4. Statutory Authority Permitting Sole Source

41 USC 1901(e)(2) - a sole source acquisition under the authority of the test program for certain commercial items, as implemented by FAR 13.501(a).

5. Rationale Justifying Use of Cited Statutory Authority

The requirement for using other than full and open competition, specifically for sole sourcing the procurement, is due to the sole ownership of the hardware and intellectual property of the contractor. No other manufacturer, other than makes a system capable of recording laser hit placement and provide instant physical vibration and electrical shock feedback while the trainees and role players are wearing sensor body gear. With this technology, the Navy’s Master at Arms personnel will be able to accurately record the results of simulated attacks in real-time. Numerous patent rights cover the training capability of the STRESSVEST system which uses components manufactured by .

STRESSVEST is the only product of its kind that can provide a self-contained system. The STRESSVEST is a non-projectile, force on force, firearm tactical training system capable of creating stress through a pain penalty without fear of projectile injury for training purposes. Based on market research, it has been determined that is the sole manufacturer and distributor of the STRESSVEST that meet these training safety requirements.

These are commercial items; the Government does not own the patent or technical rights. It would not be cost effective to acquire license rights to a commercial item - especially given the unique features that provide the STRESSVEST system with significant market advantage with regard to urban and high-density law enforcement training. Even if the Government had resources available to acquire data rights, this acquisition is needed now to meet current training requirements in anticipation of another active shooter, terrorist attack, or natural disaster.

The STRESSVEST system gives trainees the real-time experience necessary to train effectively for urban/high density law enforcement events. Failure to acquire this particular vest would result in training deficits that would degrade Navy law enforcement's ability to meet threats posed by active shooters, terrorist, or looters.

6. Description of Efforts Made to Solicit offers from as Many Offerors as Practicable.

Market research was conducted in accordance with FAR part 10, specifically, (1) knowledgeable individuals were contacted in Government and industry regarding market capabilities to meet the CNIC ASET requirements, (2) results of recent market research to meet similar requirements from Commander, Naval Installations Command (CNIC) were reviewed, (3) Government data regarding acquisitions made by other agencies for similar requirements were reviewed specifically procurements to support the Active Shooter training requirements by FLETC and Naval District Washington were evaluated to determine if another source to meet the requirements exist, and (4) other sources were sought by searching online and reviewing catalogs and generally available product literature from other manufacturers, distributors and dealers.

The Government conducted market research which included an internet (Google) search for similar compatible competitor products, a review of GSA schedules for availability through GSA, a review of other similar Government purchases of this or similar equipment, and contact with industry. Attached to this contract request package is the Navy CNIC Justification and Approval leading to sole source procurement. Verified as still valid on 1 August 2018 through a search of similar products.

STRESSVEST is the only system on the market that can both accurately record the location and time of the firearms hit and provides instant feedback to the student. In addition to products from the following companies: , , , and gear were reviewed Market research identified that only s STRESSVEST system can provide a self-contained system with the capabilities listed above. For example, the system tracks live fire only and provides feedback regarding tactics and weapons handling. does not provide negative feedback, is not a self-contained system, and does not record the location and time of firearms hits. The on uses marking cartridge projectiles, creating a safety hazard and limiting the locations that can be used for use of force scenarios. Other laser-based systems (such as ) rely on live weapons firing blanks which present safety hazards and limit force on force training areas, and systems that do not record the time and location of firearm hits.

Market research did not reveal any competitor equivalents which could be substituted; no other products exist in the market that provide the performance characteristics described above.

7. Determination of Fair and Reasonable Cost.

The Contracting officer has determined the anticipated cost to the Government of the supplies/services covered by this J&A will be fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

All future requirements will be handled on a case-by-case basis. CNREURAFSWA and NAVSUP have no plans at this time to compete future contacts for the types of supplies/services covered by this document. NAVSUP will continue performing market research and if another potential source emerges, NAVSUP will assess whether competition for future requirements is feasible.

9. Contracting Point of Contact

The point of contact at NAVSUP FLCSI Naples, Italy is Sebastiano Paciello at DSN 626-4057, commercial (0039-081)568-4057 or by e-mail at Sebastiano.Paciello.IT@eu.navy.mil.
