NAVAL AIR WARFARE CENTER AIRCRAFT DIVISION

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, NJ.

2. Description of the Action Being Approved.

This justification and approval authorizes the issuance of a firm fixed-price contract to Precision, LLC of Newberg, Oregon for the continuation of Contractor Owned Contractor Operated (COCO) Unmanned Aircraft Systems (UAS) Intelligence, Reconnaissance, and Surveillance (ISR) services. These services support NAWCAD 4.11.6 urgent requirements to continue providing ISR capability to Task Force Southwest (TF-SW) currently operating in Afghanistan. The Period of Performance (POP) shall be six (6) months.

3. Description of Supplies/Services.

NAWCAD 4.11.6 provides technical personnel, processes, coordination, and facilities to support rapid insertion and technology transition of advanced technologies to support programs of record and direct insertion of technology to support urgent fleet needs. This effort will provide the United States Marine Corps (USMC) TF-SW, operating within Afghanistan, critical ISR capabilities by providing COCO UAS, payloads, and operators to provide force protection over-watch support of train, advise and assist missions. These ISR services will provide the USMC the capability to evaluate and gather ISR data as part of a combat evaluation utilizing COCO UAS. This effort will also include an option for pack out and demobilization from theater to continental United States.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(2), FAR 6.302-2: unusual and compelling urgency.

5. Rationale Justifying Use of Cited Statutory Authority.

As detailed in the Urgent Statement of Need (USON) for TF-SW ISR Requirement, dated 29 May 2018, NAWCAD

4.11.6 has the responsibility to provide urgent ISR services to support USMC TF-SW operating with United States Central Command (CENTCOM) Area of Responsibility (AOR).

Precision is currently providing TF-SW ISR services as a subcontractor under contract GSQ0017AJ0010. The POP for that effort expires on 30 July 2018. It was anticipated that ScanEagle UAS would be provided to fulfill the needed ISR capabilities and requirements upon conclusion of the current POP under GSQ0017AJ0010. However, in April 2018 CENTCOM redirected the intended TF-SW ScanEagle UAS assets to a different location within the CENTCOM AOR. As a result, the USMC have an urgent requirement for continuation of ISR services for another six (6) months until 15 December 2018.

As Precision is currently providing these ISR services in theater, use of any other source other than Precision would entail recruitment, training, travel, and transition of tasking to a new contractor. This would entail significant time resulting in a break of service in addition to duplication of costs for Precision to pack out and demobilize from theater while another vendor travels to theater only to pack out and demobilize again in December. A delay in awarding a contract, or a break in service, would result in a loss of critical ISR coverage. Without this critical ISR support there will be an immediate increased probability of casualties and loss of life and will directly impact the ability of TF-SW to accomplish their mission to assist the Afghanistan National Army. These operational consequences will be realized every day these critical ISR support services are not in place upon expiring of the current POP on 30 July 2018.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

NAWCAD 4.11.6 technical subject matter experts conducted market research to identify vendors who could potentially provide the needed ISR capabilities in Afghanistan. Given the urgent tasking and time constraints of this effort, only Precision was found to be able to provide the required support within the required sixty (60) day timeframe necessary to avoid a break in continuous ISR support. Precision is currently performing these services as a subcontractor under contract GSQ0017AJ0010, another source would require additional time to deploy assets to theater at additional costs to the Government for travel and duplicate pack out and demobilization costs. The Government would not be able to award a competitive contract for these services prior to the current POP expiring on 30 July 2018.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal cost proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. The proposal will be reviewed by experienced technical analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

Future requirements, upon completion of this six (6) month effort will transition from NAWCAD 4.11.6 to PMA-263.

The Government anticipates future requirements for follow on ISR services in support of TF-SW will be fulfilled by providing Government owned ScanEagle UAS while competing requirements for ISR services in a Government owned contractor operated capacity.
