3. This acquisition will result in the award of a Firm Fixed Price Contract (Davis Bacon Wages apply).

6. A site visit is scheduled for 20 August 2019 at 10:00 am. However, the site visit is NOT mandatory for contract award. If the offeror attends the site visit, it will be at your own expense. The Government will not compensate or be responsible for any associated costs of the optional site visit.

Section C - Descriptions and Specifications

REMOVE AND REPLACE BUILDING 1000 Air Handler Equipment for AS-7

STATEMENT OF WORK

SECTION 1: GENERAL

1.1 GENERAL DESCRIPTION: The Contractor shall install new Variable Frequency Drives (VFD), VFD rated motors and remove and replace the existing pneumatic variable pitch fans for the supply and return fans for AS-7. The Contractor shall provide all supervision, labor, material, equipment and supplies to perform the work. Refer to Section 2 below for detailed description of work to be performed.

1.2 SITE LOCATION: The work is located in Building 1000 in the penthouse machinery room, Naval Surface Warfare Center, Philadelphia Division (NSWCPD), 5101 South 18th Street, at PNBC. See Attachment 3 for location.

1.3 TIME OF COMPLETION: Work shall be prosecuted diligently and completed within 75 calendar days of award. The time stated for completion shall include submittals, bonding, insurance, and must include final clean-up, inspection, and acceptance of the work area. Contractor is required to furnish proof of any cause for delay and must request an extension of the completion date in writing through the Contracting Officer.

1.4 GOVERNMENT TECHNICAL POINT OF CONTACT (TPOC): The Government’s Quality and

Performance Assurance Representative, Mr. Jacob Scholz (215) 897-7028, is the NSWCPD TPOC. The TPOC is a technical representative of the NSWCPD, Code 02, Contracts Department, and provides technical and administrative assistance to NSWCPD Code 02 related to the subject contract and work. All scheduling and coordination will be through the NSWCPD TPOC.

1.5 PAYMENT: Will be made in one lump sum after completion and acceptance of the work by the

Government Quality Assurance Representative.

1.6 GOVERNMENT FURNISHED MATERIALS/UTILITIES: The government will furnish the following utility services at existing outlets, for use as may be required for the work to be performed under the contract: electricity and fresh water. Information concerning the location of existing outlets may be obtained from the NSWCPD TPOC. The Contractor shall provide and maintain, at his/her expense, the necessary service lines from existing Government outlets to the site of the work.

Utilities specified above will be furnished at no cost to the Contractor. In the event that the Government is unable to provide the required types of utilities, the Contractor shall, at his/her expense, arrange for the required utilities.

1.7 EXECUTION OF WORK: The Work shall be performed during normal duty hours, normal duty hours are 0700 to 1600 Monday thru Friday. Work shall be accomplished as directed by the NSWCPD TPOC.

No work shall be performed after normal duty hours or on Government holidays unless authorized by the NSWCPD TPOC. All access must be closely coordinated with the NSWCPD TPOC.

1.8 CONTRACTOR’S PRODUCTION REPORT: The Contractor is required to submit a “Contractor Production Report” on the form furnished by the NSWCPD TPOC for this purpose. The form shall be completed daily and be provided to the NSWCPD TPOC, or delivered to Code 02 Contracts Department Office, by 1000 the following day.

1.9 CLEAN-UP OF SITE: Maintain a clean and safe worksite. Remove all scrap materials, waste and debris from work site on a daily basis. Contractors are not permitted to use Government dumpsters or other Contractor dumpsters for disposal of debris.

1.10 HOT WORK: A hot work permit is required, as needed. Hot work is not anticipated for this project. A permit may be obtained through the Government inspector with 48-hours prior notice. Hot work in electrical or mechanical room space will require a gas-free test prior to the Government fire inspector granting approval. In accordance with the Government fire inspector’s requirements, the Contractor must perform this test daily. The Government fire inspector shall approve the instrument used. Fire extinguishers must be provided by the Contractor at ALL locations where cutting is performed.

1.11 DUST CONTROL: The amount of dust resulting from prosecution of any definable feature of the work must be controlled to prevent the spread of dust to occupied portions of the site and to avoid creation of a nuisance in the surrounding area. Use of water will not be permitted when it will result in, or create, hazardous or objectionable conditions such as ice, flooding and pollution.

1.12 SUBMITTALS:

The Contractor shall submit the following within 5 days after award:

1.12.1 Activity Hazard Analysis in accordance with EM 385-1-1. See Attachment 1 for blank form and sample. See paragraph 3.6.2 for additional information. The AHA shall cover all aspects of the work.

