4. Statutory Authority Permitting Other Than Full and Open Competition

10 U.S.C. 2304(c)(1) Only one responsible source and no other supplies or services will satisfy agency requirements. The procedures in FAR subpart 13.5 will be utilized for this procurement in accordance with 41 U.S.C. 1901.

5. Rationale Justifying Use of Cited Statutory Authority

The items described in paragraph 3 must be compatible in all aspects (Form, Fit and Function) to integrate into the current design of the auditorium and meet system requirements. The auditorium can seat 300 guest with a stage deigned to utilize a video wall for presenting.

The 38 ft. wide by 9 ft. stage has clearance to fit a 19 ft. by 11 ft. video wall. Such a video wall size is required to provide optimal viewing angles for the audience in combination with the video panel type. In addition, the stage can support the weight of 1,115 lb. video wall while providing structural support by utilizing the stages back wall. The stage also has six independent 20-amp circuits to support power draws of 16,464 watts.

With a large audience and a small narrow length stage, the PixelFlex panels have a pixel pitch count of 2.6mm and brightness of 1500 Nits that uses less stage area and give visibility to guest sitting in the rear of the auditorium.

With the current design of the auditorium, PixelFlex is the only video wall system that can meet the parameters described above, and provide visibility to all guests within the auditorium.

Other video wall systems cannot match these parameters exactly.

PixelFlex is an Original Equipment manufacturer (OEM) and the only vendor that can provide proper equipment and support rigging apparatus to fit this application.

The infrastructure requirements of the PixelFlex video wall are perfectly suited for the auditorium in which it will be installed. Awarding the video wall to a different vendor would add over in labor and construction costs. It would require 80 hours of engineering redesign including research and analysis of the specifications of the new video wall, determining the new infrastructure requirements, and redrawing of the wiring and connectivity diagrams. At ( dedicated electrical circuits and receptacles have to be installed.

Special structural reinforcement would need to be added to the rear wall of the stage in order to support a wall-mounted (typical) video wall solution, and additional network cables and conduit would need to be installed in order to connect the video wall to the rest of the audio-visual system. All of this construction work would take a team of two (2) approximately seven (7) working days at 10 hours/day. The construction labor would be $ plus another in material. In total, which includes airfare to Saudi Arabia, 40 travel labor hours per person, per diem and lodging of plus a rental car, in travel costs is estimated to be . The Government would not likely recoup the costs if competed.

Market research was conducted to locate same or similar equipment compatible with the current auditorium design and system requirements. No other brand could satisfy the unique requirements brought forth by mission requirements other than what is referenced above.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable

A Sources Sought Notice (SSN) was posted on the Contract Opportunities (SAM.gov) website on 07/22/2021, and closed on of Pixelflex equipment/items. One response was received after the SSN closed from Creation Networks. The information was sent to the customer and their evaluation of Creation Networks capabilities determined that they were capable of supplying the PixelFlex video wall equipment.

7. Determination of Fair and Reasonable Costs

The Contracting Officer has determined that the anticipated costs to the Government for the items covered by this J&A will be fair and reasonable. Significant (or similar) quantities of this requirement have been purchased from this offeror in the past and cost/pricing information was received on those past procurements. This information should be sufficient to support the fair and reasonable cost determination of this procurement.

8. Actions to Remove Barriers to Competition

For the reasons set forth in Paragraph 5, Corona Division, Contracts Department, Code 02 has no plans at this time to compete future contracts for the types of items covered by this document. If another potential source emerges, Code 02 will assess whether competition for future requirements is feasible.
