JUSTIFICATION AND APPROVAL
FOR EXCEPTION TO FAIR OPPORTUNITY
1. Contracting Activity
The Naval Ship Systems Engineering Station, Naval Surface Warfare Center, Philadelphia Division (NSWCPD) Code 0223, Philadelphia, PA.
2. Description of Action Being Approved
This is a sole source action to be awarded without providing for full and open competition. The proposed contract action is a Firm-Fixed-Price (FFP), Requirements contract for hardware in support of the DDG 91 CPS VSD Control Upgrade to be awarded to Rockwell Automation Inc., 1 Allen Bradley Drive, Cleveland, OH, 44124-6118.
3. Description of the Supplies or Services
This acquisition is for hardware from Rockwell Automation as per the attached list of line items. The proposed acquisition will be in support of CPS VSD Control Upgrade on DDG 91 USS PINCKNEY that uses Rockwell Automation Programmable Logic Controller (PLC) and Variable Speed Drives (VSD) product lines supported by NSWCPD Code 518. The acquisition will consist of the PLC Enclosures and VSD Enclosures comprised of multiple PLC processors and Input/Ouput (I/O) assemblies. The enclosures communicate via an integrated network with each other and with the Human Machine Interfaces (HMI).
The Navy’s objective for this requirement is to improve the reliability, maintainability, and efficiency by reducing the Total Ownership Cost (TOC), downtime and improve commonality across ship classes.
The Government’s minimum needs have been verified by the certifying technical and requirements personnel. The total cost of the purchase is $235,010.00. The funding will be Working Capital Fund FY17. The parts required for this procurement are as follows:

4. Authority Permitting an Exception to Fair Opportunity
The statutory authority permitting other than full and open competition is 41 U.S.C. 1901 “Simplified Acquisition Procedures”, as implemented by Federal Acquisition Regulation (FAR) Subpart 13.5.
5. Rationale Justifying Use of Cited Authority
There are currently PLC based control systems installed on board the majority of the US Navy’s Fleet. This commonality and re-usability has streamlined the areas of fleet training and maintenance resulting in significant savings. This complies directly with NAVSEA INSTRUCTION 4120.9 to use products stored on the virtual shelf.
PLC based systems consist of various components (processor, power supply, I/O cards) which only function properly when all of those components are produced by the same Original Equipment Manufacturer (OEM). NSWCPD has conducted several rounds of testing in accordance with Capability Maturity Model Integration (CMMI), system requirements and hardware specifications in order to provide a PLC package to the fleet that is fully tested and debugged prior to deployment. PLC racks cannot have component parts interchanged with different OEM products. Any deviations would induce system malfunctions. This would lead to additional costs for repairs and engineering. These costs would more than double to current IGCE to meet this requirement. Therefore, the capability to procure components directly from a specific OEM is essential. Additionally, the Collective Protection System Control System Upgrade consists of 37 ships installations with 5 ship sets of Rockwell Automation components previously purchased. Any deviation from identical equipment would induce unnecessary engineering and installation cost.
Rockwell PLC Products are the only qualified product line. It also makes Rockwell Automation, Inc. the uniquely qualified supplier to the product described in this acquisition.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
Market research and surveys are conducted on a regular basis via technology and program reviews, internet searches and various US Navy programs and initiatives to advance the maturity and capability of high energy systems and high temperature superconducting technology. This includes NSWCPD surveys and analysis of alternative equipment brands that are available in industry.
In addition, the proposed acquisition was synopsized via Fed Biz Opps (http://www.fedbizopps.gov) on 31 May 2017, in accordance with FAR Part 5.2. No responses were received by the closing date (15 June 2017) of the synopsis.
7. Determination of Fair and Reasonable Costs
The Contracting Officer will determine that the anticipated cost to the Government for the supplies covered by the J&A are fair and reasonable.
Significant quantities of this requirement have been purchased from Rockwell Automation in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
