JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Philadelphia Division (NSWCPD), Code 0223.

2. Description of the Action Being Approved

This is a sole source action to be awarded without providing for full and open competition. The proposed contract action is for leasing of software required by NAVSEA 05 SPAR NNSY-0527-A-17, in which PMS213 (05V) has directed public maintenance shipyards to procure and use Eddy current vendor, Zetec, Inc’s hardware and software to inspect non-nuclear heat exchangers.

3. Description of Supplies/Services

This procurement is for the lease of Zetec, Revospec, and

Historic Data Comparator software. The software is being procured to support the auto-analysis of CVN 68 class archived data from 11 CVN platforms (100,000 tubes per 100% carrier inspection/minimum 3 inspection cycles in archive per ship), which will enable NAVSEA to monitor heat exchanger service life and reduce the likelihood of in-service leaks. In addition, the software will also be used to support other heat exchangers in the fleet such as those on the LHD-1 class.

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304(c)(1). Only One Responsible Source and No Other

Supplies or Services Will Satisfy Agency Requirements (FAR

6.302-1).

5. Rationale Justifying Use of Cited Statutory Authority

Per NAVSEA 05 SPAR NNSY-0527-A-17, Dated 02 FEB 2018, PMS312

(05V) has directed public CVN maintenance shipyards to procure and use eddy current vendor, Zetec, Inc.’s, hardware and software to inspect non-nuclear heat exchangers on CVN 68 class vessels. In order to analyze and trend the data from the shipyards, NSWCPD must have the same software to fulfill its responsibilities as in-service engineering agents. There is no alternative software that is compatible with Zetec’s software at this time. The use and acquisition of this software was directed by NAVSEA 05Z based on the USS Harry S. Truman Main and Ships

Service Turbine Generator Condenser Tube Leak Critique Report

Dated 5/20/15 (Condenser Critique, Jul 15). NAVSEA requires the best possible Eddy current technology to perform CVN-68 and LHD-

1 class heat exchanger and ship service turbine generators inspections so that data trending and historical data analysis tools can be utilized in predicting service life of heat exchanger units.

NSWCPD is the Engineering Agent for Steam Turbines and for nuclear ship condenser/reboiler inspections. NSWCPD Code 331 In-

Service Engineering Agents (ISEA’s) will be responsible for implementing new inspection requirements and techniques in the inspection process using these software packages to support

NAVSEA’s mission with respect to the fleet’s condenser health assessment. The equipment listed above meets NAVSEA’s requirements to develop, implement, and monitor an effective and efficient CVN condenser inspection program. This equipment also meets the requirements of NSWCPD Code 412, ISEA for Steam

Service Turbines by performing condenser health assessments and determining plugging criteria for condensers.

The above equipment ensures the performing activities support

NSWCPD ISEA in all efforts to implement and monitor an effective and efficient CVN condenser program. The procurement of the

ZETEC software will meet the request by NAVSEA to require NSWCPD to analyze inspection results and provide NAVSEA, Ships and

TYCOMs with condenser health assessments, historical trending, and maintenance recommendations. Implementing this inspection program at NSWCPD relies on having consistent, quality repeatable results, using the same equipment (ZETEC) as the public shipyards performing the inspections and is imperative for results to be issued to NAVSEA, ships, TYCOMs, and Naval shipyards by NSWCPD in a timely manner.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

As discussed in Section 5, the technical requirements, data ownership status, and inability to substitute other components inherent in this procurement precludes consideration of other manufacturers. Furthermore, Zetec Inc. does not utilize third-party distributors for their equipment. For these reasons, it is not practical to have any other company other than Zetec, Inc.

provide the required services.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable. This information should be sufficient to support the fair and reasonable price determination of this procurement.

8. Actions to Remove Barriers to Competition

For the reasons mentioned in Section 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