1.12.2 Machinery and Mobile Equipment Checklist (Attachment 2) in accordance with paragraph 3.6.1.11 (if required).

1.12.3 Requirements for Contractor Lift Operations as shown in Attachment A. (if required)

1.12.4 Project schedule

1.12.5 Product cut sheets, manufacturer specification sheets, manufacturers installation guidelines, motor cut sheets, fan curves etc., and as applicable Safety Data Sheets (SDS) for all materials to be used in the performance of this project. All equipment must be approved by the government TPOC prior to the start of work.

1.12.6 Warranty information guaranteeing all products and workmanship to be free of defects for a minimum of one year. VFDs and electric motors shall be warrantied for a period of not less than 2 years from the date of installation.

1.12.7 Contractor’s Daily Production Report (see Section 1.8 above)

Submittals will be approved by the NSWCPD TPOC prior to the start of work.

1.13 SITE VISIT: See FAR 52.236-27 Site Visit. Contractor shall verify all conditions, dimensions and methods at site.

1.14 CONTRACTOR REQUIREMENTS FOR LIFT OPERATIONS: Contractor shall comply with the requirements specified in Attachment A, “Requirements for Contractor Lift Operations” for all work performed with cranes or other machines used to lift equipment.

1.16 INSPECTION OF WORK: The Contractor must inspect all work in accordance with FAR clause 52.246-

12, Inspection of Construction, to ensure that the work performed under the contract conforms to contract requirements. Government inspections and tests are for the sole benefit of the Government and do not relieve the Contractor of responsibility of providing adequate Quality Control measures and do not constitute or imply acceptance.

1.17 ELECTRICAL SAFETY: Comply with Electrical Safety procedures in accordance with 29 CFR 1926.

For additional information, refer to Chapter 12, of NAVSSESINST 5100.14G.

1.18 LOCK-OUT, TAG-OUT: Comply with NSWCPD Lock-out/Tag-out procedures in accordance with

Chapter 11 of NAVSSESINST 5100.14G and 29 CFR 1926. Only authorized NSWCPD personnel must perform the Lock-Out and Tag-Out of Electrical, Mechanical, Piping, Machinery or Equipment.

1.19 ACCESS AND GENERAL PROTECTION/SECURITY POLICY: Contractor and Subcontractor employees must be U.S. citizens and able to provide satisfactory proof of U.S. citizenship. Contractor or Subcontractor employees working inside NSWCPD buildings must submit paperwork and obtain a Contractor’s ID badge. Refer to Section 3.7, Installation Access, Security, and Contractor Badges and Identification, for detailed information and procedure regarding installation access, security, and contractor badges and identification.

1.20 CONSTRUCTION MATERIALS: Unless otherwise noted, the Contractor must furnish all materials to complete the scope of work. The Contractor is responsible for procurement, shipping and storage of all construction material. All material will be procured in accordance with the Buy American Act of 1933, Federal Acquisition Regulation (FAR) Clause 52.225-9.

SECTION 2: DETAILED DESCRIPTION OF WORK

The Contractor shall provide all labor, material, tools, equipment, supplies and supervision to remove and install all equipment for AS-7 located on the penthouse floor machinery room, Building 1000, at this site. Remove and replace the existing supply and return electric motors, in flight variable pitch fans, and new VFD’s and VFD return and supply fans and motors. After completion of all work the area shall be returned to its’ proper condition.

2.1 Apply, monitor and comply with all safety requirements in accordance with the U. S. Army Corps of

Engineers Safety and Health Requirements Manual, EM-385-1-1. This shall include following all NSWCPD requirements in regards to safety at a Government facility. The Contractor shall apply and monitor proper Lockout/Tag Out (LOTO) Procedures and devices in accordance with EM385-1-1 and remove them upon the completion of work. The Contractor shall coordinate all LOTO control activities with the NSWCPD TPOC.

Air Handler AS-7

2.2 Secure and remove the existing electric motors for Air Handler AS-7 supply and return fans. The

Contractor shall turn over all motors to the Navy for storage as spares. If the Navy decides not to retain the motors the motors shall be disposed of off-site by the Contractor. Remove all supply and return fan control wiring and power wiring. The conduit can remain for re-use with the new wiring to be installed by the Contractor. All pneumatics, wiring, conduit, etc. not to be re-used shall be pulled back to the nearest junction box where it will be terminated and secured by the Contractor.

2.3 Modify the existing pneumatically adjustable in-flight variable pitch fans by replacing the blade and hub assemblies.

a. Replace the variable pitch fan blade and hub assemblies with new fixed, non-in-flight adjustable (mechanically adjustable while static) fan blade assemblies, re-using the existing fan housings.

