About this file

This justification and approval document authorizes a sole source brand name procurement of Siemens industrial control networking hardware for the Naval Sea Systems Command. The procurement includes 244 Siemens Scalance XC-206 network switches, 52 Siemens Scalance XM-408 network switches, and 492 Siemens fiber-optic extension modules to support an engineering control system technology refresh for the USS Zumwalt (DDG1000). The estimated value of the procurement is $393,681 with anticipated delivery within six weeks of award. A sole source justification is being used because the Siemens brand is necessary for technical compatibility and interoperability with the existing Siemens-based control system installed on DDG1000 class ships. Market research found other manufacturers' equipment could not meet the technical requirements or be modified to do so without significantly increased costs and schedule risks.

IN REPLY REFER TO:

4. Statutory Authority Permitting Other Than Full and Open Competition.

41 U.S.C. 1901(e)(2), a sole source (including brand-name) acquisition under the authority of Simplified Procedures for Certain Commercial Products and Commercial Services.

5. Rationale Justifying Use of Cited Statutory Authority.

Siemens is a particular brand name peculiar to one manufacturer. The Siemens brand name, is essential to the Government’s requirements, and market research indicates other companies’ similar products do not meet, or cannot be modified to meet, the agency’s needs. The above listed Siemens brand of equipment is necessary in order to be technically compatible and share commonality with the Engineering Control System (ECS) equipment used in the DDG1000 class of ships. The new equipment must maintain interoperability with portions of the control system that are not being replaced, which are also manufactured by Siemens. Significant expense has already been incurred in developing ECS programs that are compatible with this existing Siemens hardware. Use of equipment manufactured by any other brand will not meet all technical specifications required by the existing Siemens hardware such as support for Media Redundancy Protocol (MRP) and the PROFINET-IRT (isochronos-realtime) standard. Other brands of hardware would also not fulfill the requirement that the existing topology of the ECS network be preserved, due to the type and number of connections necessary on each switch.

While Siemens is the only manufacturer of the selected hardware, their products are sold through various authorized distributors. Multiple vendors can sell these parts to the government.

The cost of replacing the existing Siemens hardware with non-Siemens brand hardware would be much greater than just the difference in price between the hardware available. Because the ECS is currently built with Siemens hardware, and this technical refresh will only replace a subset of the hardware, using non-Siemens hardware would require changes to system components that are outside the scope of the current technical refresh. Additionally, increasing the scope of the tech refresh to include adapting to non-Siemens hardware would introduce unacceptable risk, as the software development process would need to be revised to support the new brand’s development tools. Initial estimates of the additional expense and time required to implement non-Siemens brand name hardware are $1,000,000 and 10,000 person-hours.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable.

A Request for Information (RFI) was posted to SAM.gov on 30 January 2023 which closed on 14 February 2023. Additionally, a synopsis of this procurement was published to SAM.Gov on 16 February 2023 which closed 3 March 2023. No contractors responded to either posting.

Market research indicates other companies’ similar products, or products lacking the particular feature, do not meet, or cannot be modified to meet, the agency’s needs. This Justification will also be posted along with the solicitation on the SAM.gov website. Any responses received will be evaluated.

7. Determination of Fair and Reasonable Costs.

The Contracting Officer has determined the anticipated cost to the Government of the supplies covered by this Justification will be fair and reasonable.

8. Actions to Remove Barriers to Competition.

For the reasons set forth in Paragraph 5, NSWCPD has no plans at this time to compete future contracts for the types of supplies/services covered by this document. If another potential source emerges, NSWCPD will assess whether competition for future requirements is feasible.
