JUSTIFICATION

For Sole Source Acquisition of Commercial Items Pursuant to FAR 13.5

I. In accordance with FAR 13.501(a), the following facts support contracting for commercial items without full and open competition.

A. Agency and Contracting Activity:

Requiring Activity: Naval Undersea Warfare Center Division, Newport

Code 8524 Newport, RI 02841

Contracting Activity: Naval Undersea Warfare Center Division, Newport Commercial Acquisition Department, Code 5912 Newport, RI 02841

B. Description of action being requested:

Sole make and model commercial procurement for Alacron, Inc. Fast Vault Mots PMC (PCI [Personnel Component Interconnect] Mezzanine Card) Compact Flash Cards.

C. Description of required supplies or services (and estimated value):

The contractor shall provide 150 each Alacron P/N 80071-10002 Fast Vault Mots PMC Compact Flash Cards. The estimated value is $212,250.

Estimated Dollar Value

FY14

SPDP $212,250

D. Statutory authority permitting other than full and open competition:

The test program for commercial items (section 4202 of the Clinger-Cohen Act of 1996) as implemented by FAR 13.501(a).

E. Description of the proposed contractor's unique qualifications or description of the nature of the acquisition which requires use of other than full and open competition:

Code 85 has a requirement to provide 150 PMC Compact Flash Cards to maintain US torpedoes for the APBS (Advanced Processor Builds) program to support multiple in-water runs. The current supply is not sufficient to meet needs. Alacron’s Compact Flash Card is the only known card available which meets the requirements for current and future compatibility with both the GE Fanuc G4DSP-XD3 and Curtis Wright Champ AV5 VME boards, which are the current and future production boards within the HWT Torpedo.

The current card in use, General Electric’s PMCF2-431 card, is obsolete and no longer available.

To the best of our knowledge Alacron’s Flash Card is the only device that meets all of the critical item performance requirements and is fully compatible with the GE Fanuc G4DSP- XD3 and Curtis Wright Champ AV5 VME host board families and is compatible with all of our past, current and future Torpedo software builds.

Utilizing any other PMC board will incur an extensive software development effort similar to our original Non-Recurring Engineering (NRE) effort to integrate the original PMC recording system.

Additional funding to support an NRE of this magnitude is not currently available.

F. Efforts made to solicit from other sources:

In accordance with FAR 5.2, NUWCDIVNPT Code 59 posted a Sources Sought notice in FedBizOpps on 29 April 2014 to determine if there was any other potential manufacturer of a card which could meet our minimum requirements.

G. Contracting Officer's determination that the anticipated cost will be fair and reasonable:

Pursuant to FAR 13.106-3, a price analysis will be performed to ensure that a fair and reasonable price is obtained.

H. Discussion of Market Survey:

Attempts by Code 85 to find equivalent PMC’s have been unsuccessful. GE’s new version of the PMCF2-431 is the PMCF3-431. This board was tested and found to be incompatible with existing weapon software. Elma Electronic’s-ACT/Technico PMCStor 9246-0GB-C board was procured and tested and was also found to be incompatible with existing weapon software. Those were the only two visible manufacturers the Code 85 could find which produced a card that performed a similar function to the Alacron card.

On 29 April 2014 the Contracting Officer issued a sources sought notice on FedBizOpps to locate firms who could meet our minimum requirements. As of the 08 May 2014 deadline no responses were received. To the best of our knowledge, there is no other card on the market which can perform a similar function to the Alacron card. Therefore, a sole make and model procurement will be issued.

I. Additional information supporting the use of other than full and open competition:

None.

J. List of sources that expressed (in writing) an interest in the acquisition:

This requirement will be synopsized in FEDBIZOPPS.

K. Actions taken to ensure subsequent competition for supplies or services:

No future procurement for these PMC Compact Flash Cards is anticipated.

III. APPROVAL SIGNATURES:

A. CONTRACTING OFFICER CERTIFICATION REQUIRED BY FAR 13.501(a)(2)(ii) I certify that this justification is accurate and complete to the best of my knowledge and belief.