Any penetrations through the fan blade housing shall have metal pipe sleeves. Do not use seal-tite as it wears through due to vibrations.

b. The new fan rotor and blade assemblies shall perform consistent with the performance characteristics of the existing fans; as identified below or approved equal, and shall be capable of meeting the original design conditions. Details of the existing fans and original design conditions may be found in Table 2.3.

i. Existing Supply Fan is a Flakt (TCF/Aerovent “Axico”) Model # FVAC-4-2-140-6-8- 280-50, Serial # 1105029.

ii. Existing Return Fan is a Flakt (TCF/Aerovent “Axico”) Model # FVAC-4-2-140-6-8- 259-51, Model # 1105035.

c. Pull back and secure all pneumatic control lines removed from the vortex mechanisms.

i. Pnuematic lines that are removed from the vortex components and are not to be re-used, shall be pulled back to the closest header or the control panel, and secured.

ii. All pneumatic lines that are pulled back shall be sealed with removable plugs.

iii. Pnuematic Pilot Positioners shall be carefully removed and turned over to the Navy for storage as spares.

VFD and VFD Supply and Return Motors

2.4 Provide and install new VFDs and VFD-rated motors for both the supply and return.

a. The motors shall operate from a 460/480-3-60 electrical power source. The motors shall have extended leads to allow for proper location of equipment.

b. The fan motors shall be rated for VFD operation (vector rated, inverter duty, etc.).

c. The motor peckerhead shall be located outside of the fan housing similar to the existing configuration.

d. The motors shall have a rated service factor of not less than 1.15.

e. The existing supply fan motor is reported to be: 125 HP, 460-3-60, 1800 RPM, motor frame 444TS.

The Contractor is responsible to field verify existing equipment prior to ordering new equipment.

f. The existing return fan motor is reported to be: 75 HP, 460-3-60, 1800 RPM, motor frame 364T. The

Contractor is responsible to field verify existing equipment prior to ordering new equipment.

2.5 Supply, install and program new VFDs for control of the new VFD-rated supply and return fan motors.

a. The new VFD shall be similar or equal to Honeywell HVAC SMARTVFD, rated for no less than the nameplate HP of the new motors or the Navy approved equivalent. Honeywell HVAC SMARTVFD is the Navy’s preferred product as this base has standardized on this product.

b. VFDs shall be suitable for use with a 480-3-60 electrical supply.

c. The VFDs shall include a manual 3 contactor bypass.

d. VFDs shall be installed in a convenient location near the air handler and accessible from the ground.

Location to be determined by the Contractor and approved by the Navy.

e. The Contractor shall be responsible for providing any necessary electrical work, including but not limited to: any necessary fuses, wiring, conduit, breakers, disconnects, etc. for the new fan VFDs and motors.

f. All new or re-used wiring and electrical work shall conform to the current NEC and UFC codes and standards.

2.6 Relocate the supply fan disconnect to the exterior of the AHU.

2.7 Relocate the return fan disconnect to the floor level.

2.8 Wire and configure the new VFDs for control by the existing Automated Logic Building Automated

System (BAS).

a. Supply and install any necessary wiring, conduit, controls, sensors, pneumatic tubing, etc. required to fully integrate the new equipment with the existing BAS.

i. Run all wiring, conduit, pneumatic tubing, etc. to the existing BAS panel located in the penthouse.

ii. Leave a minimum of 6 feet of excess wire, tubing, etc. coiled up at the BAS panel for the

Navy to land within the BAS panel.

1. The control wire shall be shielded twisted pair, minimum 20 awg, as manufactured by

Belden or equal.

2. Label both ends of all control wires.

3. Land control wires, pneumatics, etc. at their respective field devices.

4. Provide a minimum 4 pair from each VFD to AS-7 Control Cabinet (located on the side of AS-7).

a. Start/Stop signal to VFD shall be a dry contact

b. VFD Control Signal shall be a 0 to 10 volts direct current (VDC) signal

c. Motor current feedback from VFD shall be a 0 to 10 VDC signal

d. Spare

iii. Adjust the new supply and return fan blade pitch as necessary to obtain the maximum motor current with VFD at 100% (60 Hz).

b. The Contractor shall work with NSWCPD Facilities personnel to test and calibrate all sensors, controllers, devices, equipment, etc. to verify proper operation and control of all new and modified equipment. The VFD motor current settings for the supply and return fans at 10 VDC shall be provided to the Government to set up in the DDC parameter settings.

2.9 The Contractor shall fully clean the air handle and balance both the supply and return fans.

a. Clean the air handler (within the penthouse) and clean both the supply and return fans along with the ductwork immediately adjacent (Directly before and after) the fans.

b. Following the completion of the VFD, motor and fan installation, the Contractor shall dynamically balance both the supply and return fans. Static balancing or factory balancing of the fan blades is not sufficient to meet this requirement.

