About this file

This is a Justification and Approval (J&A) document from the Naval Undersea Warfare Center Division in Newport requesting approval for other than full and open competition to procure SEACON connector assemblies through a Firm Fixed Price (FFP) contract. The requirement is for specific SEACON brand connectors with no substitutions allowed, including parts like the MINM3FOFCRL04 (400 units), MINMFCRL7230105 (240 units), MINMCIRL7230277 (50 units), and other connector assemblies with quantities ranging from 4-8 units, plus option quantities.

The J&A cites that SEACON connectors are proprietary products available only through Branter & Associates Inc. (doing business as TE Connectivity) and their authorized reseller TTI Inc. The document justifies the sole source procurement under 41 U.S.C. 1901 and FAR 13.501(a)(1)(ii), noting that qualifying a new vendor would require extensive design reviews and first article testing that would result in significant costs and delays. A combined synopsis/solicitation notice was published on SAM.gov inviting capability statements from potential sources, though the document indicates no additional market research was conducted since only SEACON brand products could meet the requirements.

product cannot be offset by potential savings from competition.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A combined synopsis and solicitation notice was published publicly on the Government-wide Point of Entry (GPE), SAM.gov. The notice stated the intention of NUWCDIVNPT to award a contract on a brand name basis, no substitutions, for SEACON parts. The notice also invited all responsible sources to submit a capability statement for the consideration of the Government.

No additional research was conducted because it is not practicable, for the reasons discussed in paragraph 5 above, for any brand other than the SEACON brand to fulfill this requirement. If a responsible source submits a capability statement for consideration by the Government prior to contract award, it will be brought to the attention of the Competition Advocate.

7. Determination of Fair and Reasonable Cost.

The contracting officer will conduct price analysis using FAR 13.106-3 and/or 15.404-1(b) and 15.404- 1(c) methods, in accordance with FAR Part 13, to determine the proposed prices fair and reasonable.

8. Actions to Remove Barriers to Future Competition.

J&A Number: 25019.0
