About this file

This document is a Brand-Name Justification and Approval for a sole source acquisition from National Instruments. The Naval Surface Warfare Center, Philadelphia Division seeks to acquire National Instruments hardware components totaling $987,995 to expand the data acquisition capabilities of the Compatibility Testing Facility's existing Data Acquisition System. The components are required to be compatible with the LabVIEW software and other National Instruments parts already integrated in the system. Conducting a full system overhaul with another vendor's hardware and software would cause schedule delays and significantly increased costs estimated at $9 million. No other offers were received in response to the pre-solicitation notice published on SAM.gov from June 14 to 28, 2023. The acquisition is justified due to National Instruments being the only brand that can meet the technical and compatibility requirements without replacing the entire existing system.

The Government’s minimum needs have been verified by certifying technical and requirements personnel.

These items are Commercial Off the Shelf (COTS) components that are available from National Instruments and its authorized resellers. The items are required to be delivered within four (4) months from date of award. There are no option quantities or periods. This order will be fully funded using Shipbuilding and Conversion, Navy (SCN) FY23 funds. The Government’s minimum needs have been verified by certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition

41 U.S.C. 1901(e)(2), a sole source (including brand-name) acquisition under the authority of Simplified Procedures for Certain Commercial Products and Commercial Services.

5. Rationale Justifying Use of Cited Statutory Authority

Currently, the CTF DAS utilizes the National Instruments components mentioned above as the front end interface for a variety of analog sensors including but not limited to accelerometers, current transducers, microphones, and voltage transducers that acquire data at various acquisition rates as required per letter 486:CJC/913976/4.0(R) COLUMBIA Class-Integrated Power System (IPS) Compatibility Testing Facility (CTF) Requirements Document, Revision D and also outlined in the CTF DAS System Description document, SD-CTF-DAS-9 UID 10867. During the ongoing pre-production testing at CTF, there are 13 deployed data acquisition nodes acquiring data from over 1,650 analog sensor signals. To expand the CTF DAS to include additional analog sensors for the Motor Module Test Program as per letter 486:DRC/998477/4.0 COLUMBIA Class-Integrated Power System (IPS) Compatibility Testing Facility (CTF) Motor Module Test Program (MMTP) Requirements, Revision A, the components listed above are required to meet the published requirements. These National Instruments brand components are essential to ensure technical compatibility with the existing CTF DAS hardware and software that is currently in use. No other manufacturers offer hardware that is compatible with the components that are currently being used.

Furthermore, the CTF DAS utilizes National Instruments Labview software to perform the data acquisition. Utilizing another vendor’s hardware and subsequent software would require a complete system overhaul and additional software development, which would impact the overall program schedule for the MMTP and the greater Columbia Class program. Market research indicates other companies’ similar products, or companies lacking the particular software required, do not meet, and cannot be modified to meet, the agency’s needs to remain compatible with the existing DAS components.

The individual components associated with the CTF are uniquely aligned with each other and cannot be substituted with other manufacturers’ parts without replacing the system as a whole.

This replacement process would require years of research and development at an estimated cost of roughly $9,000,000.00. Furthermore, it would result in a similar situation as the current, where replacement parts would be on a brand name basis thus repeating the cycle of brand name or renew.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research was conducted through a survey and an analysis of alternate brands available was performed for this requirement. As previously indicated, this procurement is serving as a technical refresh of existing components. Selection of another vendor would not be feasible because it would require development of an entire new data acquisition system from the front end hardware to the back end software which would impact the program’s schedule and significantly increase the procurement costs. These components need to be procured from National Instruments through its certified resellers so that the existing CTF DAS can continue to meet the program’s ongoing data acquisition needs. As such, market research indicates other companies' similar products, or products lacking the particular feature, do not meet, and cannot be modified to meet, the agency's needs.

A synopsis of this procurement was published on the SAM.Gov on 6/14/23 with a closing date of 6/28/23. No contractors responded to the posting as of the closing date. This Justification will be posted along with the solicitation on the SAM.Gov website. Any responses received will be evaluated prior to award.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
