SOLE SOURCE JUSTIFICATION / BRAND NAME SPECIFICATION

TECHNICAL INSPECTIONS AND EVALUATION

BACKGROUND:

Code 34 of the Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT) is designated by PEO C4I PMW 770 as the Technical Direction Agent (TDA) for the SubHDR System as well as the functioning National Maintenance Center for the SubHDR Mast Group. In fulfilling these roles, NUWCDIVNPT has a requirement for the Test, Inspection, and Evaluation (TI&E) of the parts that are supplied by Raytheon.

REQUIREMENT:

TI&E on the Raytheon Assembly Parts:

• Seven (7) High Volt Power Supply - P/N G772262-1

• Ten (10) Inverter Assemblies - P/N G772272-1/2

• Nine (9) Electronic Modules - P/N G608309-1/3

Sole Source Justification/Brand Name Specification:

Raytheon specified parts are a proprietary item of Raytheon and the Navy did not purchase the complete design or drawing rights for the individual component parts on the original production contract. Only Raytheon can perform the TI&E on the parts as they are the original manufacturer of the parts. A second source would have to develop their own form fit function replacement parts which would result in additional costs and unacceptable schedule impacts to the Government. According to FAR Clause 6.302-1(a)(2)(ii), unacceptable delays in fulfilling the agency's requirements and substantial duplication of cost to the Government that is not expected to be recovered through competition are applicable for this requirement.

Based on the above, Raytheon is the only company who can perform the required TI&E, repairs, upgrades, and supply of new parts within the Government’s cost, schedule and performance requirements. The use of any other company would not be cost effective nor would critical schedules be met. Thus the development of a second source at this time is not in the best interests of the Government.
