JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved.
This justification and approval authorizes and approves an urgent, limited competition for 55 Stabilized Optics Tables, Part Number (P/N) 3429AS8600-2, in accordance with government drawing package 3429AS8600, Rev. E. and Technical Data Requirements (TDR) Request 15-17020A between two approved sources including Central Metal Fabricators, Inc. (CAGE Code: 1NZU4), Farmingdale, NJ, and Merrill Tool & Machine (CAGE Code: 5VGF8), Merrill, MI.
3. Description of Supplies/Services.
The NAWCAD Prototype and Manufacturing Division (PMD) has a requirement to procure Stabilized Optics Tables, P/N: 3429AS8600-2, for the IFLOLS Land-Based program for Foreign Military Sales (FMS) France and for the U.S. Navy, Naval Supply Systems Command (NAVSUP) to replenish the federal stock system. The Stabilized Optics Tables are Critical Application Items (CAI) and are integral in communicating landing coordinates with the pilots. Per SECNAVINST 4140.2(E)(2)(a), all capable contractors must have prior approval from the Engineering Support Activity at NAWCAD Lakehurst for CAI.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(2) & FAR 5.202(a)(2), Unusual and compelling urgency.
5. Rationale Justifying Use of Cited Statutory Authority.
The Stabilized Optics Tables are required by March 2017 in order to align, test, and install the tables in the IFLOLS to minimize the impact on the Fleet and Global War on Terror. Vendors require 8-12 months to deliver the tables after the first article is approved. Due to the long-lead time, delays to the table deliveries will lead to Government work stoppages which will result in a financial impact for the Government and will also directly impact readiness to support ongoing aviation capable ship operations. A letter of urgency, dated 16 June 2016, was received from AIR-4.8.8.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Since there are very few manufacturers of this type of material, market research in the area of Stabilized Optics Tables is an ongoing effort to identify additional sources of supply. It was determined through market research that only two (2) companies, Central Metal Fabricators, Inc. and Merrill Tool & Machine, are currently capable and approved to manufacture Stabilized Optics Table, P/N: 3429AS8600-2.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The two approved CAI list contractors will submit a formal price proposal with cost and pricing data and sufficient information to support the accuracy and reliability of the estimate. The approved contractors’ proposals will be reviewed by experienced technical analysts, cost analysts and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAVAIR PMD plans to limit competition for future procurements to CAI approved vendors and will continue to survey the market for potential sources.
