JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ

2. Description of the Action Being Approved.

This Justification and Approval (J&A) authorizes the brand name only procurement for Snap-On Tools in support of the Tool Control Program for the H1 Aircraft.

3. Description of Supplies/Services.

The total number of tools to be purchased is 8,959 for H1 procurement. The required tool boxes where these tools will be stored have been previously designed and purchased by the H1 program at the squadron level. This effort is a continuation of the purchase of tools for the tool boxes already in place at the squadron level. Each specific tool box is designed to accomplish a specific maintenance task on the various aircraft. The toolboxes are fitted with foam inserts into which the exact designs of the required tools are etched. The purchase of these tools provides the fleet with the capability of ensuring that all tools are accounted for upon completion of the maintenance tasks. Further, training is conducted utilizing these identical tool boxes. In order to ensure that all servicemen trained on servicing the aircraft/equipment can perform their designated tasks no matter where they are located; tools are the same from one squadron to another. Snap On Tools are required to support this program for uniformity of tools and tool box fit for all aircraft maintenance. As the tools are required to fit exactly into their designated foam inserts in the tool boxes, Snap On Tools are the only tools which will meet the fit and uniformity requirements for these particular tool boxes. The estimated value of this procurement is $191,520.23 and will be funded with APN-1 funds.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C 2304(c)(1) and FAR 6.302-1(a)(2), Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Rationale Justifying Use of Cited Statutory Authority.

All items to be procured are commercial items. It has been determined that the Snap-On brand is the only brand that can satisfy the requirements; however, there are distributors that can provide the tools. Since this initiation, the tool control program has continually canvassed the tool industry (manufacturers and suppliers) through various direct meetings and trade shows for other manufactures and/or suppliers to supply this need for NAVAIR. To date IDSC Holdings, LLC Snap-On Industrial is the only company still able to provide these tools without costly re-design. A synopsis for this requirement will be posted to the FedBizzOpps website. The synopsis was posted on 14 Aug 2017. Resulting in a response from five (5) vendors.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Snap-On is the only company that can satisfy the requirements; however, there are distributors that can provide the tools, but do not ship material out by the tool kit. Snap-On logistically packages and ships material in such a way that saves money in labor costs. This also enables us to get the most storage capacity out of the Vertical storage units. For first run tools and tool box kits, other suppliers can and are solicited for satisfying requirements. Since this initiation, the tool control program has continually canvassed the tool industry (manufacturers and suppliers) through various direct meetings and trade shows for other manufactures and/or suppliers to supply this need for NAVAIR. To date IDSC Holdings, LLC Snap-On Industrial is the only company still able to provide these tools without costly re-design.

7. Determination of Fair and Reasonable Cost.

In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with sufficient information to support the accuracy and reliability of the estimate. The contractor's proposal will be reviewed by experienced technical analysts, cost analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize price analysis for these commercial items as the basis for negotiating a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

Since this initiation, the tool control program will continue to canvass the tool industry (manufacturers and suppliers) through various direct meetings and trade shows for other manufacturers and/or suppliers to supply this need for NAVAIR.
