SECTION L - INSTRUCTIONS, CONDITIONS AND NOTICES TO BIDDERS
The following have been modified:
52.212-1 (DEV)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF
1449). However, the small business size standard for a concern which submits an quote in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of quotes. Submit signed and dated quotes to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotes may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, quotes must show--
(1) The solicitation number;
(2) The name, address, and telephone number of the contractor;
(3) Price and any discount terms;
(4) "Remit to" address, if different than mailing address;
(5) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the quoteor shall complete electronically);
(6) Acknowledgment of Solicitation Amendments;
(7) Delivery Date; Quotes providing for delivery after 1 January 2021 will be rejected. If no delivery date is provided, the Government will assume a delivery date of 1 January 2021;
(8) If the quote is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Unless otherwise explicitly indicated within the quote, the Government will consider submission of a quote to be a contractor’s agreement with all all terms, conditions, and provisions. Quotes that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of quotes. The contractor agrees to hold the prices in its quote firm for 30 calendar days from the date specified for receipt of quotes, unless another time period is specified in an addendum to the solicitation or a longer period of time is specified in the contractor’s quote.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotes. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple quotes. Contractors are encouraged to submit multiple quotes presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation. Each quote submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of quotes:
(1) Contractors are responsible for submitting quotes, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotes or revisions are due.
(2)(i) Any quote or modification of a quote received at the Government office designated in the solicitation after the exact time specified for receipt of quotes is “late” and will not be considered unless it is received before award is made, and the Contracting Officer determines that accepting the late quote would not unduly delay the acquisition.
(ii) However, a late modification of an otherwise successful quote, that makes its terms more favorable to the
Government, will be considered at any time it is received and may be accepted.
(iii) Contractors may withdraw their quote from consideration by written notice at any time before award.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the quote wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that quotes cannot be received at the Government office designated for receipt of quotes by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotes will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate quotes and award a single contract without discussions with contractors. Therefore, the contractor's initial quote should contain the contractor's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all quotes if such action is in the public interest; accept other than the lowest quote; and waive informalities and minor irregularities in quotes received.
(h) Multiple awards. The Government may accept any item or group of items of a quote, unless the contractor qualifies the quote by specific limitations. Unless otherwise provided in the Schedule, quotes may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity quoted, at the unit prices quoted, unless the contractor specifies otherwise in the quote.
(i) Unique entity identifier. (Applies to all quotes exceeding the micro-purchase threshold and quotes at any dollar value if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The
Contractor shall enter, in the block with its name and address on the cover page of its quote, the annotation ``Unique
Entity Identifier'' followed by the unique entity identifier that identifies the Contractor's name and address. The
Contractor also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Contractor to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the
Contractor does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Contractor should indicate that it is a contractor for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(j) Debriefing. If a post-award debriefing is given to requesting contractors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed contactor’s quote.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed contractor and past performance information on the debriefed contractor.
(3) The overall ranking of all contractors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful contractor.
(6) Reasonable responses to relevant questions posed by the debriefed contractor as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.
(k) In order to be eligible for award, the contractor shall provide proof that the nut manufacturer (whether a prime or subcontractor) has a quality management program in place that meets ISO 9001:2015 or later edition OR AS9100.

L-215-H007 SUBMISSION OF QUESTIONS BY OFFERORS—ALTERNATE I (NAVSEA) (MAR 2019)
(a) Offerors may submit questions or request clarification of any aspect of this solicitation. It is the Offeror’s responsibility to bring to the attention of the Contracting Officer at the earliest possible time, but prior to the closing date, any ambiguities, discrepancies, inconsistencies, or conflicts between the SOW or PWS (as applicable) and other solicitation documents attached hereto or incorporated by reference. Each question should identify solicitation number, document, page number, paragraph number or other identifier relating to the question. Questions without this information may not be answered. Acknowledgment of questions received will not be made.
(b) The deadline for receipt of questions is 16 October 2019. Although every effort will be made, the Government makes no guarantee that questions received after the date above will be answered.
(c) All questions shall be submitted via email to the point of contact listed for this solicitation. Responses will be posted to the Federal Business Opportunities Web page (FedBizOps) at https://www.fbo.gov.
(End of provision)
SECTION M - EVALUATION FACTORS FOR AWARD
The following have been modified:
52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible contractor whose quote, conforming to the solicitation, will be most advantageous to the Government. The Government will evaluate the contractor’s Quality Management Program on an “Acceptable / Unacceptable” basis. The following factors shall be used to evaluate quotes:
(i) Quality Management Program
(ii) Price
(b) The Government will review the contractor’s submitted proof of an acceptable Quality Management Program. In order to be acceptable, the contractor shall provide sufficient proof that the nut manufacturer (whether a prime or subcontractor) has a quality management program in place that meets ISO 9001:2015 or later edition OR AS9100.
(c) The Government intends to award a contract to the contractor whose quote conforms to the solicitation, whose nut manufacturer has a valid and acceptable Quality Management Program, and is the lowest total price.
