Project Description: The Contractor shall provide all materials, equipment, labor, and supervision to install a new flooring system at Seneca Lake sonar test f acility Dresden, NY in accordance w ith statement of w ork, draw ings, and specif ications.

The magnitude of the requirement per FAR 36.204, is betw een $100,000 and $250,000

Site visit is schedule for 19 August 2019 @ 10:00, local time. See base requirements located in the supplemental instructions of this solicitation.

STATEMENT OF WORK

New Flooring for Systems Measurement Platform Seneca Lake Sonar Test Facility, Dresden, NY

1.0 Background

The Naval Undersea Warfare Center, Division Newport (NUWCDIVNPT) retained Envoy Environmental Consultants, Inc. to perform a limited asbestos survey and assessment of floor tile and floor tile mastic on the Systems Measurement Platform (SMP) barge. After reviewing the analytical results from samples taken by the New York State (NYS) Certified Inspector, as well as taking into account past sampling results and the overall poor condition of the tiles, Envoy recommended abatement of the tile and mastic by removal or enclosure.

NUWCDIVNPT has decided to move forward with enclosure of the existing flooring, to be performed by a NYS certified abatement contractor.

2.0 Applicable Documents

NUWCDIVNPT Drawing 19-009A (1 Sheet), the associated specifications, and this statement of work, depict the work required on this particular project.

3.0 Requirements/Scope

The Project Contractor (PC) shall be a NYS certified asbestos abatement contractor. The PC shall conform to the NYS asbestos code, EPA and OSHA instructions, and all other applicable municipal, state, and federal laws, regulations, and codes. The PC shall provide all materials, labor, services, and equipment as necessary to perform the work described in the applicable documents. The PC shall coordinate positioning and storing of work related materials at the shore facility and on the barge with NUWCDIVNPT. NUWCDIVNPT will provide ferry transportation of PC personnel and materials each workday morning from the shore to the barge, and each workday afternoon from the barge to the shore. Exact times are TBD. Additional ferry rides may be provided upon special request. The SMP barge shall continue with testing operations for the duration of this project, which will require a two-phase work plan recommended by NUWCDIVNPT, and indicated on the associated drawing. Prior to the PC beginning work in each phase, NUWCDIVNPT will clear the floors of all equipment, obstructions, etc., in the applicable areas, with certain exceptions. The electrical switchgear and the amplifiers (with aluminum ground plates) shall remain in place, with asbestos enclosure performed up to those objects, but not beneath them. Other permanently based or immovable equipment may be identified prior to starting each phase. After an area has been cleared, NUWCDIVNPT will sweep and mop the floors in preparation for the PC to begin their work. Each phase shall be completed three weeks or less, with a total project duration of no more than six weeks. The PC’s work shall include the following;

1. Ensure air-sampling requirements are met per current OSHA regulations.

2. Isolate the work area, remove loose tiles or tile pieces from the floor, and clean (hepa vacuum and wet wipe) the existing flooring to be enclosed.

3. Apply a floor leveler approved by NUWCDIVNPT, in order to achieve a smooth floor base where required.

4. Provide and install approximately 5,040 square-feet of interior/exterior grade, fire-retardant treated, 1/4" thick plywood throughout the interior flooring of the SMP barge, as indicated on the drawing, to include six round and two rectangular removable floor hatches. New flooring will be required up to wall beams (similar to current floor), cutting new flooring around wall beams is not necessary.

5. Provide and install approximately 4,340 square-feet of wear resistant deck tile (MIL-PRF 32170A, type 1, class 1), per manufacturer's recommendations, in the SMP barge rooms indicated on the drawing, to include the removable floor hatches. Tile color is TBD by NUWCDIVNPT.

6. Provide and install approximately 700 square-feet of sheet floor covering for high voltage application (MIL-DTL 15562G, type 1), per manufacturer's recommendations, in the SMP barge rooms indicated on the drawing. Matting color is TBD by NUWCDIVNPT.

7. Provide and install bright aluminum or stainless steel folding recessed handles on the removable floor hatches (two per hatch), and bright aluminum or stainless steel trim on the hatches and floor openings.

