D FAR 16.505(b)(2)(i)(A) The agency need for the supplies or services is so urgent that providing a fair opportunity would result in unacceptable delays.
D FAR l 6.505(b)(2)(i)(B) Only one awardce is capable of providing the supplies or services required at the level of quality required because the supplies or services ordered are unique or highly specialized D FAR 16.505(b)(2)(i)(C) The order must be issued on a sole-source basis in the interest oJ economy and efficiency because it is a logical follow-on to an order already issued under the contract, provided that all awardees were given a fair opportunity to be considered for the original order. [When utilizing this exception, the rationale shall describe why the relationship between the initial order and the follow-on is logical (e.g., in terms of scope, period of performance, or value).] D FAR 16.505(b)(2)(i)(D) It is necessary to place an order to satisfy a minimum guarantee.
3, Rationale Justifying Use of Cited Regulatorv Authority.
a.) D The Items Described in Paragraph I Must Be Compatible In All Aspects
Form Fit And Function With Existin° S wtems Present! Installed.
b.) D A Patent, Copyright, or Proprietary Data Limits Competition.
c.) The Items Described in Paragraph 1 are "Direct Replacements"
Parts/Components for E,xistillg Equipment.
This equipment Js a direct exact replacement for electrical and size {form, fit function) as the original equipment purchased.
d.) D Foreign Military Sales (FMS) Supported By A Case Letter.
c.) D Unusual and Compelling Urgency.
f.) Ootber: If required, discuss any other rationale that supports the use ofa brand name/sole source for this effort.
4. Implication of Procuring another Brand/Manufacturer.
a.) [81 Unacceptable Delays in Fulfilling the Agency's Requirements.
No other brands were investigated since National instruments is a direct replacement for the SBR ATE used for conducting the Acceptance test requirements.
b.) Substantial Duplication Of Cost To The Government That Is Not Expected
To Be Recovered Throuf!h Competition.
The NI equipment was selected as being the most compatible to use with the NI developed software NIMAX w hich is the primary software in the Acceptance test SBR ATE used to control all interface functions. In using a different brand of equipment other than NI would deviate the configuration management of the 5BR ATE and its source code. If another manufactured device were to be used, the MK41 VLS program would incur reverse engineering costs, source code changes and a lengthy set of tests to insure compatible to interface with the current system installed. This design and testing process would take in excess amount of time, and would be costly to the Government.
c.) Other: if required, discuss any other implication of procuring another brand/manufacturer.
A product other than the specified brand name would cost the Government a total of due to the requirements in the table below. These costs would not be recovered through competition.
It is estimated that it will take approximately Months to complete the requirements to redesign and field a replacement for the SBR ATE. A newly designed SBR ATE would need to be certified before it is fielded. To fully certify the SBR ATE to accomplish the required acceptance test requirements to test an SBR it will need to be tested for several hours and must meet form, fit and function. In Addition to meeting test requirement, new design drawings, specifications and calibration procedures would need to be written. Hence using other untested, unevaluated, and undocumented equipment aside from the requirement provided would preclude the testing of all power systems that NAVY ships outfitted with a Ml<41 VLS
