About this file

This document is a Justification and Approval for use of other than full and open competition under FAR 13.5 for procurement of Downconverters. The Naval Sea Systems Command, Naval Undersea Warfare Center Division requires 18 Downconverter units in support of its In-Service Engineering Activity Electronic Assembly Repair Program. The Downconverters are needed to provide electronic warfare and imaging signals for delivered systems and any delays would postpone delivery of systems beyond need dates. The Downconverters must meet specific requirements and L3 Harris is the original manufacturer. Developing an alternate supplier would require extensive development, testing, and integration work estimated to take over 45 months at significant cost. Therefore, this non-competitive procurement of Downconverters from the sole source OEM L3 Harris is justified to prevent delays and duplication of costs.

JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

UNDER FAR 13.5, SIMPLIFIED PROCEDURES FOR

CERTAIN COMMERCIAL ITEMS

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Undersea Warfare Center Division, Newport, RI (NUWCDIVNPT),.

2. Description of the Action Being Approved

Procurement of the NARDA-MITEQ Downconverter in support of the NUWCDIVNPT

3. - In-Service Engineering Activity (ISEA) - ESM

Electronics Assembly (EEA) Repair Program.

4. Description of Supplies/Services

The NUWCDIVNPT System - ISEA - EEA Repair Program requires the procurement of a quantity of eighteen (18) Downconverter 6 CH P/N: . The EEA is a critical subassembly used within all delivered to the fleet. This subassembly provides Electronic Warfare Support (ES) breakout Radio Frequency (RF) and video signals within the Imaging Photonics Mast. Without proper supply of these EEA Parts, the delivery of Photonics Masts to the Fleet would slip beyond platform need dates.

Estimated Dollar Value

5. Statutory Authority Permitting Other Than Full and Open Competition

The property or services needed by the agency are available from only one responsible source and no other type of property or services will satisfy the needs of the agency.

These Downconverters are required to meet the Specifications detailed in Argon Specification Drawing and the recommended Manufacturer/Vendor has possession of its custodianship. The Government does not possess the custodianship of . and has no intention of obtaining the custodianship of Argon Specification Drawing

6. Rationale Justifying Use of Cited Statutory Authority

The EEA is a critical subassembly used within all delivered to the fleet. This subassembly provides Electronic Warfare Support (ES) breakout RF and video signals within the Imaging Photonics Mast. Without proper supply of these EEA Parts, the delivery of to the Fleet would slip beyond platform need dates. The Government does not possess the custodianship of the Technical Data / Drawings of these Sole Source Parts. The EEA Original Equipment Manufacturer (OEM) has cognizance over these Parts and they have not identified any replacement parts as being acceptable to meet form, fit, and function replacement for Fleet needs. In addition, the EEA OEM is supposed to procure these parts in a timely manner; however, recently, the necessary parts have not delivered. Therefore, the Government has assumed the Procurement Role and is working to acquire these part procurements to ensure that the delivery of can continue on schedule. In conclusion, the acquisition of these sole source specified parts is justifiable and needs to proceed without hesitation.

NARDA-MITEQ is the only Manufacturer/Vendor that can fulfill this type of procurement in a quality, application, cost effective, and timely matter. Otherwise facing substantial duplication of cost to the NAVY which is not expected to be recovered through competition; or unacceptable delays in fulfilling the agency's needs.

7. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

The Government does not possess the custodianship of the Technical Data / Drawings of these EEA items. In addition, the EEA OEM has not identified any replacement part as being acceptable to meet form, fit, and function of these items.

Again, the EEA OEM is supposed to procure these parts in a timely manner; however, recently, the necessary procurement of parts was incomplete. Therefore, the Government has assumed the Procurement Role and is working to acquire these part procurements to ensure that the delivery of Photonics Masts can continue on schedule.

The L3 Harris Down Converter is a critical part of the EEA contained within the and must perform in various outboard at-sea environments, which include: underwater explosion, high/low temperature, vibration, inclination, and electromagnetic interference. L3 Harris is the original equipment manufacturer (OEM) of the Down Converter and S1 Pin Diode switch used in the . The Down Converter was integrated in conjunction with the Pin Diode switch to perform tactical and Built in Test (BIT) functions with the Photonics Mast/EEA design and ancillary system components. The L3 Harris Down Converter and S1 Pin Diode Switch are certified by Boeing- Argon, the EEA OEM, to meet all of the Photonics Mast and EEA specification requirements. The and ancillary system components have been tailored to operate specifically with the L3 Harris Down Converter and S1 Pin Diode switch, ensuring all functional and performance requirements are met.

In order to develop and certify another brand of Downconverter and S1 Pin Diode Switch, the would have to certify a prospective design to ensure all the functional, performance, and environmental requirements of the Photonics Mast are satisfied. The table below identifies the tasks, schedule, and estimated cost that would be required:

Task Cost Schedule Development Effort

N/A

Development of Down Converter to meet space, weight, power, environmental, functional and performance requirements

Development of S1 Pin Diode switch to meet space, weight, power, environmental, functional and performance requirements

Development of software and firmware to meet functional and performance requirements

4 3 months Conduct Product Verification Testing

5 3 months Environmental/shock testing at component level

3 months

System level Government Floating Shock Platform Testing (Barge)

24 Months

EEA integration into Photonics Mast for barge/shock test and lab/at sea validation testing (Mast not useable after shock testing)

6 months

Modification of technical drawing, configuration management processes, and logistics documentation to support material changes

6 months

Laboratory and at-sea regression testing to validate EEA performance

10 45 months Alternate Source Total Cost & Schedule

Based on the above, it is in the Government’s best interest to award this requirement on a Brand Name basis to prevent unacceptable delays and substantial duplication of costs in providing Down Converters.

8. Determination of Fair and Reasonable Costs

NARDA-MITEQ is the only Manufacturer that can fulfill this type of procurement in a quality, application, cost effective, and timely matter. This part was procured by in 2021 and the cost per item was as follows:

Description Part No. Qty Price Each Total Price L3 Harris Miteq Downconverter, 6 Channel

SYS0218M07S 3

9. Actions to Remove Barriers to Competition

The compatibility requirements of this hardware do not allow for substitution of another manufacturer’s products. It is in the Government’s best interest to award this requirement on a Brand

Name basis to prevent unacceptable delays and substantial duplication of costs in providing these Down Converters.
