JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity.

Naval Air Warfare Center Aircraft Division (NAWC-AD) Lakehurst, NJ

2. Description of the Action Being Approved.

This justification and approval authorizes and approves a sole source acquisition with Bemco, Inc. (CAGE Code 98776) for a Firm Fixed Price procurement for the MQ-4C Triton Unmanned Aircraft Systems (UAS) Program to satisfy an unusual and compelling urgent requirement.

3. Description of Supplies/Services.

Two Polyalphaolefin (PAO) Carts, P/N PCL+55/63F-12MATR, are required by the MQ-4C Triton Program for use at the Organization Level of Maintenance. The PAO Cooling Cart (PAOCC) is a self-contained, diesel/electric powered, wheeled-cart mounted, PAO coolant conditioner. They are used to cool the Multi-Function Action Sensor (MFAS) assembly, Wide Band Received Exciter (WBRE) assembly, 270VDC Power Supply assembly, and SATCOM High Powered Amplifier (HPA)/High Powered Voltage Source (HPVS) in the Triton Unmanned Aircraft (UA). The PAOCC will be used in support of aircraft avionics and radar systems during testing and maintenance of these systems.

4. Statutory Authority Permitting Other Than Full and Open Competition.

10 U.S.C. 2304(c)(2), Unusual and compelling urgency.

5. Rationale Justifying Use of Cited Statutory Authority.

Two (2) PAO Carts are needed within 200 days to support MQ-4C flight testing at VX-20, Patuxent River, MD. If the PAO Carts are not delivered within this time frame, the maintainers will not be able to perform required flight testing activities as there would be no means to cool or maintain the avionics bay and radar systems within the aircraft. Delaying the procurement of the above equipment by the required delivery date will cause Government work stoppages which will directly impact support operations and mission readiness.

In order to meet immediate requirements, a Priority 02 designation has been assigned to this acquisition in accordance with the attached Memo from the MQ-4C, Principal Deputy APML dated 20 March 2015.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

Market Research was performed using Google, Dogpile, Bing, and the Small Business Administration’s Dynamic Small Business Database, but no alternate PAO Carts were identified that meet all of the requirements. Furthermore, NAVAIR engineering and logistics personnel on the MQ-4C Triton Support Equipment Team have evaluated the specifications for alternate PAO Carts used on other aircraft platforms (i.e. Global Hawk, F-35, F-22, and E-2) and none of those carts were found to meet Triton performance requirements. In accordance with FAR 5.502(a)(2), a synopsis was not published on the Federal Business Opportunities (FBO) website due to the unusual and compelling urgency.

7. Determination of Fair and Reasonable Cost.

The negotiation and establishment of a fair and reasonable price will be conducted in accordance with FAR 15.4. As stated in FAR 15.402, the Contracting Officer shall purchase all supplies and services at a fair and reasonable price.

8. Actions to Remove Barriers to Future Competition.

This procurement is a one-time buy to satisfy an unusual and compelling urgency requirement. There are no actions that the Government can take at this time to remove barriers to full and open competition. If future requirements arise, the Government will review the marketplace for emerging technology and alternate solutions.