8. Clean (hepa vacuum and wet wipe) the new flooring.

4.0 Other Requirements

Tools and materials shall only be left in areas of the SMP barge that are part of the work area in progress, or other areas approved by NUWCDIVNPT. Tools and materials shall not be left in the paths of travel from/to the exit/entry doors and ladders.

(a) Definitions. As used in this clause—

“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.

“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).

“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.

“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232- 7003, Electronic Submission of Payment Requests and Receiving Reports.

(c) WAWF access. To access WAWF, the Contractor shall—

(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

(2) Be registered to use WAWF at https://wawf.eb.mil/ following the step-by-step procedures for self-registration available at this web site.

(d) WAWF training. The Contractor should follow the training instructions of the WAWF Web-Based Training Course and use the Practice Training Site before submitting payment requests through WAWF. Both can be accessed by selecting the “Web Based Training” link on the WAWF home page at https://wawf.eb.mil/.

(e) WAWF methods of document submission. Document submissions may be via web entry, Electronic Data Interchange, or File Transfer Protocol.

(f) WAWF payment instructions. The Contractor shall use the following information when submitting payment requests and receiving reports in WAWF for this contract or task or delivery order:

UW H-2-0004 CONTRACTOR REQUIREMENTS FOR PERFORMANCE ON A GOVERNMENT SITE

(a) Control of Contractor Personnel

The contractor shall comply with the requirements of NUWCDIVNPTINST 5500.4C regarding performance at Government facilities. All persons engaged in work while on Government property shall be subject to search of their persons and vehicles at any time by the Government, and shall report any known or suspected security violations to the Security Department of the contracting activity. Assignment, transfer, and reassignment of contractor personnel shall be at the discretion of the contractor. However, the contractor shall remove from contract performance any person who endangers life, property, or national security through improper conduct. Such removal shall not relieve the contractor from meeting its contractual obligations and shall not be considered an excusable delay as defined in

FAR 52.249-14.

(b) Contract Personnel Administration

The contractor is responsible for managing its employees and guarding against any actions that are of the nature of personal services or give the perception that personal services are being provided. If the contractor feels that any actions constitute, or are perceived to constitute personal services, it is the contractor's responsibility to notify the PCO immediately in accordance with the clause FAR 52.243-7. When on-site in Government office spaces, laboratories, test facilities, or ship assets, Contractor employees shall be clearly identified as a Contractor (e.g.

utilizing Common Access Cards (CACs) and sign identifications in office spaces). In addition, Contractor employees shall identify themselves as Contractor personnel when answering telephones and sending emails.

Contractor personnel cannot lead/manage/supervise Government personnel. Contractor program /project managers/Senior Technical Representative (STR) shall be clearly identified and known as such by Government employees. As circumstances permit, periodic meetings shall be conducted between the COR and the Contractor organization program manager/project manager.

(c) Early Dismissal and Closure of Government Facilities

When a Government facility is closed or Federal employees are dismissed early (due to severe weather, security threat, security exercise, or a facility related problem) that prevents personnel from working, onsite contractor personnel regularly assigned to work at that facility shall follow the same reporting and/or departure directions given to Government personnel. The contractor shall not direct charge to the contract for such time off, but shall follow parent company policies regarding taking leave (administrative or other). Non-essential contractor personnel, who are not required to remain at or report to the facility, shall follow their parent company policy regarding whether they should go/stay home or report to another company facility. Subsequent to an early dismissal and during periods of inclement weather, onsite contractors should monitor radio and television announcements before departing for work to determine if the facility is closed or operating on a delayed arrival basis.

(d) When Federal employees are excused from work due to a holiday or a special event (that is unrelated to severe weather, a security threat, or a facility related problem), on site contractors shall continue working established work hours or take leave in accordance with parent company policy. Those contractor employees who take leave shall not direct charge the non-working hours to the contract. Contractors are responsible for predetermining and disclosing their charging practices for early dismissal, delayed openings, or closings in accordance with the FAR, applicable cost accounting standards, and company policy. Contractors shall follow their disclosed charging practices during the contract period of performance, and shall not follow any verbal directions to the contrary. The Contracting Officer will make the determination of cost allowability for time lost due to facility closure in accordance with FAR, applicable Cost Accounting Standards, and the Contractor's established accounting policy.

