JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center, Philadelphia Division
(NSWCPD), Code 0223.
2. Description of the Action Being Approved
This is a sole source action to be awarded without providing for full and open competition. The proposed contract action is a Firm Fixed Price (FFP) for four 3-inch self-cleaning strainers, four
3-inch simplex strainers and one 5-inch simplex strainer to support USS George H. W. Bush
(CVN 77) and USS IWO JIMA (LHD 7) installations. Tate Andale Inc. is the Original
Equipment Manufacturer (OEM) of these strainers (Cage Code 09032, 1941 Lansdowne Rd., Baltimore, MD 21227).
3. Description of Supplies/Services
The procurement of these strainers is in support of SCD 10138 and 13325 VS-50 Oil-Water
Separator (OWS) system installation aboard CVN 77 and LHD 7, respectively. These strainers are for replacing and retrofitting an existing system that was already Navy Shock, Vibe and EMI qualified using the Tate Andale strainers as part of the main system. In addition, two of these strainers are controlled by the Programmable Logic Controller (PLC) system, which was specifically designed to interact with those Tate Andale strainers.

4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 2304(c)(1). Only One Responsible Source and No Other Supplies or Services Will
Satisfy Agency Requirements as implemented by Federal Acquisition Regulation (FAR) subpart
6.302-1.
5. Rationale Justifying Use of Cited Statutory Authority
There are Tate Andale strainers installed on board the majority of the US Navy’s Fleet. This commonality and re-usability has streamlined the areas of fleet training and maintenance resulting in significant savings. This complies directly with NAVSEA INSTRUCTION 4120.9 to use products stored on the virtual shelf.
The self-cleaning strainer (SCS) is a chamber strainer housing a cylindrical wedgewire screen made of monel. The SCD provides 800-micron (μm) particulate-level filtration to prevent fouling the parallel plate stacks in the OWS tank. This self-cleaning strainer is controlled by the
Programmable Logic Controller (PLC) in the Main Control Panel (MCP), based upon the differential pressure across the strainer. Whenever the differential pressure across the SCS exceeds predetermined setpoints, the SCS will then automatically backwash the particulate matter to the Waste Oil Tank (WOT) known as “SCS BACKWASH” sequence. Any signal problem between the PLC and the SCS will cause the system to enter in “SYSTEM
SHUTDOWN” state; and the system will be unavailable to operate.
In addition, the three simplex strainers (SS) are single chamber strainers with a removable and cleanable perforated plate basket. Two 3-inch strainers are located between the system inlet and the Oil-Water Separator (OWS) pumps with a required basket perforation size of 3/16-inch.
Additionally, a 5-inch strainer is located directly upstream the Oily Waste Transfer Pump
(OWTP) with a required basket perforation size of 3/8-inch. The primary function of the strainers is to protect the pump elements (i.e., rotor and stator) from debris. Also, the inlet and outlet pressures of the 3-inch simplex strainers are monitored by the PLC. For 5-inch simplex strainer, the differential pressure is monitored by a local differential pressure gage.
As mentioned previously, the Tate Andale strainers are required for the retrofitting of an existing system that is Navy Shock, Vibe and EMI qualified. The required components are replacement parts of the existing main system. Any deviations from using Tate Andale strainers will require re-qualification, re-engineering and re-programming the OWS system. Also, any deviations will require updating the Integrated Logistic System (ILS) package of the system, including technical manual, allowance parts list and planned maintenance schedule.
Tate Andale is the OEM of these strainers; and the company also has sole possession of the design, drawings, specifications, technical information and support documentation such as Navy
Shock, Vibe and EMI qualification approvals of these strainers. In addition, Tate Andale has exclusive data rights for these designs. Therefore, no other company has the rights and technical data to manufacture or modify these strainers.
For the reasons stated above, Tate Andale is the only company that can effectively provide the necessary components needed to meet NSWCPD requirements within the specified schedule and cost constraints without significant risk to the Navy. Award to any other source would result in devastating delays in fulfilling NSWCPD’s requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
As noted above, Tate Andale is the OEM and owns the technical data for the items to be procured. Substitution of other items would require a lengthy and cost prohibitive redesign effort impacting much of the Fleet. Furthermore, Tate Andale does not sell its hardware via distributors. For these reasons, it is not practical to have any other company other than Tate
Andale to provide the required supplies.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable. The same strainers have been procured from this offeror in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable price determination of this procurement.
8. Actions to Remove Barriers to Competition
For the reasons mentioned on Section 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
