4. Authority In accordance with FAR 13.501(a)(1)(ii), this brand name procurement is conducted under the authority of the test program for commercial items at 41 U.S.C. 1901.

5. Supporting Rationale

Minimum specifications are determined by the Department of Defense and Naval Network Warfare Command (NETWARCOM) policies enforcing Information Assurance (IA) compliance with Secure Socket Layer (SSL) and Common Access Card (CAC) logon. AERVA media players went through the Navy Marine Corps Intranet (NMCI) system transition process where they were scanned and found to be NMCI compliant. AERVA AerWave (software) has a Department of Navy Application and Database Management System (DADMS) ID of 55260. NETWARCOM issued a new ATO for the AERVA NERDS solution on October 30, 2014 which is valid through October 30, 2017.

After 9 years of research and testing, and 5 years of operating under approved ATOs, it is determined that AERVA Inc. is the only vender that provides the required software and maintenance renewal licenses for the approved NERDS solution.

6. Best Value Determination

The contracting officer will determine the order placed pursuant to this Justification for Other Than Full and Open Competition represents the Best Value to the Government. The contracting officer will make a determination of fair and reasonable pricing for this individual order in accordance with the evaluation procedures in FAR 12.602.

7. Market Research

Market research was conducted among GSA schedule holders and open market vendors. The required services are only available through the manufacturer, Aerva Inc.

8. Other Supporting Facts

The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT), Code 1041 received an Authority to Operate (ATO) for the Newport Real-time Digital Signage (NERDS) solution at NUWCDIVNPT on September 20, 2011. The ATO was granted utilizing the AERVA hardware and software products as they were the only company to meet the requirements. Upon receipt of the ATO, NUWCDIVNPT awarded N66604-11-C-3805 to AERVA Inc. for 34 media players, software, installation, and setup of AerWave server software. The NERDS solution is now utilized by all the Warfare centers connecting through the NUWCDIVNPT server.

9. Actions to Remove Barriers to Competition

The compatibility requirements of this Information Technology (IT) procurement do not allow for substitution of another manufacturer’s services for the items listed as sole make and model items in section 3, above.
