JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The contracting activity is the Naval Surface Warfare Center, Philadelphia Division (NSWCPD) Code , Philadelphia, PA.
2. Description of Action Being Approved
This is a sole source action to be awarded without providing for full and open competition. The resultant contract will be awarded as a Firm Fixed Price (FFP) supplies procurement for a replacement hydraulic motor assembly for the COLUMBIA Towed Communications Buoy System at a total estimated cost of $411,136.50 to MacTaggart Scott, UK EH20 9SP.
MacTaggart Scott is registered in the System for Award Management (www.sam.gov) database.
3. Description of Supplies/Services
The proposed contract will allow MacTaggart Scott to manufacture the proposed design as a single prototype hydraulic motor assembly that is qualified for installation onboard U.S. Naval Submarines. MacTaggart Scott will also be required to provide quality assurance through analysis and testing that the hydraulic motor assembly is suitable for use. The completed engineering drawings, test procedures, engineering analysis, critical design review presentation and test results will accompany the prototype as deliverables for the project. The Government requires a form/fit replacement of the current Towed Communications Buoy System hydraulic motor assembly used on OHIO for use on COLUMBIA Class. This form/fit replacement will have improved performance as detailed in the PWS.
The items to be procured under the proposed contract action are as follows:

The total estimated dollar value of this requirement is $411,136.50. The following is a breakdown of the estimated funding amounts for this proposed contract action:

The Government’s minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
10 U.S.C. 230(c)(1), “Only one responsible source and no other supplies or services will satisfy agency requirements.”
5. Rationale Justifying Use of Cited Statutory Authority
The prototype hydraulic motor assembly must be 100% compatible in form and fit with the current Towed Communications Buoy System Hydraulic Motor manufactured by MacTaggart Scott. Any deviations to interfaces, dimensions, size or performance could significantly impact the Government as it pertains to the COLUMBIA Class Towed Communications Buoy System.
The Government Furnished Information (GFI) has already been provided to the Ship Builder (Electric Boat). A non-100% compatible hydraulic motor design would result in modification of the GFI and a significant cost incurred by the Government.
The current Towed Communications Buoy System Hydraulic Motor design, manufactured by MacTaggart Scott, is proprietary. The Government does not own rights to any of the internal drawings or specifications required for design. All detailed external drawings, detailed internal drawings, internal component dimensions, internal component materials, specifications, and manufacturing processes to build the hydraulic motor assembly are proprietary to MacTaggart Scott. The Government only has a limited set of external dimensions relating to the interface requirements and mounting of the hydraulic motor assembly onboard the Ship. The unavailability of detailed technical information from MacTaggart Scott and the proprietary design of the current hydraulic motor would make MacTaggart Scott the only vendor capable of developing an identical form/fit solution that meets all the requirements outlined in the Performance Work Statement (PWS).
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
In accordance with FAR Part 10, a Request for Information (RFI) was posted on the Federal Business Opportunities (FedBizOps) website on April 20, 2018. The Government received responses to this RFI.
In addition, the proposed acquisition was also synopsized in the Federal Business Opportunities (FedBizOps) website on May 1, 2018, in accordance with FAR 5.2. As discussed in paragraph 5, the design of the current hydraulic motor is proprietary to MacTaggart Scott and provides significant cost savings over a non-100% compatible hydraulic motor design that would result in modification of the GFI.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine whether the cost to the Government for the supplies/services covered by this Justification and Approval is be fair and reasonable.
In accordance with FAR 15.402, the Contracting Officer shall ensure that all supplies provided under this contract are procured at a fair and reasonable price. The contractor will submit a formal price proposal with certified cost or pricing data and sufficient information to support the accuracy and reliability of the estimate. Defense Contract Management Agency pricing assistance and/or Defense Contract Audit Agency audit of contractor’s proposal will be requested along with offeror’s certificate of current cost or pricing data at the conclusion of negotiations. The contractor’s proposal will be reviewed by experienced technical analysts, cost analysts and contract specialist with the aid of necessary field pricing support. The Contracting Officer will utilize cost and price analysis as the basis for negotiating a fair and reasonable price.
8. Actions to Remove Barriers to Competition
For reasons set-forth in Section 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. It is essential that the government continue to rely on MacTaggart Scott, who manufactures the current Towed Communications Buoy System Hydraulic Motors. If any other potential sources emerge, the Government will assess whether there is competition for future requirements.