2.10 All work and equipment shall be performed and installed in accordance with local, state, federal and industry codes. The Contractor shall provide a one-year warranty from defects in materials and workmanship from the date of acceptance. The Contractor shall also provide manufacturers warranties on all new equipment for a period of not less than year from the date of installation. VFDs and electric motors shall be warranted for a period of not less than two years from the date of installation. The Contractor shall make every effort to minimize the duration of the air handler down time in order to reduce any impact on the building occupants.

2.11 Upon completion of the project, the Contractor shall turn over all manuals and documentation for the newly installed equipment (O&M manuals, installation manuals, equipment specifications, etc.) to the TPOC.

SECTION 3: ADMINISTRATIVE AND SAFETY REQUIREMENTS

3.1 DIRECTIVES: The Contractor and his employees must comply with all referenced regulations, directives, and instructions. Applicable Department of Defense (DOD), Secretary of the Navy (SECNAV), Chief of Naval Operations (OPNAV), and other directives, instructions, and regulations are available from the Contracting Officer.

3.2 PHILADELPHIA NAVY YARD INSTALLATION REGULATIONS

3.2.1 The Contractor and his employees must become acquainted with and obey all Government regulations as posted, or as requested by the Contracting Officer.

3.2.2 The Contractor must participate actively in the activity energy conservation program. The Contractor must comply with the base energy conservation program and must become familiar with its requirements. The Contractor superintendent must represent the Contractor's interests at all meetings of the activity's Energy Conservation and Resource Management Committee. Use of high-energy consuming tools or equipment will be approved by the Contracting Officer prior to use.

3.3 FIRE PROTECTION: The Contractor and his employees must know where fire alarms are located and how to turn them on. The Contractor must handle and store all combustible supplies, materials, waste and trash in a manner that prevents fire or hazards to persons, facilities, and materials. Contractor employees operating critical equipment must be trained to properly respond during a fire alarm or fire in accordance with activity instructions.

3.4 ENVIRONMENTAL PROTECTION: The Contractor must comply with all federal, state and local environmental protection laws and the regulations and standards. The Contractor must coordinate all environmental protection matters with the Contracting Officer. The Activity Environmental Protection Coordinator or other authorized officials may inspect any of the facilities operated or maintained by the Contractor at any time and without prior notice. If a regulatory agency assesses a monetary fine against the Government for violations resulting from Contractor actions, the Contractor must reimburse the

Government for the amount of the fine and related costs. The Contractor must clean up any oil or chemical spills resulting from his operations at his own expense. The Contractor must not create a nuisance or hazard to the health of military or civilian personnel.

3.5 DISPOSAL: Debris, rubbish, non-hazardous waste and non-usable material resulting from the work under this contract must be disposed of by the Contractor at his expense off Government property, unless otherwise directed. In either case, the Contractor must dispose of all hazardous waste in accordance with all applicable environmental law, including but not limited to, the Resource Conservation and Recovery Act and its associated state and local regulations. Prior to disposal of any hazardous waste, the Contractor must obtain approval from the Contracting Officer.

3.5.1 Segregate and recycle all debris generated by the work and remove off station to a licensed facility. Debris must be removed and transported in such a manner that prevents spillage on streets or adjacent areas. Local regulations regarding hauling and disposal must apply.

3.5.2 Submit a report with invoice that includes the following:

Amount (by weight) and type of waste materials disposed of in a landfill or incinerator. Provide destination and the tip fee per ton.

Amount (by weight) and type of materials salvaged for sale, salvaged for reuse, and recycled.

Provide destination and revenue generated for each material.

3.6 SAFETY REQUIREMENTS AND REPORTS

3.6.1 All work must be conducted in a safe manner and must comply with all requirements of the U.S.

Army Corps of Engineers Safety and Health Requirements Manual, EM-385-1-1. The Contractor must be responsible for instructing his employees in appropriate safety measures and must not permit them to place machines and other equipment in traffic lanes or other locations in such a manner as to create safety hazards. The Contractor must employ a competent person as defined in EM-385-1-1 to function as the Site Safety and Health Officer (SSHO). The following paragraphs denote minimum safety requirements. Contractor must consult EM-385-1-1 for additional information or any safety issues not discussed in this specification.

3.6.1.1 Personal Protective Equipment Minimum Requirements

(a) Head Protection: All persons working in or visiting hard-hat areas must be provided with and required to wear Type I or Type II, Class G meeting the requirements of ANSI Z89.1 Hardhat areas are those areas with potential hazard of head injury.

