LIMITED SOURCE JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Undersea Warfare Center Division Newport (NUWCDIVNPT), Contracts Department, Code 0221, Newport, RI.

2. Nature and/or Description of Action Being Approved

The Naval Undersea Warfare Center Division, Newport (NUWCDIVNPT), Code 2514, Ordnance Document (OD) 44979 Firing Craft Operating Procedures and Checklists development team, is requesting approval to place a new purchase order for specific brand name products (no substitutions allowed). This requirement includes ruggedized Panasonic model FZ-G1 tablet computers and associated peripheral components required for this initiative. Panasonic has deployed a new, ruggedized model replacing the now obsolete H2 tablets with an improved FZ-G1 model. Procurement of this new model maintains previously established Fleet requirements and is necessitated for continuity of the Interactive Electronic Tablet (IEP) version 1.0. It also preserves the Information Assurance Platform Information Technology (PIT) Risk Acceptance currently in progress. All other make and model tablets from manufacturers other than Panasonic do not meet performance requirements or Information Assurance requirements rendering this make and model tablet the only acceptable platform for the IEP initiative.

These tablets serve as a significant step in the process towards a paperless Navy and will streamline development of Ordnance Document (OD) 44979 Firing Craft Operating Procedures and Checklists. The IEP initiative is directed by Program Executive Office (PEO) Submarines and is designed to replace paper-based operating procedures with electronic versions, reducing overall cost of the OD44979 Firing Craft Operating Procedures and Checklists.

Based on market research conducted by the Technical Code and Contract Negotiator, the required ruggedized Panasonic model FZ-G1 tablet computers and associated peripheral components are available through a number of GSA vendors including the Betis Group (GS-35F-0195J) and Knowledge Information Solutions, Inc. (GS-35F-0143R).

4. Authority

In accordance with FAR 8.405-6(b)(1), this procurement is conducted under the authority of the Multiple-Award Schedule (MAS) program, Title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 251, et seq.), and Title 40 U.S.C. 501, Services for Executive Agencies.

Per FAR 8.405-6, “[o]rders placed or BPAs established under Federal Supply Schedules are exempt from the requirements on Part 6.” However, FAR 8.405-6 further states “an ordering activity must justify its action when restricting consideration in accordance with paragraphs (a) or

(b) of this section.” As such, per FAR 8.405-6(b)(1), a brand name specification procurement is justified here because “the particular brand name, product, or feature is essential to the Government’s requirements, and market research indicates other companies similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs.”

5. Supporting Rationale

In accordance with FAR 8.405-6(b)(1), a brand name specification procurement is justified here because the Panasonic items and associated peripheral components listed above in Section (3) ensures NUWCDIVNPT Code 2514 maintains a homogenous environment for the Ordnance Document (OD) 44979 development team to fulfill development, publication, distribution and maintenance of Firing Craft Operating Procedures and Checklists for all U.S. submarines.

NAVSEA Program Offices PMS450 and PMS425 have tasked NUWCDIVNPT 2514 to develop electronic versions of the OD library and procure associated computer hardware for shipfit of all VIRGINIA-class submarines and those SSN688/688I-Class submarines receiving combat control system upgrades to AN/BYG-1 TI-13/APB14. It is important that new assets are compatible with the infrastructure already in place to ensure seamless conversion and interoperability between OD44979, Firing Craft Operating Procedures and Checklists.

Panasonic Toughbook H2 tablets were chosen by Fleet operators after an exhaustive review of capabilities, limitations, usability, and ruggedness for operating in an industrial at-sea environment as well as in-port periods of inclement weather during weapon shipping and unshipping evolutions.

Panasonic has deployed a new, ruggedized model replacing the now obsolete H2 tablets with an improved FZ-G1 model. Procurement of the new model maintains previously established Fleet requirements and is necessitated for continuity of Interactive Electronic Tablet (IEP) version 1.0 between models. It also preserves the Information Assurance Platform Information Technology (PIT) Risk Assessment currently in progress.

The PMS425 and PMS450 Program Offices, based on recommendations, developmental testing, Information Assurance progress and standard configuration, approved the FZ-G1P5-05VM Tough Pads as the authorized tablet to be utilized for the electronic conversion of OD44979, Firing Craft Operating Procedures and Checklists.

IEP is a full rate production (ACAT III) program, an IT-21 initiative that uses commercial off-the-shelf (COTS) hardware that directly supports the paperless Navy initiative across multiple classes of submarines. A lack of these assets would have a negative impact on the submarine fleet’s desire to advance the transition from paper-based product to an electronic version of weapons loading, handling, and employment procedures.

6. Best Value Determination

The Contracting Officer will determine the price to the Government for the supplies covered by this Limited Source Justification fair and reasonable, and representative of the best value to the Government based on a comparison to the multiple GSA schedule holder’s GSA pricing and a comparison to historical pricing paid for Panasonic H2 tablets (now obsolete model) previously purchased. Additionally, these items are available via GSA Advantage, which, by virtue of placing an order with a schedule holder, the Government obtains the best value (considering price, special features, and administrative costs) consistent with FAR 8.404(d).

7. Market Research

The Government conducted Market Research and determined the Panasonic Tough Pads are sold exclusively via Panasonic’s resellers. The Government also confirmed there are Multiple-Award Schedule (MAS) holders on GSA Advantage (www.gsaadvantage.gov) authorized to sell these items.

9. Actions to Remove Barriers to Competition

a. The compatibility requirements of the Panasonic FZ-G1 model tablet do not allow for substitution of another manufacturer’s products for the Panasonic items listed above in Section (3). Therefore, in the event that any future acquisition of these brand name supplies is required, the procurement will again be competed to the maximum extent practicable amongst Panasonic’s resellers.

b. For the brand name or equal/equivalent items identified above in Section (3), there are a number of different manufacturers whose components may meet the Government’s requirement. As a result, for both the current and any future acquisitions of this item, the procurement will be competed to the maximum extent possible.
