JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

JUSTIFICATION

1. Contracting Activity

The Naval Sea Systems Command, Naval Surface Warfare Center, Philadelphia Division (NSWCPD), Code 0223.

2.

Description of the Action Being Approved This is a sole source action to be awarded without providing for full and open competition. The proposed contract action is a Firm Fixed Price (FFP) contract in support of the CVN73 Machinery Control and Monitoring System (MCMS) to be awarded to Rockwell Automation Inc., 1 Allen Bradley Drive, Cleveland, OH, 44124-6118.

3.

Description of Supplies/Services This acquisition is for hardware from Rockwell Automation in support of the SCD2585 (CVN73 USS George Washington Reactor Complex OverHaul (RCOH) MCMS Upgrade. The acquisition will consist of the PLC Group Input / Output DROP Boxes (IODB) which will contain Rockwell 1756 series I/O devices, Communication Cards, and Programmed Logic Controllers, and Industrial Ethernet Switch Boxes (IES) which will contain MS20 Ethernet switches and modules. The PLCs communicate via an integrated network with each other, the IODB assemblies and computer based workstations.

The Navy’s objective for this requirement is to improve the reliability, maintainability, and efficiency by reducing the Total Ownership Cost (TOC), downtime and improve commonality across ship classes. Part of the hardware acquisition (PLC L83 processors and En2T COMCards) will be used in LBTF to emulate shipboard environment and develop CVN Controls Software. It is also used to provide distance support to ships for operational issues, troubleshooting, training and as a verification and validation platform for assessing and addressing cybersecurity issues as they arise.

The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The total cost of the purchase is $295,335.70. The funding will be Shipbuilding and Conversion, Navy (SCN).

The required delivery date shall be 18 weeks after date of award.

4.

Statutory Authority Permitting Other Than Full and Open

Competition

41 USC 1901(e)(2), a sole source acquisition under the authority of Simplified Procedures for Certain Commercial Items, as implemented by Federal Acquisition Regulation FAR Subpart 13.501(a).

5.

Rationale Justifying Use of Cited Statutory Authority There are currently PLC based control systems installed on board the majority of the US Navy’s Fleet including that on the CVN68 Nimitz Class (CVN 73). This commonality and re-usability has streamlined the areas of fleet training and maintenance resulting in significant savings. This complies directly with NAVSEA INSTRUCTION 4120.9 to use products stored on the virtual shelf.

PLC based systems consist of various components (processor, power supply, I/O cards) which only function properly when all of those components are produced by the same Original Equipment Manufacturer (OEM). NSWCPD has conducted several rounds of testing in accordance with Capability Maturity Model Integration (CMMI), system requirements and hardware specifications in order to provide a PLC package to the fleet that is fully tested and debugged prior to deployment. PLC racks cannot have component parts interchanged with different OEM products. Any deviations could induce unnecessary problems, costs and additional engineering, therefore, the capability to procure components directly from a specific OEM is essential. Going forward, the CVN68 Class will have cybersecurity requirements that necessitate only original OEM parts (Rockwell Automation, Inc) with a specific level of firmware that will support those requirements. Obtaining these electronic components directly from the OEM ensures integrity of the hardware and firmware and reduces or removes risk of the introduction of Malware or compromised hardware through a Gray Market supply chain.

For the reasons stated above, it is imperative that the hardware procured to stand up the CVN73 MCMS be the exact same configuration as used shipboard, and as such, makes Rockwell PLC Products the only qualified product line. It also makes Rockwell Automation, Inc. the uniquely qualified supplier to the product described in this acquisition. The government does not have the requisite specifications, drawings or source code that would be required to procure the hardware competitively.

6.

Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

Market research and surveys are conducted on a regular basis via technology and program reviews, internet searches and various US Navy programs and initiatives to advance the maturity and capability of high energy systems and high temperature superconducting technology. This includes NSWCPD surveys and analysis of alternative equipment brands that are available in industry.

In addition, the proposed acquisition was synopsized via FedBizOps (http://www.fbo) on 05 February 2018, in accordance with FAR Part 5.2. No responses were received by the closing date (20 February 2018) of the synopsis.

7.

Determination of Fair and Reasonable Costs The Contracting Officer will determine that the anticipated cost to the Government for the supplies covered by the J&A are fair and reasonable, prior to award.

Significant quantities of this requirement have been purchased from Rockwell Automation in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8.

Actions to Remove Barriers to Competition For the reasons set forth in Paragraph 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