(b) Clothing: Employees must wear clothing suitable for the weather and work conditions: the minimum for construction sites must be short sleeve shirt, long pants (excessively long or baggy pants are prohibited).

(c) Protective Footwear: Employees must wear safety–toed boots meeting ANSI Z41 while working on construction sites.

(d) Eye and Face Protection: All eye and face protection must meet the requirements of ANSI/ASSE Z87.1, employees must also use eye side protection.

(e) High visibility vests will be worn when working around construction equipment or when working on highways.

3.6.1.2 Display of Safety Information: Within one calendar day after commencement of work, erect a safety bulletin board at the job site. The following information must be displayed on the safety bulletin board in clear view of the on-site construction personnel, maintained current, and protected against the elements and unauthorized removal.

(a) Map denoting the route to the nearest emergency care facility.

(b) Emergency phone numbers.

(c) Copy of Activity Hazard Analysis sheets (AHAs).

(d) Occupational Safety and Health Administration (OSHA) 300A form.

3.6.1.3 Emergency Medical Treatment: Contractor must arrange for their own emergency medical treatment. The Government has no responsibility to provide emergency medical treatment.

3.6.1.4 Use of Hand and Power Tools: Hand and power tools must be of a manufacturer listed by a nationally recognized testing laboratory for the specific application for which they are to be used. Use, inspection and maintenance:

(a) Hand and power tools must be used, inspected, and maintained in accordance with the manufacturers’ instructions and recommendations and must be used only for the purpose for which designed.

(b) Hand and power tools must be inspected, tested, and determined to be in safe operating condition before use. Continued periodic inspections must be made to assure safe operating condition and proper maintenance.

(c) Hand and power tools must be in good repair and with all required safety devices installed and properly adjusted. Tools having defects that will impair their strength or render them unsafe must be removed from service.

(d) Loose and frayed clothing, loose long hair and dangling jewelry (including dangling earrings, chains and wristwatches) must not be worn while working with any power tools.

Guards: Power tools designed to accommodate guards must be equipped with such guards.

a) All guards must be functional.

b) Reciprocating, rotating, and moving parts of equipment must be guarded if exposed to contact by employees or otherwise create a hazard.

3.6.1.5 Portable Extension Cords: Portable extension cords must be sized in accordance with manufacturer ratings for the tool to be used and must be protected from damage. All damaged extension cords must be immediately removed from service. Portable extension cords must meet the requirements of National Fire Protection Association (NFPA) 70.

3.6.1.6 Ladders: All portable ladders must be of sufficient length and must be placed so that workers will not stretch or assume a hazardous position. The top or top step of a stepladder must not be used as a step unless it has been designed to be so used by the manufacturer. Ladders may be used as work platforms only when use of small hand tools or handling of light material is involved.

3.6.1.7 Lockout/Tag Out: Coordinate all control activities with the designated NSWCPD TPOC. Apply, monitor and remove proper lockout and tag out devices.

3.6.1.8 Sanitation Requirements: Provide drinking water and toilets as needed for construction personnel.

3.6.1.9 Fire Protection: Provide two ABC fire extinguishers at the work site to guard against potential fires.

3.6.1.10 Fuel-Powered Tools: When fuel-powered tools are used, they will not be fueled while running, while hot, or near an open flame.

3.6.2 Activity Hazard Analysis

The principle purpose of an Activity Hazard Analysis (AHA) is to reduce the overall risk of the hazards associated with construction work. The Contractor must develop and submit an AHA on the form of Attachment 1 for every operation involving a type of work presenting hazards not experienced in previous project operations or where a new work crew or subcontractor is to perform work.

The analysis must identify and evaluate hazards and outline the proposed methods and techniques for the safe completion of each phase of work. At a minimum, define activity being performed (can use the Definable Features of Work). A Definable Feature of Work (DFOW) is a task, which is separate and distinct from other tasks, has the same control requirements and work crews, sequence of work, specific safety and health hazards anticipated (slip or trips, cuts, dust or chips in eyes), control measures (to include personal protective equipment) to eliminate or reduce each hazard to acceptable levels, equipment to be used (hand tools, backhoe), inspection requirements (list the inspection requirements for the activity to ensure the controls are working, and equipment is inspected to ensure proper operation), training requirements for all involved (any unique training required to make the established controls work) and the competent person in charge of that phase of work.

The AHA must be continuously reviewed and, when appropriate, modified to address changing site conditions or operations. The analysis should be used during daily inspections to ensure the implementation and effectiveness of the activity’s safety and health controls. Activity Hazard Analysis must be updated as necessary to provide an effective response to changing work conditions and activities.

