JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity The Naval Sea Systems Command, Naval Surface Warfare Center, Philadelphia Division (NSWCPD), Code 0223.
2. Description of Action Being Approved
This is a sole source action to be awarded without providing for full and open competition. The proposed contract action is a Firm Fixed Price (FFP) contract for hardware in support of the Oil Pollution Abatement (OPA) System Improvements Program for USS IWO JIMA (LHD 7) to be awarded to Rockwell Automation Inc., 1 Allen Bradley Drive, Cleveland, OH, 44124-6118.
3. Description of the Supplies or Services
This requirement is for the purchase of two (2) OWS Main Control Panels, one (1) OWS Remote Display Panel and two (2) OWS Variable Frequency Drives.
Two Model VS-50 Oil-Water Separator (OWS) systems are being installed onboard LHD 2 through LHD 8 via Ship Change Document (SCD) 13325 which replaces the existing Model C50/RF01 OWS system with a dual Model VS-50 OWS system. The Model VS-50 OWS is a Programmable Logic Controller (PLC) system that is utilized to achieve full system automation.
The Model VS-50 OWS system consists of the Main Control Panel (MCP), Variable Frequency Drive (VFD), and Remote Display Panel (RDP); in addition to the Electrical Interface Enclosure (EIE), PECOFacet Model C50/M02 OWS tank, Moyno pumps, motorized valves, flowmeters, Oil Content Monitors (OCM), Self-Cleaning Strainers (SCS), pressure transducers, and other ancillary components.
Currently, the Model VS-50 OWS system is already installed onboard USS WASP (LHD 1), USS BLUE RIDGE (LCC-19), USS CARL VINSON (CVN 70), USS THEODORE ROOSEVELT (CVN 71) and USS ABRAHAM LINCOLN (CVN 72). In addition, the Model VS-50 OWS system will be installed onboard USS GEORGE WASHINGTON (CVN 73) during its upcoming Refueling Complex Overhaul (RCOH) availability and onboard USS IWO JIMA (LHD 7) during its Planned Maintenance Availability (PMA) scheduled to start in 9/17/2018. These materials are required prior to the beginning of the availability to conduct preliminary in-house inspection and testing.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The total cost of the purchase is $179,802.88. The funding will be Working Capital Fund FY18. The parts required for this procurement are as follows:

4. Statutory Authority Permitting Other Than Full and Open Competition
41 USC 1901(e)(2), a sole source acquisition under the authority of Simplified Procedures for Certain Commercial Items, as implemented by Federal Acquisition Regulation FAR Subpart 13.501(a).
5. Rationale Justifying Use of Cited Statutory Authority
There are currently PLC based control systems installed on board the majority of the US Navy’s Fleet. PLC based systems consist of various components (processor, power supply, I/O cards) which only function properly when all of those components are produced by the same Original Equipment Manufacturer (OEM).This commonality and re-usability has streamlined the areas of fleet training and maintenance resulting in significant savings. This complies directly with NAVSEA INSTRUCTION 4120.9 to use products stored on the virtual shelf.
Rockwell Automation already has the knowledge, expertise, and qualifications necessary for the OWS control system enclosures. Rockwell has worked with NSWCPD for many years and understands how our systems work and what types of requirements are necessary. It would be unacceptable to award these programs to another contractor because of the uniqueness involved. The amount of training, design work, and engineering that would be required from another contractor has already been accomplished by Rockwell. If the government were forced to re-accomplish these tasks, then costs would be significantly increased and deadlines would be missed due to ramp-up time.
Design work is lengthy and heavily involved on both the government side and the contractor side. From the time the contractor begins lab development, initial design work, product deployment, and finally to the multiple inevitable design iterations, each program would be set back as much as 12 months or more. This would lead to delayed installations or even cancellations for systems that are critical to cost saving initiatives by the government, out of date / obsolete Damage Control Systems, and massive modernization efforts that will help extend the service life of LHD ships.
For the reasons stated above, Rockwell Automation is the only company that can effectively provide the necessary components needed to meet NSWCPD requirements within the specified schedule and cost constraints without significant risk to the Navy. Award to any other source would result in devastating delays in fulfilling NSWCPD’s requirements.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research and surveys are conducted on a regular basis via technology and program reviews, internet searches and various US Navy programs and initiatives to advance the maturity and capability of high energy systems and high temperature superconducting technology. This includes NSWCPD surveys and analysis of alternative equipment brands that are available in industry.
In addition, the proposed acquisition was synopsized via FedBizOps (http://www.fbo) on 31 October 2017, in accordance with FAR Part 5.2. No responses were received by the closing date (15 November 2017) of the synopsis.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine that the anticipated cost to the Government for the supplies covered by the J&A are fair and reasonable, prior to award.
Significant quantities of this requirement have been purchased from Rockwell Automation in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
