JUSTIFICATION FOR NON-COMPETITIVE PROCUREMENT
JUSTIFICATION FOR NON-COMPETITIVE PROCUREMENT (JNCP)
FOR ACTIONS BELOW THE SIMPLIFIED ACQUISTION THRESHOLD ($150,000)
PR/Solicitation Number: 1300686438
Agency, Contracting Activity and Purpose: SPAWAR Systems Center, Pacific, Code 22220, Justification for Other than Full and Open Competition.
Description of the Supply or Service being procured, its intended use and anticipated/estimated value (Answer the Following Questions):
Describe the product or service you want purchased (provide make, model, and product serial number/part number—include a spreadsheet if necessary)
Purchase of Syrlinks X-Band radio per the following items:
P/N: EWC27-FM, X-Band Transmitter Flight Model
P/N: SERV-C27-TR-FM, Services – Delivery of Final Test Reports
P/N: OPTC27-FDS, DSN Filter
What is its intended use or purpose?
The Syrlinks X-Band Transmitter is a high data rate radio transmitter used on small satellites to communicate vital information. This technology is relatively new to small satellites and the acquisition of this product will allow us to use the radio in a lab to test and evaluate its performance. This is a first-time purchase of this equipment. This equipment is being procured as part of the Foreign Comparative Testing program as authorized by 10 USC 2530(a)(g).
Possible Authority for Non-Competitive Procurement (If you check block 3a. below, complete associated table marked 3(a). If you check block 3(b) below, complete associated table marked 3(b):
Sole/Limited Source Procurement (Only One Responsible/Capable Source) Is there only one responsible/capable source that can provide the supply or service? Non-competitive procedures can typically only be used when there is one source able to meet the Government’s minimum requirements (i.e., the manufacturer is the sole distributor/reseller of the product or service). If only one source can meet the Government’s requirements, complete table 3(a) below and provide a complete and thorough discussion of how you are aware that only one source exists in paragraph 4 below.
Brand Name Requirement (Item Peculiar to One Manufacturer) Is the requirement peculiar to a single brand name or one manufacturer? Competition can be limited to companies that are capable of providing the specific brand name, product or feature required when it is essential to purchase a specific brand because it is the ONLY brand that has the ability to meet the Government’s minimum requirements (i.e., while there is one manufacturer, multiple distributors/resellers exist for the product or service). If so complete Table 3(b) below.
TABLES – Complete the Table which corresponds to the answer you provided above.
TABLE 3(a) – ONLY ONE RESPONSIBLE/CAPABLE SOURCE (Item or Service can ONLY be procured from One Source/Company/Contractor and NO other source.)
List the critical characteristics or capabilities necessary to meet the “Government’s Minimum Requirements” What makes these critical characteristics/ specifications/ capabilities unique to this product/service and vendor?
Why is each identified critical characteristic required?
State any alternatives available or considered” as a means of fulfilling this requirement and why they aren’t viable; and what would be the impact if a product was purchased from another vendor or without each characteristic listed.
The X-Band radio must fit in a small satellite form factor, preferably within a 10cm cube area.
This X-Band radio measures less than 9.6 cm cubed which fits perfectly in a 1 unit section of a nanosatellite.
The standard size for each unit of a small satellite is 10 cm cubed. The satellite must fit in a deployer which does not allow for components to protrude out any of the sides of the satellite.
The radio must support frequencies above S- Band. The X-band radio allows for higher data rates important for mission success in small satellites.
The X-band radio allows for higher data rates important for mission success in small satellites.
There may be a large amount of data stored on a satellite with a small amount of time to communicate with ground stations. The data rate must be X-Band in order to transfer enough data in the time available.
Must be a foreign product.
This vendor is located in United Kingdom and South Africa. The project purchasing this project requires the product to be foreign.
If purchase from an US vendor, the sponsor of the project would pull remaining funding and would not fund any future work with our group.
Must have flight heritage.
This component has flown on GOMX-3 and OPS-SAT.
Flight heritage proves success of satellite components in space, which cannot fully be proven in a lab environment.
Other X-Band radio components do not have the flight heritage of this product, so there is no real proof that the other products will survive in space.
TABLE 3(b) – BRAND NAME REQUIREMENT (Item or Service MUST be a specific brand, make, or model; however, it may be purchased from multiple vendors.)
List the critical What makes these critical State any alternatives characteristics or capabilities necessary to meet the “Government’s Minimum Requirements” characteristics/ specifications/ capabilities unique to this product/service and vendor?

available or considered” as a means of fulfilling this requirement and why they aren’t viable; and what would be the impact if a product was purchased from another vendor or without each characteristic listed.
Describe the Market Research conducted.
You must provide sufficient narrative explaining your research, date performed, and how you are certain no other products exist that meet your requirements, or how you are certain that similar products are inadequate that meet your requirement. Market research is not a substitute for competition and requirements should be well-established prior to seeking use of non-competitive procedures. If your requirement is supported by an official document (e.g. a Program of Record) that mandates specific Brand Name materials that cannot be substituted, you must reference the document in sufficient detail to allow the reviewer to obtain the document; your notation must identify any applicable document number, date, paragraph/table or other identifying location, the issuing and approving authority. Attaching a copy of the applicable document provides the best support, and if the document is lengthy, provide copies of the applicable pages reflective of the mandated items, the title page (or equivalent), and approval page. In addition, you must explain the impact of using an “alternate or equal” item, in order to justify why market research was not conducted.
Use the table below (or attach a similar table) to supplement your narrative. Provide a comparison of your required item to any similar products or services that do not meet all of the criteria listed in table 3(a) or 3(b) above. If the product/service is truly unique and no other similar items exist, list only your product/service and check each box showing that it meets all minimum criteria listed in table 3(a) or 3(b). In the first row you will list each of your Critical Attributes/Minimum Characteristics from the Table in 3(a)/(b) above. Then, in the first column you will list each company/manufacturer and the brand/model of the product you reviewed. Finally, in the columns adjacent to the company/brand listed, you will indicate whether it “Met” or “Did Not Meet” the required characteristic. DO NOT LEAVE TABLE 4 BLANK.

List any other information or facts supporting the justification to limit competition not described elsewhere on this form.
A determination not to compete the proposed contract was made pursuant to the Federal Acquisition Regulation (FAR) 6.302-1, only one source is capable of satisfying the agency's requirements. Acquisitions of items for test and evaluation under the Foreign Comparative Testing program are in accordance with 10 U.S.C. 2350a(g) and centrally managed by the Under Secretary of Defense for Acquisition, Technology and Logistics and the Assistant Secretary of Defense for Research and Engineering (ASD(R&E)) through the Deputy Assistant Secretary of Defense for Emerging Capability and Prototyping (DASD(EC&P)) Comparative Technology Office, which provides funding for U.S. test and evaluation of selected equipment items and technologies developed by allied or friendly countries.
Provide a statement of actions that will be taken to remove or overcome any barriers to competition prior to any future procurements for this Supply or Service (there is an ongoing duty to remove the elements of a justification that unduly restrict competition thereby allowing for competition of this requirement in the future).
Technical Cognizance will continue to search for new products that are compatible with the Pumpkin 6U satellite and the existing lab space in the future.