3.6.3 Accident Reports and Notifications

3.6.3.1 Accident Reports: For recordable injuries and illnesses, and property damage accidents resulting in a least $2,000 in damages, the prime Contractor must conduct an accident investigation to establish the root cause of the accident, complete the Navy Contractor Significant Incident Report (CSIR) and provide the report to the Contracting Officer within five calendar days of the accident. The Contracting Officer will provide copies of any required or special forms.

3.6.3.2 Accident Notification: Notify the Contracting Officer as soon as practical, but not later than four hours after any accident meeting the definition of recordable injuries or illnesses or high visibility accidents, property damage equal to or greater than $2,000.

Information must include Contractor name, contract title, type of contract, name of activity, installation or location where accident occurred, date and time of accident, names of personnel injured, extent of property damage (if any), extent of injury (if known) and brief description of accident (to include type of construction equipment used, Personal Protective Equipment (PPE) used, etc.). Preserve the conditions and evidence on the accident site until the Government investigation team arrives on site and Government investigation is conducted.

3.6.3.3 Definition of a Recordable Injury or Illness: Any work related injury or illness that results in:

(a) Death, regardless of the time between the injury and death, or the length of the illness;

(b) Days away from work;

(c) Restricted work;

(d) Transfer to another job;

(e) Medical treatment beyond first aid;

(f) Loss of consciousness;

(g) A significant injury or illness diagnosed by a physician or other licensed health care professional, even if it did not result as listed above.

3.6.4 The Contractor's workspace may be inspected periodically for OSHA and Navy violations.

Abatement of violations will be the responsibility of the Contractor and/or the Government as determined by the Contracting Officer. The Contractor must provide assistance to the Safety Office escort and the federal or state OSHA inspector if a complaint is filed. Any fines levied on the Contractor by federal or state OSHA offices due to safety/health violations must be paid promptly.

3.6.5 If the Contractor fails or refuses to promptly comply with safety requirements, the Contracting Officer may issue an order stopping all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such stop order must be made the subject of claim for extension of time or for excess costs or damages to the Contractor.

3.6.6 The Safety Office will investigate all complaints of unsafe or unhealthful working conditions received from Contractor's employees, federal civilian employees, or military personnel. The Safety Office will notify the Contracting Officer of the results of such investigations.

3.7 INSTALLATION ACCESS, SECURITY, AND CONTRACTOR BADGES AND

IDENTIFICATION

3.7.1 Citizenship Requirements: Work under this contract is restricted to U.S. citizens. No employee or representative of the Contractor will be admitted to the work site unless he furnishes satisfactory proof that he is a citizen of the United States. Documents acceptable for Proof of Citizenship include:

3.7.1.1 Birth registration card.

3.7.1.2 Certificate of live birth, birth certificate.

3.7.1.3 Certificate of Naturalization.

3.7.1.4 Certificate of registration.

3.7.1.5 DD-214 (Must Cite Birthplace).

3.7.1.6 DD Form 4 (Contract for Enlistment and Must Cite Birthplace).

3.7.1.7 DD 1966 (Application for Enlistment).

3.7.1.8 Military discharge papers (must cite birthplace).

3.7.1.9 Delayed birth certificate.

3.7.1.10 Hawaii certificate of foreign birth.

3.7.1.11 Hospital birth certificate.

3.7.1.12 Marriage license certificate.

3.7.1.13 Merchant marine certificate.

3.7.1.14 Military officer ID card.

3.7.1.15 Notification of birth registration.

3.7.1.16 State of Hawaii ID card.

3.7.1.17 USA passport.

3.7.1.18 Verbal inquiry with State of Hawaii Vital Statistics Office.

3.7.2 Application for Contractor Identification Badges: The Contractor's employees or representatives who will be working inside NSWCPD facilities or secure perimeters must obtain a Contractor's ID badge which can be valid for up to 6 months. The Contractor will be required to submit a Letter of Badge Request on company letterhead to the NSWCPD TPOC including the contract name, contract number, contract duration, building/location of work, NSWCPD TPOC contact information, NSWCPD point-of-contact information, and the names and personal information for each contractor employee or representative (DOB, SSN, place of birth, citizenship status) to the NSWCPD TPOC for Security review and approval. A Letter of Badge Request is required to be submitted whenever expiring badges are needed to be renewed for continued work on the contract, containing the same information included in the initial request.

For Contractor employees or representatives that do not have a CONFIDENTIAL or higher security clearance, the Contractor shall provide a completed SECNAV 5512/1 (DoN Local Population ID Card/Base Access Registration Form) for each employee or representative to the NSWCPD TPOC for CNRMA (Command Navy Region Mid-Atlantic) vetting, review and approval.