(e) Training Requirements

(1) The contractor shall ensure that each contractor employee performing work at any NUWC Division Newport site take the following actions:

(A) Complete all required trainings as indicated on the following website:

(B) Read the documents titled “Occupational Safety and Health Information for Contractors” and “NUWC Division Newport Environmental Policy”, available at the following website, prior to performing any work:

(f) Safety Requirements

(1) Prior to commencing any work that falls under the following areas, the contractor shall provide a complete listing of all qualified and trained employees who will perform the work on company letterhead to the Contracting Officer’s Representative (COR), or, if no COR is assigned, to the NUWC Division Newport Safety Office:

(A) Permit required Confined Space Program

(B) Control of Hazardous Energy (Lock out / Tag out)

(C) Respiratory Protection

(D) Walking-Working Surfaces, Fall Protection Program and Scaffolding

(2) The contractor shall follow the posted provisions of the building’s Emergency Action Plan (EAP) for any mishap, incident, or emergency situation.

(3) The contractor shall report unsafe work conditions, safety hazards, and any mishaps (injury/property damage) to their supervisor, the COR, and the NUWC Division Newport Safety Office.

52.204-7 SYSTEM FOR AWARD MANAGEMENT (OCT 2018)

(a) Definitions. As used in this provision--

Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.

Registered in the System for Award Management (SAM) means that--

(1) The Offeror has entered all mandatory information, including the unique entity identifier and the EFT indicator, if applicable, the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14) into SAM;

(2) The offeror has completed the Core, Assertions, and Representations and Certifications, and Points of Contact sections of the registration in SAM;

(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The offeror will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and

(4) The Government has marked the record ``Active''.

Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity. See www.sam.gov for the designated entity for establishing unique entity identifiers.

(b)(1) An Offeror is required to be registered in SAM when submitting an offer or quotation, and shall continue to be registered until time of award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address exactly as stated in the offer. The Offeror also shall enter its EFT indicator, if applicable. The unique entity identifier will be used by the Contracting Officer to verify that the Offeror is registered in SAM.

(c) If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for establishment of the unique entity identifier directly to obtain one. The Offeror should be prepared to provide the following information:

(1) Company legal business name.

(2) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(3) Company physical street address, city, state, and Zip Code.

(4) Company mailing address, city, state and Zip Code (if separate from physical).

(5) Company telephone number.

(6) Date the company was started.

(7) Number of employees at your location.

(8) Chief executive officer/key manager.

(9) Line of business (industry).

(10) Company headquarters name and address (reporting relationship within your entity).

(d) Processing time should be taken into consideration when registering. Offerors who are not registered in SAM should consider applying for registration immediately upon receipt of this solicitation. See https://www.sam.gov for information on registration.

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to (a) commence work under this contract within 15 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than 120* The time stated for completion shall include final cleanup of the premises.

*The Contracting Officer shall specify either a number of days after the date the contractor receives the notice to proceed, or a calendar date.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $200 for each calendar day of delay until the work is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.

(d) Inspection/Acceptance. The Contractor shall tender for acceptance only those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. The Government must exercise its postacceptance rights--

(1) Within a reasonable period of time after the defect was discovered or should have been discovered; and

(2) Before any substantial change occurs in the condition of the item, unless the change is due to the defect in the item.

(e) Excusable delays. The Contractor shall be liable for default unless nonperformance is caused by an occurrence beyond the reasonable control of the Contractor and without its fault or negligence, such as acts of God or the public enemy, acts of the Government in either its sovereign or contractual capacity, fires, floods, epidemics, quarantine restrictions, strikes, unusually severe weather, and delays of common carriers. The Contractor shall notify the Contracting Officer in writing as soon as it is reasonably possible after the commencement of any excusable delay, setting forth the full particulars in connection therewith, shall remedy such occurrence with all reasonable dispatch, and shall promptly give written notice to the Contracting Officer of the cessation of such occurrence.

(f) Termination for the Government's convenience. The Government reserves the right to terminate this contract, or any part hereof, for its sole convenience. In the event of such termination, the Contractor shall immediately stop all work hereunder and shall immediately cause any and all of its suppliers and subcontractors to cease work.
