JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
UNDER FAR 13.5, SIMPLIFIED PROCEDURES FOR
CERTAIN COMMERCIAL ITEMS
JUSTIFICATION
The following facts support contracting for commercial items without full and open competition, using the procedures in FAR 13.5-Simplified Procedures for Certain Commercial Items, in accordance with 41 U.S.C. 1901.
1. Contracting Activity
The Naval Sea Systems Command, Naval Undersea Warfare Center Division, Code 02, Newport, RI.
2. Description of the Action Being Approved
Request approval to solicit a procurement using other than full and open competition, for either Network Allies (formerly Adtech Global Solutions) or Germane Systems brand, Symmetric Multiprocessors. In accordance with FAR 13.106-1, the Government has determined the required Network Allies or Germane Systems brand Symmetric Multiprocessors are commercially available through Network Allies, Germane Systems, and authorized reseller Pioneer Industries.

4. Statutory Authority Permitting Other Than Full and Open Competition
41 U.S.C. 1901; Simplified Acquisition Procedures.
5. Rationale Justifying Use of Cited Statutory Authority
The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT), provides synchronized troubleshooting support, , for active AN/SQQ-89 Combat Systems on all U.S. Navy cruisers and destroyers.

maintains system configurations within the that are identical to those in the fleet in order to replicate and troubleshoot shipboard problems, provide distance support, perform software test, evaluation, certification, maintain Software Configuration Management, and provide system training.
All AN/SQQ-89 combat systems in the require parts that are authorized for use as listed in the Naval Sea Systems Command Design Control Documents in order to reproduce a shipboard environment to ensure consistency of test and troubleshooting results by accurately reproducing exact AN/SQQ-89 Combat Systems issues. The Naval Sea Systems Command Design Control Documents 8520472, 8520473, 8520474, and 8524075 are the drawings that provide an engineering description and acceptance criteria for the Symmetric Multiprocessors used in the AN/SQQ-89A(V)15 with Engineering Change (EC) 219. These documents include a list of approved suppliers, the supplier's item identification, and sufficient engineering definition for acceptance of items that are used in the system. The Integrated Warfare Systems program office, IWS-5B is responsible for the approval of these documents and all Configuration Management of the AN/SQQ-89 Undersea Warfare Combat System, and that defined Configuration
Management processes are followed to approve and track any changes made to the system's baseline. The requirement for the SSUSW laboratory to recreate the exact formatting, functional, and physical characteristics of the Fleet deployed AN/SQQ-89 Combat Systems is critical to the NUWCDIVNPT mission and ultimately Fleet operations.
The inability to recreate the exact characteristics of the AN/SQQ-89 Combat System in the could result in NUWCDIVNPT’s inability to provide timely resolution of Fleet issues. This includes the inability to investigate Software Trouble Reports (STR), thermal issues, and timing issues.
The Government has identified two manufactures that satisfy the requirements for the symmetric multiprocessors per the above referenced design control documents, Network Allies and Germane Systems. Other than Network Allies and Germane Systems, no other company’s Symmetric Multiprocessors meet the design control requirements for use in the AN/SQQ-89 system baseline.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
For the reasons set forth in section 5, the Naval Undersea Warfare Center Division, Code 02, Newport, RI, will purchase the supplies through Network Allies, Germane Systems, or Pioneer Industries. Network Allies does not have any authorized resellers, while Germane Systems only authorizes Pioneer Industries to resell its products. The proposed contract action will be advertised via a combined synopsis/solicitation posted to the Federal Business Opportunities (FedBizOps) website in an effort to solicit quotes from as many vendors as possible.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine the cost pursuant to this justification is fair and reasonable based on a comparison of the competitive pricing from the potential vendors in accordance with FAR 15.404-1(b)(2)(i).
8. Actions to Remove Barriers to Competition
The Governments requirement for Network Allies or Germane Systems brand Symmetric Multiprocessors does not allow for substitution of another manufacturer’s products for the items listed in Section 3, above. Therefore, in the event of any future acquisitions of these components from manufacturers that satisfy design control requirements, the procurement will again be competed to the maximum extent practicable amongst Network Allies, Germane Systems, and their authorized resellers.
However, at the time of preparation of any future requirements packages the information contained in section 5 will be validated to confirm a requirement to procure hardware components from these manufacturers still exists. Consideration will be given to moving this requirement to full and open competition if feasible in the future.