Once approved, the Contractor's employees or representatives will report to Security (Building 29) with a completed I-9 form, along with two forms of identification specified on the I-9 form, for issuance of the ID badge. The Contractor must obtain the required employee ID badges from the Government at his own expense, at no additional cost. The ID badge must be returned within 5 calendar days to Security (Building 29) when an employee leaves the Contractor's service, when the job is complete, or the ID badge has expired. The Government is not responsible for any cost or lost time associated with obtaining or the use of daily or Contractor ID badges.

One-Day Visitor Badges: The Contractor's employees or representatives can obtain a daily Visitor's badge from the Security desk inside NSWCPD facilities, however, a Government escort will be required at all times and the badge will only be valid for the facility where the badge was issued. The use of daily visitor's ID badge is not recommended as a Government escort must be scheduled in advance and escort's availability is limited and granted on a case-by-case basis (i.e.

availability is not guarantee). The Contractor's personnel would have to obtain daily passes, be subject to daily mandatory vehicle inspection, and would have limited access to the installation if using a Visitor badge. The Government is not responsible for any cost or lost time associated with escort availability in conjunction with the use of Visitor’s badges for the Contractor’s employees or representatives.

3.7.3 General Access Requirements and Restrictions: The following access requirements and restrictions apply to work at any NSWCPD facility or secured perimeter.

3.7.3.1 No employee or representative of the Contractor will be admitted to the site of the work unless he/she has satisfactorily completed the Application for Contractor Identification Badge process and has furnished satisfactory proof that he/she is a citizen of the United States. The Government Security Office must approve each base application form before the employee or representative will be authorized admittance to the site of work by the Government.

3.7.3.2 The Contractor is responsible to collect and account for all identification badges issued to his/her personnel at the expiration of the contract, expiration of the badge or when no longer required. Collected badges must be returned by the Contractor to the NSWCPD Security Office (Building 29).

3.7.3.3 Comply with all security regulations currently in force as communicated directly by the Government Security personnel and as conveyed by the NSWCPD TPOC.

3.7.3.4 Employees or representatives of the Contractor, while working at NSWCPD, must display the Government issued badge over the front of their outer clothing at all times.

3.7.3.5 Roll up/garage doors are only permitted to be opened by Government personnel or Access Control Personnel (ACP). The ACP or Government personnel must guard the door during the entire time the door is un-secured. The doors must be secured immediately following its use, unless otherwise permitted by the Command Security Director.

3.7.3.6 Fence gates are only permitted to be opened by Government personnel or Access Control Personnel (ACP). The ACP or Government personnel must guard the gate during the entire time the gate is un-secured. The gate must be secured immediately following its use, unless otherwise permitted by the Command Security Director.

3.7.3.7 Commercial vehicles (with company logo) that are required to enter the fence line perimeter or enter the building at any NSWCPD facility must be inspected by CNRMA Police prior to entering the property. No personally-owned vehicles are permitted within the fence line perimeter of any NSWCPD facility. Coordinate vehicle inspections with the NSWCPD TPOC.

3.7.3.8 No Contractor or personally owned cameras are allowed inside NSWCPD facilities. If photographs are required for design or construction records, submit a written request to the Contracting Officer to have photographs taken by a Government Official using a Government camera. Photographs taken by the Government will be reviewed by Security before release to the Contractor.

3.7.3.9 If a security alarm is required to be temporarily disabled for a construction activity the Contractor must submit a completed Request to Mask Security Alarm form to the NSWCPD TPOC at least three business days in advance of the required date. The

NSWCPD TPOC will coordinate with the NSWCPD Security Office to obtain approval for the request.

3.8 IDENTIFICATION OF CONTRACTOR EMPLOYEES

3.8.1 The Contractor must provide to the Contracting Officer the name or names of the responsible supervisory person or persons authorized to act for the Contractor as outlined in NSWCPD Site Access Requirements.

3.8.2 The Contractor must furnish sufficient personnel to perform all work specified within the contract.

3.8.3 Contractor employees must conduct themselves in a proper, efficient, courteous and businesslike manner.

3.8.4 The Contractor must remove from the site any individual whose continued employment is deemed by the Contracting Officer to be contrary to the public interest or inconsistent with the best interests of National Security.

3.8.5 No employee or representative of the Contractor will be admitted to the site of work until and unless he/she has satisfactorily met the requirements outlined in NSWCPD Site Access Requirements.

3.8.6 All Contractor/subcontractor employees working under this contract must be identified by a distinctive nameplate, emblem, or patch attached in a prominent place on an outer garment.

Employee identification must not be substituted for station required passes or badges.

