm-fixed price contract is anticipated.

All items listed above are open market. The total estimated cost for all items is $1,520,797.85 including shipping costs.

These items will be used to perform sonar repairs to the submarine while in the dry dock.

4. Statutory Authority Permitting Other Than Full and Open Competition.

The statutory authority which permits other than full and open competition is 41 U.S.C. 1901(e)(2), Special Rules for Commercial Items. This urgent and compelling acquisition for certain commercial items, will be implemented by FAR 13.501 (a).

5. Rationale Justifying Use of Cited Statutory Authority.

The Trident Refit Facility in Kings Bay, GA was recently made aware of an emerging and urgent requirement needed by 9 July 2018 to support sonar dome repair on one of the fleet’s strategic assets requiring specialized scaffolding equipment. The unit impacted is forward deployed, and as a result, the maintenance for the sonar dome was identified late. The current scaffolding system is not constructed and based on the limitations of the current scaffolding system, the assembly to use in this application is too time consuming to meet submarine schedules and would impact operational schedules of multiple tactical and strategic assets. Also, there are additional safety requirements needed for the scaffolding for this particular asset. The scaffolding is required for reaching in around the sphere once the dome is removed.

There is urgent need for new scaffolding equipment to support the submarine’s sonar dome/sphere repairs so that the sonar equipment is up and running prior to their mission. Restoration and repair of sonar systems maintains peak tactical advantage over our adversaries. The sonar sphere being fully functional is vital for safe submarine operation and tactical capabilities, especially considering the submarine operates in areas with large contact densities. Additionally, having the capability to restore the sonar dome to full capability is required to support the strategic mission of submarine, the number one priority of the Department of Defense. Market Research indicates that Layher’s Scaffolding products are the only known type of scaffolding products that provide the technical and safety features required. They incorporate patented and built in fall protection systems while building or constructing the scaffolding that is not available from other manufacturers. The scaffolding has a unique critical interlocking capability that allows the assembled sections of the scaffolding to be lifted and removed in half the time as previously allowed from the dry dock, this is especially important as it allows the rapid removal of the scaffolding prior to hurricanes. There are no other vendors at this time that can provide these capabilities.

It is important that sonar dome repairs be completed while the submarine is in dry dock to meet critical submarine schedules. If the equipment is not received, missions will be compromised day by day until the scaffolding equipment is in place for repairs to be completed.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

The requiring activity and contracting activity have conducted market research to the maximum extent possible in order to meet the urgent needs of the requirement. Layher is the only source capable of meeting the requirement. A synopsis of this requirement has not been published. In accordance with FAR

5.202(a)(2), a synopsis is not required when the proposed contract action is made under the conditions of unusual and compelling urgency and the Government would be seriously injured if the agency complies with the time periods specified in FAR 5.203.

7. Determination of Fair and Reasonable Cost.

The Contracting Officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable in accordance with FAR 13.106-3.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Paragraph 5, NAVSUP Fleet Logistics Center Jacksonville (FLCJ) has no plans at this time to compete future contacts for the types of supplies/services covered by this document.

If another potential requirement emerges, FLCJ will assess whether competition for future requirements is feasible.

9. Contracting Point of Contact.
