JUSTIFICATION AND APPROVAL

FOR USE OF OTHER THAN FULL AND OPEN COMPETITION

1. Contracting Activity

The contracting activity is the Naval Surface Warfare Center, Philadelphia Division (NSWCPD), Code 0222.

2. Description of Action Being Approved

This is a sole source procurement to be awarded without providing for full and open competition.

The placement of a Firm, Fixed Price (FFP) purchase order, in accordance with procedures set forth by FAR 13.5 to The MathWorks Inc. for described services herein.

3. Description of Supplies/Services Required to Meet the Agency’s Needs

This procurement is for the purchase of new licenses as well as the renewal of licenses for MathWorks software products.

MathWorks products such as MATLAB software contain a high-level technical computing language and interactive environment for algorithm development, data visualization, data analysis, and numeric computation. MATLAB consists primarily of the core product, MATLAB, a numerical processing engine, and Simulink, a graphical model-based programming environment. The MATLAB software provides unique capabilities in a wide range of applications, including signal and image processing, communications, control design, test and measurement, and financial modeling and analysis. Additional MATLAB software components (toolboxes) are available separately and provide specialized functions. Examples include the SimPowerSystems Toolbox, which provides specialized functions for the design and analysis of simulating electrical power systems. This function is critical as it includes models of electrical power components, including three-phase machines, electric drives, and components for applications such as flexible AC transmission systems, renewable energy systems, harmonic analysis, calculation of total harmonic distortion, and load flow used in ship systems analysis and design.

MATHWORKS TOOLBOX(S) NEW LICENSES

This software is critical to the research and development of electrical power systems under NSWCPD Modeling and simulation lab. The total estimated cost of the MATLAB software maintenance is $333,067.50. This effort will be issued using 2016 Navy Working Capital Funds (NWCF) type funding.

4. Statutory Authority Permitting Other Than Full and Open Competition

The statutory authority permitting other than full and open competition is 10 U.S.C. 2304 (c)(1), “Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements,” as implemented by paragraph 6.302-1 of the Federal Acquisition Regulation

(FAR).

5. Rationale Justifying Use of Cited Statutory Authority

This procurement is for new licenses and the annual software license renewal for existing MathWorks software toolboxes being used in NSWCPD’s labs and modeling and simulation community.

The combination of these toolboxes creates a unique technical advantage that allows us to model complex systems as whole (i.e, mechanical, electrical, imaging) system. To develop such models with other software would require the purchase of multiple software packages. Multiple software packages from different retailers may not interface with each other to simulate integrate systems. This would require software companies to disclose proprietary information to each other to integrate the different systems to produce one system model. MathWorks provides this in one complete package via their various toolboxes. Only MathWorks can provide this capability for the modeling and simulation of the current shipboard systems that we are simulating

Alternatives to Mathwork MATLAB and toolboxes could not be obtained through market research which consisted of online searches, talks with vendors, past procurements and modeling and simulation experience. The Mathworks toolbox suite allow for simulations to be integrated into a complete system (i.e, mechanical, electrical, imaging). For the systems being modeled, no other software package can provide this functional capability. NSWCPD also must be able to verify existing models from third party vendors, contractors and academia that the agency and other members of the shipbuilding community have provided contract work or grants. As these outside parties are using the Mathworks software, NSWCPD must maintain the same level of capability these entities are using in order to verify their models and simulations before transitioning hardware items to the fleet based on those simulation results

The purchase of the additional licensed is to complement our existing modeling and simulation efforts, due to an increase in shipboard component simulation and government personnel. For the reasons set forth herein, Mathworks, Inc are the only source that can provide these units that will enable the NSWCPD to ensure data integrity for technical analyses performed by the NSWCPD.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

On 31 August 2016 this contract action was synopsized on Federal Business Opportunities (https://www.fbo.gov/). As of 15 September 2016, no offerors have notified the NSWCPD Contract Specialist of their capability to complete this effort.

The MathWorks Inc. is the only known vendor of the MatLab and Simulink products. A review of GSA Advantage was performed and the requisite software and support is not available through GSA. A review of the NASA SEWP contract was conducted as well and no other NASA SEWP vendor had the ability to provide NASA with a consolidated contract to provision maintenance and new licenses, for all of NSWCPD. A Google search was performed and no additional sources were found of software that are capable of meeting the current simulation need for tasking upon the NSWCPD modeling and simulation personnel.

7. Determination of Fair and Reasonable Costs

The Contracting Officer will determine whether the cost to the government for the supplies/services covered by this Justification and Approval are fair and reasonable, prior to award.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 6, NSWCPD Code 0222 has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