3.9 IDENTIFICATION OF CONTRACTOR VEHICLES: The Contractor must obtain parking passes for company vehicles, if required, from the Contracting Officer. The company name must be displayed on each of the Contractor's vehicles in a manner and size that is clearly visible. All vehicles must display a valid state license plate and safety inspection sticker, if applicable, and must be maintained in good repair.

3.10 PERMITS: The Contractor must, without additional expense to the Government, obtain all appointments, licenses, and permits required for the prosecution of the work. The Contractor must comply with all applicable federal, state, and local laws. Evidence of such permits and licenses must be provided to the Contracting Officer before work commences.

3.11 PROOF OF CITIZENSHIP: No employee or representative of the Contractor will be admitted to the site of work unless satisfactory proof of citizenship of the United States is furnished and confirmed.

3.12 WARRANTY OF INSTALLATION: In addition to any other warranties in this contract, the Contractor warrants that work performed under this contract conforms to the contract requirements and is free of any defect in equipment, material, or design furnished, or workmanship performed by the Contractor or any subcontractor or supplier at any tier. This warranty must continue for a period of one (1) year from the date of final acceptance of the work. If the Government takes possession of any part of the work before final acceptance, this warranty must continue for a period of one (1) year from the date the Government takes possession.

C-202-H001 ADDITIONAL DEFINITIONS–BASIC (NAVSEA) (OCT 2018)

(a) Department - means the Department of the Navy.

(b) Commander, Naval Sea Systems Command - means the Commander of the Naval Sea Systems Command of the Department of the Navy or his duly appointed successor.

(c) References to The Federal Acquisition Regulation (FAR) - All references to the FAR in this contract shall be deemed to also reference the appropriate sections of the Defense FAR Supplement (DFARS), unless clearly indicated otherwise.

(d) National Stock Numbers - Whenever the term Federal Item Identification Number and its acronym FIIN or the term Federal Stock Number and its acronym FSN appear in the contract, order or their cited specifications and standards, the terms and acronyms shall be interpreted as National Item Identification Number (NIIN) and National Stock Number (NSN) respectively which shall be defined as follows:

(1) National Item Identification Number (NIIN). The number assigned to each approved Item Identification under the Federal Cataloging Program. It consists of nine numeric characters, the first two of which are the National Codification Bureau (NCB) Code. The remaining positions consist of a seven digit non-significant number.

(2) National Stock Number (NSN). The National Stock Number (NSN) for an item of supply consists of the applicable four-position Federal Supply Class (FSC) plus the applicable nine-position NIIN assigned to the item of supply.

C-204-H001 USE OF NAVY SUPPORT CONTRACTORS FOR OFFICIAL CONTRACT FILES (NAVSEA)

(OCT 2018)

(a) NAVSEA may use a file room management support contractor, hereinafter referred to as "the support contractor", to manage its file room, in which all official contract files, including the official file supporting this procurement, are retained. These official files may contain information that is considered a trade secret, proprietary, business sensitive or otherwise protected pursuant to law or regulation, hereinafter referred to as “protected information”. File room management services consist of any of the following: secretarial or clerical support; data entry; document reproduction, scanning, imaging, or destruction; operation, management, or maintenance of paper-based or electronic mail rooms, file rooms, or libraries; and supervision in connection with functions listed herein.

(b) The cognizant Contracting Officer will ensure that any NAVSEA contract under which these file room management services are acquired will contain a requirement that:

(1) The support contractor not disclose any information;

(2) Individual employees are to be instructed by the support contractor regarding the sensitivity of the official contract files;

(3) The support contractor performing these services be barred from providing any other supplies and/or services, or competing to do so, to NAVSEA for the period of performance of its contract and for an additional three years thereafter unless otherwise provided by law or regulation; and,

(4) In addition to any other rights the contractor may have, it is a third party beneficiary who has the right of direct action against the support contractor, or any person to whom the support contractor has released or disclosed protected information, for the unauthorized duplication, release, or disclosure of such protected information.

(c) Execution of this contract by the contractor is considered consent to NAVSEA's permitting access to any information, irrespective of restrictive markings or the nature of the information submitted, by its file room management support contractor for the limited purpose of executing its file room support contract responsibilities.

(d) NAVSEA may, without further notice, enter into contracts with other contractors for these services. Contractors should enter into separate non-disclosure agreements with the file room contractor. Contact the Procuring Contracting Officer for contractor specifics. However, any such agreement will not be considered a prerequisite before information submitted is stored in the file room or otherwise encumber the government.

C-211-H018 APPROVAL BY THE GOVERNMENT (NAVSEA) (JAN 2019)

Approval by the Government as required under this contract and applicable specifications shall not relieve the Contractor of its obligation to comply with the specifications and with all other requirements of the contract, nor shall it impose upon the Government any liability it would not have had in the absence of such approval.
