JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWCAD) Lakehurst, NJ
2. Description of the Action Being Approved.
This Justification and Approval authorizes and approves the issuance of a firm fixed price contract for the procurement of Enterprise Land Mobile Radio (ELMR) simulcast repeaters and ancillary support services on a sole source basis to Motorola Solutions, Inc of Columbia, MD. This requirement will support the NAWCAD Special Communications Mission Solutions (SCMS) Division St. Inigoes, MD, Commander, Navy Installation Command (CNIC) ELMR Contingency Operations for Bahrain.
3. Description of Supplies/Services.
The SCMS Division of NAWCAD, St. Inigoes has been tasked by CNIC to support the Commander, Navy Region Europe, Africa, and Southwest Asia (CNREURAFSWA) with the connectivity of their ELMR network at Isa Air Base (IAB) in Bahrain. The Bahrain ELMR network will be established to provide the communications required by the first responders, during safety/security emergencies on military installations in Bahrain. The Logistics Support Area (LSA) in Bahrain, which is located approximately two miles north of the IAB, employs the Motorola ASTRO 25 Integrated Voice and Data trunking radio system as their emergency communication system. The ASTRO 25 system includes a six (6)-channel simulcast repeater that is inadequate to provide coverage for the entire flight line area of the base. By adding an additional six (6)-channel simulcast repeater site, it will expand the coverage and boost the signal to the users on the flight line at IAB. The identified six-channel simulcast repeater site will be installed inside the flight line hangar at the IAB in Bahrain.
A simulcast repeater system works by receiving multiple frequencies and retransmitting via the available channels. The simulcast repeater system will be able to use the current six (6) frequencies and transmit to twelve channels. The simulcast repeater system will also facilitate voice, data and Over the Air Rekeying to the flight line. The simulcast repeaters connect with two controllers via an Ethernet router. The controllers are equipped with Information Assurance (IA) features that mitigate unauthorized attempts to connect by intercepting the frequencies.
The Navy ELMR system uses Motorola’s Dynamic System Resiliency technology, which allows remote sites to continue to communicate system-wide when the site loses connectivity, for whatever reason to the Zone Core. Only Motorola parts are 100% compatible with the system in current use. The ELMR’s hardware, software, and data connections, as well as the policies, procedures, and facilities that support the equipment are all certified to U.S. Navy standards. Motorola Solutions Inc. currently possesses a Navy Authorization to Operate in the Bahrain region. The six-channel simulcast repeater system will meet Department of Defense requirements for Project 25 LMR and Secretary of the Navy requirements for Information Assurance/Cybersecurity.
The requested communications equipment will improve reliability and address simulcast and redundancy deficiencies within the current system for ELMR Outside the Continental United Status Project 25 communications network. It will provide additional coverage and flexibility to integrate with other Navy ELMR assets in the CNREURAFSWA Region.
The total estimated value of this contract is $ , which will be funded with .
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(1), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority.
CNIC has standardized across the US Navy, starting in 2007, the architecture and lifecycle support structure for all wireless emergency response communication systems. Operational requirements as stated in the CNIC Concept of Operations for the U. S. Navy ELMR system, latest version 2.05 dtd 24 FEB 2014, necessitate single vendor sourcing, from Motorola Solutions, for the commercial enterprise and subscriber radio infrastructure equipment utilized in ELMR in order to fully meet mission requirements.
The required equipment and ancillary support services for this acquisition are to support a critical requirement for the LSA, Bahrain Security Forces established in the Kingdom of Bahrain for contingency operations in the Central Command Area of Responsibility (AOR). The current threat to LSA Bahrain is categorized as significant due to its unique geographical location. Not only is the Kingdom of Bahrain surrounded by hostile neighboring countries, but terrorist organizations, including the Islamic State, are active within this AOR. Therefore, effective communication is an operational necessity and as outlined above, the emergency response communications capability for the LSA Bahrain is already operating in a degraded capacity. Further degradation or complete loss of communications is highly likely, the impact of which could result in the loss of life or extreme damage to government property and critically impacting mission capability. Procuring the required equipment from an alternative manufacturer would cause the Government to incur substantial duplication of costs and experience unnacceptable delays to the program’s schedule. This duplication of cost is estimated to be $1,822,000, which consists of $828,000 following the procurement of equipment from any manufacturer other than Motorola. The cost to train personnel to support the different equipment configuration and maintenance would average $30,000 per year. In addition, spare material would need to be procured for established repair banks and is estimated to cost $800,000. Lastly, $164,000 is estimated for IA documentation and accreditation level of effort. Due to IA accreditation, the program would experience a delay of approximately 12 months. This delay impacts the Government's ability to meet its mission.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research was conducted on internet search engines such as Google.com as well as the gsaadvantage.gov and sewp.nasa.gov websites to identify commercially available solutions for a LMR Six (6) Channel Simulcast Repeater. Multiple solutions were identified and reviewed to determine each solution’s ability to meet the requirements for CNIC IAB. Of the manufacturers identified in the market research, several provide similar products, but none could meet the Government’s requirements because they are not part of the standardized ELMR baseline. It was found that Motorola is the only manufacturer whose equipment meets the Navy’s ELMR requirements while maintaining interoperability and interchangeability with the existing ELMR system. In addition, Motorola is the only manufacturer capable of providing voice and data transmission and Over the Air Programming capabilities on the Navy’s standardized ELMR network.
The research conducted by SCMS determined Motorola has several authorized distributors, which are authorized to provide the required Motorola hardware, however, none of the distributors are authorized to provide the ancillary technical services needed to install and maintain the simulcast repeater system.
In accordance with Department of Defense Federal Acquisition Regulation Supplement 206.302-1(d) a Request for Information notice was published on the FedBizOpps webpage on 02 February 2016 and closed on 22 February 2016. Responses were received from Harris Corporation, Relm Wireless Corporation and Motorola Solutions. The Government evaluated the responses from Harris and Relm, but concluded they could not meet the Government’s requirements, without causing the Government to incur a substantial duplication of costs and program delays, as outlined above. Motorola’s response provided pricing and availability of the requirement equipment.
Subsequently, a synopsis was posted to FedBizOpps, in accordance with FAR 5.2, on 03 August 2016 and closed on 18 August 2016. No inquiries or challenges were received.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.4, the Contracting Officer shall ensure that the price negotiated for this acquisition is fair and reasonable. An independent government estimate has been provided for this effort. The required Motorola components of the six (6)-channel simulcast repeater site, have been determined commercial in accordance with the definition of commercial items at FAR 2.101. As such, the contractor will submit a formal price proposal with other than certified cost or pricing data to sufficiently to support the accuracy and reliability of the estimate. The proposal will be reviewed by experienced technical personnel at SCMS. The Contracting Officer will utilize price analysis in accordance with FAR 15.404-1, including a review of historical data and commercial price lists, as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
NAWCAD has no plan at this time, to compete future contracts for the required equipment described in this document. If another potential source emerges, NAWCAD will assess whether competition for future requirements is feasible.
