The government’s minimum needs have been verified by the certifying technical and requirements personnel.

4. Statutory Authority Permitting Other Than Full and Open Competition 10 U.S.C.2304(c)(1). Only one responsible source and no other supplies or services will satisfy agency requirements, as implemented by FAR 6.302-1

5. Rationale Justifying Use of Cited Statutory Authority NSWCCO, Performance Assessment Department (PA) has a requirement to perform analysis and assessment using large data sets. The software being procured is MathWorks MATLAB with various additional toolboxes and the maintenance support for MATLAB and each toolbox. The MATLAB software is used to plot/manipulate/display large data sets in such a way that is currently unavailable with any other tool/software. The period of performance of the maintenance will be a minimum of twelve (12) months.

a) Current Compatibility: The Mathworks MATLAB toolboxes are the current software tool suite utilized by Performance Assessment analysts. Currently, Mathworks is the only source for any and all MATLAB updates required to maintain compliance of current configuration. MATLAB is deeply embedded with other analysis software used in the Performance Assessment Department. Utilizing other software to replace the functionality of MATLAB and all its toolboxes and would require the modification of the Performance Assessment analysis software to integrate it with the current software suite utilized by the Performance Assessment analysts. Considering the use of two (2) full time programmers to develop the analysis software tools concurrently, the preparation for deployment of a different analysis software suite could take up to 6 months. The cost for this integration is estimated to be $250,000 (1 FTE @ ND-04) when accounting for all the computer program changes, testing, and validating of the modified tools. Additionally, the associated effort for the modifications needed to convert multiple existing project files, workstation configurations, and information assurance controls for certification maintenance to adapt to other software is estimated to take a team of four (4) system administrators one month to complete. The cost for those efforts would be $84,000 (.33 FTE @ ND-04). These estimates are based on historical integration costs for similar efforts. This equals a total delay of 7 months and an additional cost of $334,000 to implement any other software tool suite to meet the Government's requirements.

6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable A sources sought notice expressing the Government’s interest in the purchase of MATLAB Licenses and Maintenance Support was posted on the Federal Business Opportunities (FEDBIZOPPS) website on 3 November 2016. The Sources Sought Notice closed on 13 November 2016. There were no interested vendors and MATHWORKS advised that they do not have any authorized distributors.

7. Determination of Fair and Reasonable Costs The Contracting Officer has determined that the anticipated cost to the Government for the supplies covered by the J&A will be fair and reasonable. The Contracting Officer will use price analysis, including historical cost estimating relationships from previous procurements, and commercial price lists, to determine that the final price to the Government is fair and reasonable.

8. Actions to Remove Barriers to Competition For reasons set forth in Paragraph 5, NSWCCO has no plans at this time to compete future contacts for the types of supplies covered by this J&A. If another potential source emerges, NSWCCO will assess whether competition for future requirements is feasible.
