FAR 16.505(b)(2)(i)(C) The order must be issued on a sole-source basis in the interest of economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. [When utilizing this exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value).]

FAR 16.505(b)(2)(i)(D) It is necessary to place an order to satisfy a minimum guarantee.

3. Rationale Justifying Use of Cited Regulatory Authority.

a.) The Items Described in Paragraph 1 Must Be Compatible In All Aspects (Form, Fit And Function) With Existing Systems Presently Installed.

b.) A Patent, Copyright, or Proprietary Data Limits Competition.

c.) The Items Described in Paragraph 1 Parts/Components for Existing Equipment.

d.) Foreign Military Sales (FMS) Supported By A Case Letter.

The Naval Surface Warfare Center (NSWC), Corona Division, Performance Assessment Department, Code PA44 requires four (4) SEMCO PETRA Systems and two (2) SEMCO PHTS Systems. SEMCO telemetry products have been tested and used under the harsh environmental circumstances including aboard US Naval vessels during live fire missile exercises with outstanding results for many years. SEMCO provided telemetry products are an integral component of the NSWC Corona

RECEIVING & DISTRIBUTION TELEMETRY SYSTEM TELEMETRY DATA

PROCESSING SYSTEM (RDTS/TDPS-C/U). If another brand/manufacturer is chosen, PA44 would need to evaluate and field test the amplifier and simulator systems before deploying, which would cause unacceptable delays in the ability to rapidly deploy the RDTS/TDPS-C/U in support of FMS.

As an industry leader in the aeronautical telemetry market focused on the development and deployment of advanced telemetry products, SEMCO holds several patents and copyrights on it's product line which includes transmitters, receivers and precision drive antenna systems.

PA44 currently maintains a fast declining stock of old legacy PETRA systems manufactured by NSWCDD. These systems have supported countless missile events over the last 30 years. Legacy PETRA systems are reaching the end of their usable life. In order to continue to support naval events worldwide SEMCO is the only company that has designed a direct replacement to these legacy systems at half the size, twice the power output, and a fraction of the cost.
