NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION

IN REPLY REFER TO:

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, NJ.

2. Description of the Action Being Approved.

This Justification & Approval (J&A) authorizes and approves the issuance of a Firm Fixed-Price contract to Precision, LLC (Precision) of Newberg, OR for the continuation of Contractor Owned/Contractor Operated (CO/CO) Unmanned Aircraft Systems (UAS) Intelligence, Reconnaissance, and Surveillance (ISR) services. These services are in support of Advanced Concepts & Rapid Transition Division’s (AD-4.11.6) urgent requirement to continue providing ISR services supporting United States Marine Forces Central Command (USCENTCOM) as requested in Urgent Universal Needs Statement (UUNS) “USCENTCOM Group 2 UAS Services.”

3. Description of Supplies/Services.

AD-4.11.6 provides technical personnel, processes, coordination, and facilities to support rapid insertion and technology transition of advanced technologies to support programs of record and direct insertion of technology to support urgent fleet needs. This effort will provide USCENTCOM a continuation of mission-critical ISR capabilities by providing CO/CO UAS, payloads, and operators. These ISR services provide the USMC the capability to evaluate and gather ISR data as part of mission-critical force protection and combat evaluation utilizing CO/CO UAS. Approval of this contract action will provide continuation of the aforementioned CO/CO UAS support.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(2), FAR 6.302-2: unusual and compelling urgency.

5. Rationale Justifying Use of Cited Statutory Authority.

“Urgent Statement of Need (USON) Group 2 ISR Requirement” dated 20 November 2017 resulted in AD-4.11.6 providing CO/CO Group 2 UAS ISR services via U.S. General Services Administration contract GSC-QF0B-17-AJ0010 order GSQ0017AJ0010 for a PoP of 1 February 2018 through 30 June 2018. The contract was extended through 31 July 2018 to allow sufficient time for a contract vehicle to be established to support continuation of ISR service requirements as documented in USON for “USCENTCOM ISR Requirement – Group 2” dated 29 May 2018.

Contract N68335-18-C-0680 was awarded to Precision for CO/CO UAS ISR services for a PoP of 1 August 2018 through 15 November 2018 with an option for demobilization from 15 November 2018 to 15 December 2018. This contract was awarded in response to USON for “USCENTCOM ISR Requirement – Group 2”, dated 29 May 2018. The USON stated that is was intended for a Joint Urgent Operational Needs (JUON) USCENTCOM ScanEagle UAS asset to be used to fulfill the needed ISR capabilities and requirements. However, in April 2018 U.S.

Central Command (USCENTCOM) redirected the intended USCENTCOM ScanEagle UAS assets to a different location within the USCENTCOM Area Of Responsibility (AOR).

Therefore, contract N68335-18-C-0680 was extended for an additional four months of CO/CO UAS ISR services from Precision until the ScanEagle UAS assets become available for the requirement to transition to PMA-263 for Government Owned/Contractor Operators (GO/CO) UAS ISR services.

As documented in J&A_18_3096, PMA-263 was planning to assume responsibility of the USCENTCOM ISR requirements on 15 November 2018 by providing a Government owned ScanEagle UAS while pursuing a competitive ISR services strategy which was intended to be fulfilled in a GO/CO capacity. During performance of the current contract, PMA-263 provided a ScanEagle asset for ISR services for up to 600 flight hours a month. However, on 09 October 2018, UUNS “USCENTCOM Group 2 UAS Services” was signed documenting the need for continued CO/CO ISR support above and beyond the flight hours the ScanEagle is currently providing. Additional flight hours are needed because the USCENTCOM mission grew in complexity and scope. The operational chain of command is unable to consistently meet the requirement to cover these additional responsibilities with the current UAS ISR services of the Scan Eagle provided via PMA-263. This new UUNS provides new requirements for flight hours above and beyond what was provided under the USON signed on 29 May 2018. Therefore, continued CO/CO ISR flight services are required to supplement the flight hours provided by the ScanEagle to meet the increase in scope and complexity of the mission. On 12 October 2018, AD-4.11.6 was informed that USCENTCOM anticipated solution to the asset shortage is submission of a new JUON that directs the required level of support via PMA-263 assets. Once USCENTCOM’s PMA-263 efforts directed by the proposed JUON are in place, AD-4.11.6 CO/CO ISR support will no longer be required. The USON “USCENTCOM UAS Requirement- Group 2” was signed on 23 October 2018.

Precision is currently providing these services. Use of any other source other than Precision would cause a break in service of these critical UAS ISR services after completion of the current operations on 15 November 2018. A delay in awarding this contract action or a break in service would result in a loss of mission-critical ISR coverage necessary to support USCENTCOM’s operations. Without this mission-critical ISR support, there will be an immediate impact in the ability of USCENTCOM to accomplish their mission. These operational consequences will be realized every day these mission-critical ISR support services are not in place upon the expiration of the current PoP of 15 November 2018.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

AD-4.11.6 technical Subject Matter Experts conducted market research to identify vendors who could potentially provide the needed urgent ISR capabilities. Given the urgent requirements and time constraints of this effort, only Precision was found to be able to provide the required support within the 30-day timeframe necessary to avoid a break in continuous ISR support.

Precision is currently performing ISR services under contract, N68335-18-C-0680. Use of any other source would further induce an increased likelihood of a break in service directly impacting the TF-SW’s mission and increases the risks identified in section 5 of this J&A. A synopsis was not posted on Federal Business Opportunities (FBO) website In Accordance With (IAW) FAR 6.302-2(a)(1) Unusual and Compelling Urgency Citation 10 U.S.C. 2304(c)(2). IAW FAR 6.302-2, this J&A will be posted to FBO within 30 days after contract award.

7. Determination of Fair and Reasonable Cost.

IAW FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal cost proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. The proposal will be reviewed by experienced technical analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

For the reasons set forth in Section 5, execution of this urgent requirement will fulfill the immediate need. AD-4.11.6 anticipates transition of the ISR support to PMA-263 at the completion of this action as a result of a new USCENTCOM submitted JUON. The new USCENTCOM JUON directs the required level of support via PMA-263 assets. Once USCENTCOM’s PMA-263 efforts directed by the proposed JUON are in place, AD-4.11.6 CO/CO ISR support will no longer be required.
