4. Statutory Authority Permitting Other Than Full and Open
Competition
10 U.S.C. 2304(c) (1): Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.
5. Rationale Justifying Use of Cited Statutory Authority
The Shipboard Electronic Systems Evaluation Facilities (SESEFs) are land based test sites, established to facilitate testing and certification of ships' electromagnetic transmitting and receiving equipment. SESEFs are used to detect and isolate shipboard system deficiencies leading to increased ship material readiness at the completion of construction, delivery availabilities, during routine ship operations, and prior to deployment. The SESEF sites perform in excess of 600 tests per year in maintaining compliance with US Navy Preventative Maintenance System (PMS) requirements, and provide the surface Fleet with troubleshooting assistance.
The Naval Undersea Warfare Center, Division Newport (NUWCDIVNPT), Code 70 is tasked with supporting eight Shipboard Electronics Systems Evaluation Facilities (SESEF) sites. The eight SESEF sites include: Norfolk, VA; Mayport, FL; San Diego, CA; Ediz Hook, WA; Barbers Point, HI; Guam; Yokosuka, Japan, and Rota, Spain.
If a contract is awarded to a new equipment manufacturer, the process of modifying the ERDFTS test set will incur an approximately 10 month delay to operations. The recertification would include preparation of a revised DD Form 1494, the Application for Equipment Frequency Allocation, and MCEB review and processing of this application; this effort is estimated to take 7 months (best case). The customer would then begin the Configuration Control Board (CCB) process, to include drafting and submittal of the Infrastructure Change Request (ICR). Upon delivery, the equipment would undergo two (2) tests. These two
(2) tests: (1)bench testing and regression testing, would incur a 1 month delay after receipt of equipment. One (1) week after the tests are complete, the results would be documented in Standard Operating Procedures, drawings, and other applicable documents and the Test Readiness Review (TRR) phase begins.
During this phase, the revised test plan is drafted, and a System Verification Document (SVD) will be created, taking approximately 1 month; 2) the last step in this process is the test and integration of the new equipment. This is followed by a Systems Operational Verification Test (SOVT) where live testing with Fleet assets will be scheduled and performed by two
(2) people over two (2) weeks. The overall cost to modify the ERDFTS with a new log periodic antenna manufacturer is estimated at .
The Military Communications Electronics Board (MCEB) is the governing body for testing and certifying military systems that transmit electromagnetic emissions. The MCEB uses Form JF12 to authorize a particular system configuration for operation. The MCEB’s , dated 4 April 2013 provides approval for operation of the ERDFTS and includes a list of approved key components used to generate electromagnetic emissions within the system. The configuration cited in must be met at all SESEF sites at all times to support testing of critical EW systems for the fleet. The only log periodic antenna model approved for the ERDFTS system is the US Antenna Products model described above in the Option Year Table above. The MCEB JF12 certification allows SESEF to apply to the Navy Marine Corps Spectrum Office (NMCSO) for permission to radiate (i.e., transmit radio frequency signals). NMCSO allocates frequency assignments based on the MCEB’s approved JF12. A change in components results in a change to the approved configuration.
Such a change would result in loss of MCEB authorization and, in turn, revocation of NMCSO frequency allocation. This would result in the Navy's inability to operate the SESEF.
If another configuration of log periodic antennas is obtained, the SESEF facility will have to undergo, at a minimum, a 10 month recertification process, to include a JF12 resubmittal, bench testing, validation, verification and accreditation (VV&A), regression testing, and testing with live assets.
All eight SESEF sites need to operate using identical systems in order to ensure consistency of test results. Therefore, if a new item were incorporated into one site, this would require replacement of all existing systems with the new configuration.
The government estimates this would cost based on the log periodic antennas under this requirement needing to be replaced at eight sites concurrently rather than one or two at a time due to routine maintenance. The duplicative costs are incurred for recertification, re-issuance of JF12 approval and frequency assignment.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
For the reasons set forth in paragraph 5, the Naval Undersea Warfare Center Division Newport can only procure the required hardware from US Antenna Products. US Antenna Products does not have any authorized distributors. The proposed sole source contract action will be synopsized via posting on the Federal Business Opportunities (FedBizOpps) website in accordance with
FAR 5.2.
7. Determination of Fair and Reasonable Costs
The contracting officer will determine the order placed pursuant to this Justification is fair and reasonable based on a price analysis in accordance with FAR 15.404-1(a)(2) and/or a cost analysis in accordance with FAR 15.404-1(a)(4), if required.
8. Actions to Remove Barriers to Competition
The Government’s requirement for United States Antenna Products log periodic antennas, in support of the ERDFTS, does not allow for substitution of another manufacturer’s antenna. To meet the needs of the Navy in supporting and performing the required testing of critical EW systems for the Fleet, the SESEF sites must maintain the current configuration of the ERDFTS, currently employing United States Antenna Products log periodic antennas.
United States Antenna Products is the only source of the log periodic antennas used in conjunction with the MCEB Certification. Until such time as the MCEB regulations are in some way modified, the limitations placed on SESEF by the MCEB certification restricts the Government from seeking other sources. Therefore, in the event that any future acquisition of United States Antenna Products log periodic antennas are required, and the information in section 5 above remains true, the procurement will again be processed on a sole source basis.
However, at the time of preparation of any future requirements packages the information contained in section 5 will be validated to confirm the sole source requirement still exists.
Consideration will be given to moving this requirement to full and open competition in the future if feasible.
