JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
1. Contracting Activity.
Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ
2. Description of the Action Being Approved.
This justification and approval authorizes and approves the sole source acquisition of a one-year subscription for web access to specifications; standards that are both military and commercial; and procurement history data and is used for engineering, logistics, and procurement at NAWC-AD Lakehurst. This will be accomplished with a contract with IHS Global, 15 Inverness Way East, Englewood, CO 80112.
3. Description of Supplies/Services.
This contract will include Historical Department of Defense Standardization Service from 1990- present, Haystack Gold GS, Naval Instructions and Directives – Complete, Active Historical Department of Defense Directives, Specifications and Standards-Essential, American Society of Mechanical Engineers Boiler and Pressure Vessel Code (ASME BPVC) Collection, and SAE Technical Reports. IHS’ products are used throughout this Center in support of critical military operations. A loss of these services would seriously injure this Agency’s ability to continuously support ongoing operations causing an impact to the Fleet of interruption in support. The estimated value for this effort is $268,268.15 for a one-year subscription.
4. Statutory Authority Permitting Other Than Full and Open Competition.
10 U.S.C. 2304(c)(2), Unusual and compelling urgency.
5. Rationale Justifying Use of Cited Statutory Authority.
In order to meet NAVAIR Lakehurst mission requirements, the Government requires 24 hour, seven days per week, on-line, immediate access to military and commercial specifications, standards, handbooks, and procurement history data. This information is used both in normal operations and in response to Fleet emergencies. IHS has an exclusive license with Aerospace Industries Association (AIA) / National Aerospace Standards, American Institute of Steel Construction, Electronic Industries Alliance, Telecommunications Industry Association, Association Connecting Electronics Industries, International Society of Automation, Alliance for Telecommunications Industry Solutions, National Board of Boiler and Pressure Vessel Inspectors
Engineering Equipment and Materials Users Association, American Bearings Manufacturers Association, Consumer Electronics Association, Electronic Components, Assemblies and Materials Association, Federal Specification, Joint Aviation Authorities, National Institute of Building Sciences, Parachute Industry Association, Pipe Fabrication Institute, Delphi Automotive Systems, and NAVISTAR. IHS also holds an exclusive license for electronic distribution of American Gear Manufacturers Association, American Petroleum Institute, Building Industry Consulting Service International, European Organization for Civil Aviation Equipment, Insulated Cable Engineers Association, National Electronics Manufacturers Association, and Society of Automotive Engineers (SAE) documents. The ASME BPVC Advantage portal is also exclusive to IHS.
IHS is the only source of supply for this integrated product, which allows the user to cross-reference and access subtier specifications from top-level specifications. There are no alternate sources due to exclusive license agreements between IHS and non-Government standards bodies. IHS is the exclusive electronic/WEB distributor for several standards bodies. For those standards bodies, there is no alternative to the IHS subscription. IHS is the only known company that can provide all of the required resources. As such, access to IHS' document delivery service is essential to NAVAIR Lakehurst's ability to provide timely 24/7 mission critical support to the Fleet. In the 12 months of 1 Jan 2015 to 31 Dec 2015, Lakehurst used over 5,300 AIA and SAE documents (IHS is the exclusive distributor for these associations as noted above). For the period of 1 Jan 2015 through 31 Dec 2015, Lakehurst accessed over 16,700 documents and accessed all the services at IHS over 22,700 times. Accordingly, AIA and SAE documents are critical resources. It is essential that we maintain access to them via their exclusive distributor.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.
Market research was conducted; however, no market capability was found other than IHS Global due to their exclusive distribution licenses. At this time, IHS Global is the only contractor capable of supplying the required services. A Request for Information was posted to the FEDBIZOPS on 30 March 2016. One response was received from a small business; however, they were unable to meet the full requirement.
7. Determination of Fair and Reasonable Cost.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies and services provided under this contract are procured at a fair and reasonable price. The Contractor will submit a formal price proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. IHS Global’s proposal will be reviewed by experienced technical analysts, cost analysts, and contract specialists with the aid of necessary field pricing support. The Contracting Officer will utilize price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Future Competition.
For the reasons set forth in Paragraph 5, NAWC-AD Lakehurst, New Jersey has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NAWC-AD Lakehurst, New Jersey will assess whether competition for future requirements is feasible.
